The attached plat for certain real property situated in the County of Albemarle, Virginia
(the "Property"), entitled "SUBDIVISION OF TAX MAP 56 PARCELS 35, 36 & 36A,
CHESTERFIELD LANDING WHITE HALL MAGISTERIAL DISTRICT, ALBEMARLE
COUNTY, VIRGINIA" prepared by Roudabush, Gale & Associates, Inc., dated January 21,
2016, last revised June 17, 2016 (the "Plat"), is hereby submitted for recordation on behalf of
SM Charlottesville, LLC, a Virginia limited liability company ("SM Charlottesville"), in the
Clerk's Office of the Circuit Court of the County of Albemarle, Virginia.
As evidenced by that certain Additional Security Credit Line Deed of Trust and Security
Agreement in the original principal amount of $240,000,000.00 granted by SM Charlottesville to
TRSTE, Inc., a Virginia corporation, as Trustee for the benefit of Wells Fargo Bank, National
Association, as Administrative Agent ("Lender"), dated April 17, 2014, and recorded April 17,
2014, in the Clerk's Office as in Deed Book 4480, page 690, and, as evidenced by various
amendments and modifications thereto recorded in the Clerk's Office in Deed Book 4483, page
686, Deed Book 4593, page 674, and Deed Book 4722, page 182, incrementally increased to
$316,925,000.00, as further amended, modified and supplemented from time to time (all
together, the "Deed of Trust"), SM Charlottesville granted its interest in the Property as
collateral.
Lender joins herein to evidence its consent to the submittal of the Plat and SM
Charlottesville's granting of any rights to the Property thereunder; provided, however Lender
makes no warranty or any representation of any kind or nature concerning the Plat or any of its
elements, terms or provisions, or the legal sufficiency thereof and disavows any such warranty or
representation. Nothing contained herein constitutes a waiver or modification of any of the
terms of the lien of the Deed of Trust, and, by recording this Certificate of Plat, SM
Charlottesville acknowledges that nothing contained herein constitutes any other release,
conveyance or grant in connection with any of the Property or the Deed of Trust.
