CERTIFICATE OF CORRECTED PLAT
This Certificate of Corrected Plat is made this 25th day of
April, 2001, by Margaret P. Fowler, herein Fowler, and Robert
Hauser Homes, Inc., a Virginia corporation, herein RHH, the two
being collectively referred to herein as the Declarants, and
provides:
On January 5, 2000, RHH recorded a Certificate of Plat dated
January 5, 2000, in the Clerk's Office of the Circuit Court of
Albemarle County, Virginia, in Deed Book 1885, page 158, to which
was attached a subdivision plat dated September 21, 1999, revised
December 1, 1999, prepared by B. Aubrey Huffman & Associates,
Ltd., captioned, "Subdivision Plat Showing Phase 3A, Rivercrest,
Dunlora, Albemarle County, Virginia," herein the Plat, consisting
of seven pages. :Page 5 of the Plat shows a fifty Wit, (50') wide
Emergency Access Basement between Rio Road and She Ridgy
Road, and adjacent thereto an Area Reserved For Ful
,Meadowcreek Parkway Right Of Way. The Plat indicated that-
the Emergency Access Easement and the Reserved Area were owned by
ORHH, when in fact Fowler was, and remains, the fee simple owner
rof a portion of the Emergency Access Easement and all of the
1Reserved Area, both of which lie within the boundaries of Tax
r'Sheet 61, Parcel 164 as identified on the Plat. The parties
desire to correct the error by identifying the property owned by
Fowler, and to evidence Fowler's consent to the terms and
conditions of the Plat in their entirety as expressly modified by
the attached plat dated January 18, 2000, revised January 15,
2001, and April 12, 2001, prepared by B. Aubrey Huffman &
Associates, Ltd., captioned, "Plat Showing Boundary Line
Adjustment And Plat Of Correction, Phase 3A, Rivercrest, Dunlora,
Albemarle County, Virginia," herein the Attached Plat.
In consideration of the sum of Ten Dollars and other
valuable consideration paid by each of the parties to the other,
the receipt and sufficiency of which is hereby acknowledged, the
Declarants hereby evidence their joint and several approval of
the Attached Plat. Any reference to future potential development
is to be deemed as theoretical only. All statements affixed to
the Attached Plat are true and correct to the best of the joint
and several knowledge of the Declarants.
The Declarants further declare that RHH shall be solely
responsible for the construction, maintenance and repair of the
Emergency Access Easement which shall consist of a twelve foot
(12') wide all weather surface with three foot (3') shoulders.
RHH shall keep the Emergency Access Easement free and clear of
snow, ice and any other obstructions that may occur. Any and all

means or methods used to control access to the Emergency Access
Easement, including without limitation gating, must have the
approval Of the relevant Albemarle County officials.
