I am currently working on the resubmittal form and response letter for our Special Use Permit.
Do I need to hand deliver a copy to the County Office Building or should I email it to you?
We never needed additional parking in other lots owned by Sue Albrecht, she brought that up but
we do not wish to pursue that option as it is not necessary. The kitchen is being equipped with a
grease trap and all of our spaces have overhead sprinklers. My meeting with Captain Ayers went
well yesterday and I will be referencing his suggestions in my letter. Other than the questions
about our tournament attendanc e, where there any other concerns? I would hate to miss
something and be charged another $1000.00.

The Special Use Permit application received in the Department of Community Development
on 12/18/2017 has been deemed complete by County staff. The applicant must now pay the
required fee for this application to be further processed for review.
The application fee required for SP-2017-00033 is $2,150.00
Please provide a check to the front office staff in the Department of Community Development
for the amount noted above, payable to the “County of Albemarle,” as soon as possible,
but no later than Friday, December 29th, 2017.
A fee received after Friday, December 29th will require your application to be processed with
the next applicable round of application submittals. Submittal Schedule ***
Also, please provide a copy of this email along with your check as verification that your
fee can be accepted.
ADDITIONAL FEES REQUIRED BUT NOT DUE AT THIS TIME.
Please note that there will be at least one public hearing by the Planning Commission and one
public hearing by the Board of Supervisors. Virginia State Code requires that notice for public
hearings be made by publishing a legal advertisement in the newspaper and by mailing letters
to adjacent property owners. Therefore, at least two fees for public notice are required before
the Board of Supervisors may hear a Special Use Permit.
The total fee for public notice will be provided to you after the final cost is determined and
must be paid before a public body hears the application. Staff estimates the total cost of legal
advertisement and adjacent owner notification to be between $400 and $450 per hearing. This
estimate reflects the average cost of public notice fees for Special Use Permit applications, but
the cost of certain applications may be higher.
If applicable, any fees for waiver/special exceptions will be required at the time the additional
fees noted above are calculated. The current fee for a special exception is $457.
*** Please note that if the application fee is not paid within six months o f the application
being deemed complete, (6/22/2018) then this application will be deemed withdrawn and
all material will either be returned to the applicant or recycled. ***

Good Afternoon,
This email is to let you know that The Rack, Inc. is withdrawing our Special Use Application for Greenbrier
Drive. The property owner, Sue Albrecht of Anvince Land Trust and Design Environs Corporation, refused to
finish the build-out for our space, she attempted to charge us $15,000 for her "administrative fees" in obtaining
the Special Use Permit without our consent, she overcharged us for up fit of our space (violating our lease) and
harassed us to the point of having to leave our location upon the recommendation of our lawyer.
We are looking for a new location in Albemarle Co unty and we truly appreciate the County's support for our
venture.

Staff has reviewed your initial submittal for SP201700031 to add pool tables to a restaurant at 340
Greenbrier Drive.
Planning Comments (Elaine Echols)
Consistency with the Comprehensive Plan
Comments on conformity with the Comprehensive Plan will be provided to the Planning Commission
and Board of Supervisors as part of the staff report when this proposal goes to public hearing or a
worksession.
Land Use:
This project is designated for Office/R&D/Flex/Light Industrial, which allows professional office;
research and development, design, testing of prototypes; manufacturing, assembly, and packaging;
commercial and residential are secondary uses (no maximum density) in the PL29 Master Plan. It
was determined at your preapplication meeting that this use could be considered a secondary use.
Zoning Comments (Rebecca Ragsdale)
Parking -- Based on the recreation parking calculation of 1 space/125 square feet of usable rec area,
there is adequate parking for regular operation of The Rack on this site. However, given that The
Rack is expected to host tournaments, I need more information on the expected number of
attendees to determine parking and recommend parking strategies for tournament days. The
applicants mentioned in the community meeting that shared parking with the abutting property
under common ownership (TMP 061W0-01-0A-009A0) would provide tournament day overflow
parking needs. Zoning will still need to have information on expected # of attendees for
tournaments at The Rack as well as review businesses and required parking on TMP 061W0-01-0A-
009A0 to determine if a shared parking agreement can be approved under Section 4.12.10 and
4.12.08 of the ordinance.

