Thank you for contacting us about the steps needed to bring your proposal to the Board of Supervisors
since Clay Greene is no longer a part of your development team. Staff believes the following changes are
needed:
Planning Commission
The Planning Commission recommended approval of ZMA-2014-00006 with the following conditions:
• Make the changes to resolve this issue: The timing language in note 3 on sheet 5 of the application
plan conflicts with the timing language in proffer 3a. The proffer refers to the landscaping being
installed prior to the 7th CO and the other says following the 7th CO. The note and the proffer
language should be made consistent.
• Cash proffers should not be reduced unless sufficient information regarding whether or not the
reduced proffer amount addresses the impacts of this rezoning or sufficient information about the
economic infeasibility is provided
• Demonstrate that access to water exists for the neighboring properties to the south
• Look into the tree issues of concerned property owners to the north.
Staff believes that these items can be resolved by:
• Making the first change in the list above
• Providing information on the costs incurred due to required changes to the plan. Staff can support
a request to reduce cash proffers by the costs incurred to make the required changes to the plan to
comply with fire and rescue comments.
• Providing an additional utility easement from the proposed parking lot closest to Avon Street to the
adjoining property which could be available for water.
• Identifying the location of the trees on the properties of the adjoining owners to the north. If the
trees are located on the property line or within 5 —10 feet of the property line, consider offering to
remove trees on those adjoining properties so as to prevent damage to those trees during
construction.
The next potential BOS hearing date would be in March, either March 1 or March 8, depending on the
Board's agenda. Please provide 4 copies of your revised plan and proffers and submit them no later than
January 30, 2017. 1 will accept these earlier than that date if you can provide them.
