Dear Mr. Blair:
The above referenced plat is being considered for approval by this office; however, prior to approval one
of the final items required by the ordinance is an instrument evidencing maintenance of certain
improvements as required by Section 14-317,which typically comes in the form of a Covenants and
Restrictions(C&R) document,which outlines maintenance of all required improvements.Typically, when
we have a multi-phase subdivision each phase gets added to the C&R document through a C&R
amendment or Supplementary Declaration to the C&R which adds the various lots in the new phase to
the maintenance doc. In this case the applicant believes that this phase and the lots in it are already
included in the C&R because of the last amendment which he believes added the residue land and does
not want to record any additional amendments to this doc prior to final plat approval as he said it's
already been recorded for this phase(see attached correspondence w/Jeremy Swink). He requests
County Attorney review of the last amended document which he believes covers the phase we're
currently reviewing(phase B3,which is listed on the attached plat as Residue A). Please review and
provide some guidance to his request. Is this phase already included in the C&R doc or does it still need
to be added.