Noise - Since the applicants do not propose music other than a juke box, staff does not have
concerns about noise.
Building Official (Michael Dellinger)
(If the Board approves the special use permit) Plans will need to be drawn by a registered design
professional, as the proposed use appears to be a change of use of the CO to an Assembly use.
Grease trap maybe needed if including a restaurant. May need sprinkler system if not already
installed.

Virginia Department of Transportation Comments – to be forwarded
Additional Planning Comments
The NMD zoning designation anticipated a mixture of uses in this building. This proposed restaurant
with pool tables appears to be consistent and compatible with the nearby uses. Staff recommends that
you resubmit information requested by Zoning, according to the resubmittal schedule. After review,
staff will develop potential conditions for the special use permit for consideration by the Planning
Commission at their public hearing if they recommend approval to the Board of Supervisors.
Action after Receipt of Comments
After you have read this letter, please take one of the actions identified on “Action after Receipt of
Comment Letter” which is attached. Staff recommends that you provide a resubmittal prior to asking for
your Planning Commission public hearing.
Resubmittal
If you choose to resubmit, please use the attached form. There is no fee for the first resubmittal. See
resubmittal schedule is for resubmittal dates.
Notification and Advertisement Fees
When this project is ready to be scheduled for the Planning Commission’s public hearing, a fee of $474
must be paid to cover costs for legal advertisements. The Board of Supervisors public hearing fee of
$259 can be paid with the Planning Commission’s public hearing fee or later. If you wish to provide a
single payment, the total is $733.

ACTION AFTER RECEIPT OF COMMENT LETTER
Within 30 days of the date of this letter, please do one of the following:
(1) Resubmit in response to review comments
(2) Request indefinite deferral
(3) Request that your Planning Commission public hearing date be set
(4) Withdraw your application
(1) Resubmittal in Response to Review Comments
If you plan to resubmit within 30 days, make sure that the resubmittal is on or before a
resubmittal date as published in the project review schedule. The full resubmittal schedule may
be found at www.albemarle.org in the “forms” section at the Community Development page.
Be sure to include the resubmittal form on the last page of your comment letter with your
submittal.
The application fee which you paid covers staff review of the initial submittal and one
resubmittal. Each subsequent resubmittal requires an additional fee. (See attached Fee
Schedule.)
(2) Request Indefinite Deferral
If you plan to resubmit after 30 days from the date of the comment letter, you need to request
an indefinite deferral. Please provide a written request and state your justification for
requesting the deferral. (Indefinite deferral means that you intend t o resubmit/request a
public hearing be set with the Planning Commission after the 30 day period.)
(3) Request Planning Commission Public Hearing Date be Set
At this time, you may schedule a public hearing with the Planning Commission. However, we
do not advise that you go directly to public hearing if staff has identified issues in need of
resolution that can be addressed with a resubmittal.
After outstanding issues have been resolved and/or when you are ready to request a public
hearing, staff will set your public hearing date for the Planning Commission in accordance with
the Planning Commission’s published schedule and as mutually agreed by you and the County.

The staff report and recommendation will be based on the latest information provided by you
with your initial submittal or resubmittal. Please remember that all resubmittals must be made
on or before a resubmittal date.
By no later than twenty-one (21) days before the Planning Commission’s public hearing, a
newspaper advertisement fee and an adjoining owner notification fee must be paid. (See
attached Fee Schedule.) Your comment letter will contain the actual fees you need to pay.
Payment for an additional newspaper advertisement is also required twenty-two (22) days prior
to the Board of Supervisors public hearing.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the
Planning Commission’s public hearing will be allowed during the life of the application. The
only exception to this rule will be extraordinary circumstances, such as a major change in the
project proposal by the applicant or more issues identified by staff that have not previously
been brought to the applicant’s attention. As always, an applicant may request deferral at the
Planning Commission meeting.
(4) Withdraw Your Application
If at any time you wish to withdraw your application, please provide your request in writing.

Failure to Respond
If we have not received a response from you within 30 days, we will contact you again. At that
time, you will be given 10 days to do one of the following: a) request withdrawal of your
application, b) request deferral of your application to a specific Planning Commission date as
mutually agreed to with staff, or c) request indefinite deferral and state your justification for
requesting the deferral. If none of these choices is made within 10 days, staff will schedule
your application for a public hearing based on the information provided with your original
submittal or the latest submittal staff received on a resubmittal date .

