I have attached a copy of the email with the question,as well as letter from the lending agent that was attached to the email,for your reference. This subdivision plat and the associated deed was already approved by the County. You and I worked on it late last fall. At that time of the approval we told them that they could not have a non-family member on the deed or the affidavit,unless the bank mandated that they include the spouse on the deed. They have now gotten a letter from the bank,which they sent me this last Friday. I think that they have already recorded the deed. However,I am not certain of that. Could you tell me if there is any process with the County Attorney's office for them revising the Deed and the affidavit for the,Family Division to include the spouse? Or since we have previously approved the plat and the deed do they just move forward with the change to the deed without involving the County at all? I've attached the documents you just returned to me for your reference. Because Scott remembers other BLA's being allowed in the Ag/For Districts we would like to know at what point,or under what circumstances, would a BLA not be allowed. Is it a matter of the acreage? What other criteria would make one BLA approvable, and another not allowed, other than the criteria delineate in the code for subdivisions that are allowed such as family divisions? We would like have the criteria clarified not only to explain it to my current applicant but also in order to bring this to the other planners so that we will make sure to use those criteria in the future.
