In this case the applicant believes that this phase and the lots in it are already included in the C&R because of the last amendment which he believes added the residue land and does not want to record any additional amendments to this doc prior to final plat approval as he said it's already been recorded for this phase(see attached correspondence w/Jeremy Swink). He requests County Attorney review of the last amended document which he believes covers the phase we're currently reviewing(phase B3,which is listed on the attached plat as Residue A). Please review and provide some guidance to his request. Is this phase already included in the C&R doc or does it still need to be added.