Fees paid in cash or by check must be paid at the Community Development Intake
Counter. Make checks payable to the County of Albemarle. Do not send checks directly to the
Review Coordinator. Fees may also be paid by credit card using the secure online payment
system, accessed at

The Police Dept. said “The letter dated February 5, 2018, contains all my recommendations on the Security Plan.”
Zoning said that you had answered all of their questions related to parking.
These were the only outstanding issues, so I don’t think there is any other info you would have needed to provide.
Did you tell me where you were looking for the next possible location? I ask because we may need to schedule another
preapplication meeting, depending on WHERE it is located.

Good Afternoon,
This email is to let you know that The Rack, Inc. is withdrawing our Special Use Application for Greenbrier Drive. The
property owner, Sue Albrecht of Anvince Land Trust and Design Environs Corporation, refused to finish the build-out for our
space, she attempted to charge us $15,000 for her "administrative fees" in obtaining the Special Use Permit without our
consent, she overcharged us for up fit of our space (violating our lease) and harassed us to the point of having to leave our
location upon the recommendation of our lawyer.
We are looking for a new location in Albemarle County and we truly appreciate the County's support for our venture.

Community Meeting-Places 29 Hydraulic CAC-January 22, 2018 Greer Elementary School- The
applicants held the community meeting for The Rack at the Places 29 Hydraulic CAC’s regular
meeting. The property owner provided history of the use of the building at 340 Greenbrier
along with information about its current zoning and tenants. The applicants presented
information about the history of pool and their vision for The Rack, including their proactive
security planning. ACPD officers were present to comment on their concerns and how The Rack
has developed a security plan in advance of opening to help avoid issues. The CAC members did
not offer any objections to the proposed use and complimented the applicants on their well
thought out plans.
The Review for the following application has been completed:

PARKING-Based on the recreation parking calculation of 1 space/125 square feet of usable rec
area, there is adequate parking for regular operation of The Rack on this site. However, given
that The Rack is expected to host tournaments, I need more information on the expected
number of attendees to determine parking and recommend parking strategies for tournament
days. The applicants mentioned in the community meeting that shared parking with the
abutting property under common ownership (TMP 061W0-01-0A-009A0) would provide
tournament day overflow parking needs. Zoning will still need to have information on expected
# of attendees for tournaments at The Rack as well as review businesses and required parking
on TMP 061W0-01-0A-009A0 to determine if a shared parking agreement can be approved
under Section 4.12.10 and 4.12.08 of the ordinance.
NOISE-Since the applicants do not propose music other than a juke box, staff does not have
concerns about noise.
SPECIAL USE PERMIT CONDITIONS-Staff beleives conditions regarding noise or any other
security plan requirements the police recommend may be appropriate conditions of approval.

PROPOSAL: Add pool tables to a restaurant in an existing building
PETITION: Approval under Section 25.2.2.1 of the zoning ordinance for a commercial recreational
establishment for a pool hall in conjunction with a restaurant in an existing building on a 2 acre parcel.
No dwelling units are proposed. Section 25.2.2.1 allows commercial recreational establishments
including but not limited to amusement centers, bowling alleys, pool halls, and dance halls by special

commercial, service and industrial uses.

community meeting. The project will be reviewed by the Hydraulic CAC but is actually in the Rio
Magisterial District. I have advised Sue Albrecht to check in with/get permission from Cynthia if she
wants the community meeting at the next Hydraulic CAC meeting. Since that meeting is coming righ t up,
you might get an invitation before we send you the list of new submittals. I wanted you to be aware that
the project has been accepted for review.
Additional information on the project: A zoning permit is under review for a restaurant with 3 pool
tables in this building at 340 Greenbrier Drive. Four or more pool tables constitute a pool hall for which
a special use permit is required. They would like to have a total of 11 pool tables in the restaurant for
competition/tournament play. The police department has already provided input and will continue to
provide input.
Please let me know if you have questions about what was submitted. I’ll know more after I start the

The maximum, but rarely will happen, is 98 patrons at tournaments.
Rebecca Ragsdale is in process of approving the zoning clearance application for this tenant's
"By Right" first phase of occupancy at 340 Greenbrier Drive. She has a summary of the
building's global parking calculations as well as the hours o f operation for the tenant mix. Please
touch base with her on the parking topic.
There is no outdoor amplified music and indoor music is typically sourced from a jupe box with
the possibility of an occasional disk jockey which would be amplified.
Judi McMullen is one of the officers of The Rack, INC and has my authorization to sign the SP
Application.

