County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to
act on any VSMP permit by issuing a project approval or denial. This project is approved. The
rationale is given in the comments below. The application may be resubmitted for approval if all
the items below are satisfactorily addressed. The VSMP application content requirements can be
found in County Code section 17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must
contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
1. Provide an updated, signed registration statement for this disturbed area if it is not already covered
in the existing Old Trail permit. Rev. 1: Comment addressed.
2. Ensure the latest, approved sheets get inserted into the master SWPPP for Old Trail. Rev. 1:

B. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404.

C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a
SWMP. This plan is disapproved, and the reasons are provided in the comments below. The
stormwater management plan content requirements can be found in County Code section 17-403.
1. Provide the Old Trail SWM Master Plan Reference Checklist. Rev. 1: Comment addressed.
2. Provide the Old Trail Water Quality Compliance Tracking Ledger. Rev. 1: Sheet 9 calculations are
for 4.15 AC, but the drainage area on sheet 5 and in the tracker spreadsheet is 4.48 AC. Please

clarify. Also, please clarify facilities BF A-E. The tracker spreadsheet says WPO201600009 in
the big block note, but the column it says WPO201700016. Rev. 2: Comment addressed.
SWM agreement will need to be executed before plan approval. Coordinate with Ana Kilmer for
this process. Rev. 1: Comment addressed. There is a stormwater agreement for the original plan. It
runs with the land/parcel and does not need to be updated with the amendment.
4. Please label the easement around the bioretention and extended detention as "SWM facility
easement". This easement will need to have a plat and a deed. Rev. 1: When will this easement be
recorded? Rev. 2: Comment addressed. Plat is under review.
5. Bottom elevation of the bioretention/extended detention should be lower than the E&S sediment
basin. This will ensure contractor removes all sediment from construction. Currently, it appears
the bottom of both is 661.5. Rev. 1: Comment addressed. Note is sufficient.
6. A channel section is provided on Sheet 4. Please clarify the location of this channel section. Rev.
1: Comment addressed.
7. Provide a liner for the bottom of the extended detention facility. Rev. 1: Comment addressed. Note
is sufficient.
8. Clarify the location of the mitigation area Al. Rev. 1: Comment addressed.
D. Erosion and Sediment Control Plan (ESCP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP.
This plan is approved, and the reasons are provided in the comments below. The erosion control
plan content requirements can be found in County Code section 17-402.
1. Phase II needs a CE with a wash rack. Rev. 1: Comment addressed.
The VSMP permit application and all plans may be resubmitted for approval when all comments have
been satisfactorily addressed. For re -submittals please provide 2 copies of the complete permit package
with a completed application form.
Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to
discuss this review.
Process;
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate
request form and fee to the Department of Community Development. One of the plan reviewers will
prepare estimates and check parcel and easement information based on the approved plans. The County's
Management Analyst will prepare bond agreement forms, which will need to be completed by the owner
and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need
to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to
obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded.
The County's Management Analyst or other staff will prepare the forms and check for ownership and
signature information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ
database for state application processing. DEQ will review the application information based on local
VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid
directly to the state. For fastest processing, this is done electronically with the emails provided on the

application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the
application, they will issue a permit coverage letter. This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference.
Applicants will need to complete the request for a pre -construction conference form, and pay the remainder
of the application fee. The form identifies the contractor and responsible land disturber, and the fee
remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction
conference will be scheduled with the County inspector. At the pre -construction conference, should
everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that
work may begin.

3. Ensure the correct TMP’s are shown on all applicable sheets of the plan.

5. Please label the easement around the bioretention and extended detention as “SWM facility
easement”. This easement will need to be platted with a deed and executed before plan approval.
6. Bottom elevation of the bioretention should be lower than the E&S sediment basin. This will

ensure contractor removes all sediment from construction. Currently, the sediment basin elevation
is higher than the bioretention.
7. Adequate outfall is necessary (subdivision 19 of 9VAC25-840-40). Particularly, concentrated
stormwater runoff leaving a development site shall be discharged directly into an adequate natural
or man-made receiving channel, pipe or storm sewer system. For those sites where runoff is
discharged into a pipe or pipe system, downstream stability analyses at the outfall of the pipe or
pipe system shall be performed. Currently, the proposed concentrated outfall is not into an
adequate channel.
8. Please label the total drainage area and C-factor (or CN) as well as the Tc path on sheet 5. The
drainage divide lines are shown, but the total area and design information is not labeled.
9. Show how 9VAC25-870-98 is met (flooding: 10 yr post is less than 10 yr pre).
10. See attached planting list for Albemarle County. Please specify these plants in your bioretention
landscape plan.
11. A portion of lot 24 and the roadway is shown in the WPO buffer. This is not allowed, even with
mitigation. Please revise.

1. Temporary Sediment Basin 1 as shown in Phase One of the Erosion and Sediment Control Plan is
designed for a drainage area of 4.29 acres, but the drainage area as shown on Phase One is 5.20
acres. Correct Basin sizing to meet correct drainage area of Phase One.
2. Under Sequence of Construction for Erosion and Sediment Control (page 6 of plan set) correct
sequence to have basin installed as part of initial controls along with Super Silt Fence and
Diversions. Major grading cannot begin before all perimeter and initial controls are installed.
