Comments relating to Emergency Access Easement, or Turn-around:

9. An access easement is proposed for TMP 62F-3 13. Rather than creating an easement,
could this area be conveyed to TMP 62F-313?
11. It is our understanding that the adjacent parcel off of Belvedere Blvd. will be constructed
with private allies and that per Albemarle County Code,an inter-parcel connection with
Dunlora V will not be allowed. As such,Road B will not be considered a stub out and
the alternative Branch Type turnaround should be replaced with a cul-de-sac.
Furthermore,this cul-de-sac will be a permanent turnaround and will need to be located
within dedicated right-of-way.
19.The Secondary Street Acceptance Regulations(SSAR)requires a minimum of two
external connections. It appears that a connection will not be available to Belvedere due
to the development of the adjacent parcel and VDOT has indicated that there will not be a
new connection to Rio Road. Written documentation from the Dunlora HOA needs to be
provided indicating that the HOA will not allow a connection across land currently
owned by the HOA adjacent to Dunlora Drive in order for this SSAR requirement to be
waived.

7. [14-409] Coordination and extension of streets. As discussed,the proposal on the adjacent parcel does
not include a street. the lots are served by an alley. If that proposal is approved,the extension shown on
this plat may not be necessary.this issue can be resolved with the Final Plat. Any change to the road layout
will require an amendment to the road plans.

7. As previously discussed,the branch-type temporary turnaround needs to be replaced with a cul-
de-sac. The cul-de-sac may be offset,and if acceptable to the County and Emergency Services,
may have a 30' radius. This radius is based on the understanding that school buses would not
drive into this section of DunIora, rather, it would pick children up at the intersection with
Shepherd's Ridge Road. In addition, a CG-9 would need to be provided for the emergency access
so that emergency service vehicles would not be driving over the curb. Bollards would still need
to be utilized to prevent normal traffic from accessing Rio Road via this connection.
25. In order to improve plan review cycle times, VDOT has developed checklist to aid in review and
preparation of construction plans. These checklists have been included with this letter and are
recommended to be provided with future submittals.

not include a street. the lots are served by an alley. If that proposal is approved. the extension shown on

Rev1: Comment not fully addressed. During and after the SRC meeting there was much
conversation about how to meet VDOT, Fire Rescue and Engineering comments. It seemed that a
phased plan including a temporary cul-de-sac was the solution to address all concerns. This plan
does not provide the design that was discussed in our meetings and may not satisfy the comments
provided on the original submittal.

The County of Albemarle Planning Division will approve the plat referenced above once the following comments
have been satisfactorily addressed (The following ccmments are those that have been identified at this time.
Additional comments or conditions may be added or eliminated based on further review.): [Each comment is
preceded by the applicable reference, which is to the Subdivision'Zoning Ordinances unless otherwise
specified.]
1. [14-302(A)3] Existing or platted streets. Provide the location and width of Dunlora Drive.
2. [14-302(A)4&5] Private&public easements. Verify that the location and dimensions of all existing and
proposed private and public easements are shown. Proposed easements should be labeled with the
intended holder.
3. [14-302(A)4&5] Private&public easements. Will an easement be necessary for the off-site sewer
connection? If so. show it on the plat and add impacted property owner(s) as signees, or submit a separate
easement plat for review,
4. [14-302(A)4&5] Private&public easements. Clarify the 'proposed access easement' noted on Sheet 1.2.
Sheet 1.1 indicates the intent to vacate the exist ng access easement in what appears to be the same
location: these two notes should be consistent.

For the others, here was my response to John's question if you haven't seen it already:
Developer right to grade within existing Emergency Access Easement,though easement has NOT been dedicated to
public use and lies on a parcel not owned by Developer. This issue needs to be resolved by the Developer and the fee
simple owner of the Emergency Access Easement area because we can't resolve disputes between landowners and
we can't determine private property rights. About the attachment,County records do not show that Margaret P.
Fowler owned the land in 2000/2001 where the Emergency Access Easement area was located (06100-00-00-16400),
though I see that her name shows up on the corrected plat. Since 1998,she has lived in River Run. Since December
1999 Valerie Shepherd has been the sole owner of 06100-00-00-16400 and the Emergency Access Easement area
shows up in that parcel's GIS history,though the County appears to have assigned a separate parcel identification
number for the Emergency Access Easement area.Prior to then, Shepherd co-owned the parcel with Cary Fowler
Rubin,so I don't know what to make of the attachment or the attachment or who has what rights.
Bottom line for the County,though,is that we would expect to find an easement allowing the Developer to enter
the reserved Emergency Access Easement area on the parcel not owned by the Developer.If RHE or its successor
believes that what you have attached gives them the right,then they need to make that call. Obviously,someone is
objecting and the parties need to resolve any disagreement rather than us.As for the statement in the certificate of
plat that"RHH shall be solely responsible for the construction,maintenance and repair of the Emergency Access
Easement,"the parties need to figure out whether it is merely a license(permission to enter and use,and typically
revocable) or an easement(an interest in land to enter and use).

guidance. Since easement issue delays Road Plan Approval,and since Engineering coordinates Road Plan review,this

1/25,LJ Lopez contacted board member(Brad Sheffield)who contacted Mark Graham, seeking assistance. Mark has
asked Bill Fritz to assist. Yesterday,I spoke with LJ Lopez. He asks to meet,and asks that County Attorney's Office
attend.
Road Plan approval is at an impasse until Developer secures right to grade/construct an Emergency Access between(Rio
Rd and Dunlora V subdivision)within the existing Emer.Access Easement on TMP#62F-E2(shown on plat, recorded
Jul 5,2001).