Attached is the last plan we reviewed and the last set of comments that I provided to the
applicant. I strongly suggested that they wait until they had worked out all of the outstanding
issues before going to the Commission. In an email, I said:
Major/substantive issues are:
Need to demonstrate the ability to access the property from Avinity Drive for this
development (an access easement or written permission)
Provision of easements for offsite grading and landscaping or written permission to pro vide
Provision of easements for offsite drainage or written permission to provide
Tightness of site – may not be able to meet ARB requirements without reducing area for
something else – the concern is for losing amenity area
Wording on the plan about how affordable housing will be provided (this may or may not be
a substantive issue, depending on the future wording that is provided)
What I perceive to be minor issues:
Providing a vehicular connection to the south
Calculation of open space
Areas where I think we agree to disagree:
Size of PRD/special exception
Elevations to ensure compatibility (Please see my comments in

Sue Albrecht, who owns the property, Jeni Bintzer, or Judy McMullen may be contacting
you to set up a community meeting. The project will be reviewed by the Hydraulic CAC
but is actually in the Rio Magisterial District. I have advised Sue Albrecht to check in
with/get permission from Cynthia if she wants the community meeting at the next
Hydraulic CAC meeting. Since that meeting is coming right up, you might get an
invitation before we send you the list of new submittals. I wanted you to be aware that
the project has been accepted for review.
Additional information on the project: A zoning permit is under review for a restaurant
with 3 pool tables in this building at 340 Greenbrier Drive. Four or more pool tables
constitute a pool hall for which a special use permit is required. They would like to have
a total of 11 pool tables in the restaurant for competition/tournament play. The police
department has already provided input and will continue to provide input.
Please let me know if you have questions about what was submitted. I’ll know more
after I start the review.

harmony with our property neighbors, the County and the ACPD. I hope our withdrawal will not
jeopardize us from this useful information.

a choice we took lightly, we are well aware we will be starting over from scratch and decided it

Most applications for Special Use Permits and Zoning Map Amendment require at least one public hearing by the Planning Commission
and one public hearing by the Board of Supervisors. Virginia State Code requires that notice for public hearings be made by publishing
a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefor e, at least two fees for public notice
are required before a Zoning Map Amendment may be heard by the Board of Supervisors. The total fee for public notice will be
provided to the applicant after the final cost is determined and must be paid before the ap plication is heard by a public body.

Attached are the review comments I have in hand as of today. I am out of the office for the next two
days and they are due to go out on Friday.
I am still waiting on comments from police and VDOT. I am not expecting any recommended changes
from VDOT; however, I need to get written comments from police about your security plan.
Rebecca Ragsdale in Zoning needs additional information about parking as you will see in the letter. You
should probably contact Michael Dellinger, the Building Official, to make sure you know what is needed
for building changes. (You may have already done this.)

The next resubmittal date is on Monday, Feb. 5; however, without police comments I can’t tell you
whether anything more will be needed.
If you want to, you can resubmit the info for Zoning on Monday and, if police needs something, I can
hold that submittal to let you give me what the police dept. needs, pri or to distributing it to other
reviewers.

This email is to let you know that The Rack, Inc. is withdrawing our Special Use Application for
Greenbrier Drive. Our property owner, Sue Albrecht of Advince Land Trust and Design
Environs, has refused to finish the build-out for our space, she has charged us $15,000 for her
"administrative fees" in obtaining the SUP, she has broken our lease four different ways and
harassed us to the point of having to leave our location upon the recommendation of Fran
Lawrence, our lawyer.
We are looking for a new location, maybe Albemarle Square. I hope that Albemarle Co unty will
reflect on Sue Albrecht's attempt to get a Special Use Permit for her "horse farm" and carefully
review her Special Use Application. She enjoys litigation; just look her up the County and City's
Court dockets and you will see why we chose to leave.
We are available for further comment if necessary and truly appreciate the County's support for
our venture. We sincerely hope to be applying for another Special Use Permit with Albemarle
County in the very near future.
