The Department of Community Development hereby grants approval of a LOR for the improvements described in the letter and shown on the attached site plan sheets dated August 7, 2018. The current proposal modifies the previously approved site plan by relocating a fire line, domestic line, and a sanitary sewer line. It also increases the dimensions of a showroom and reduces dimensions for the maintenance building, and modifies the lighting plan photometrics to match the new light locations. To this end, we hereby certify that all of the existing site light poles and fixtures were installed prior to the August 12, 1998 enactment of Zoning Ordinance Section 4.17.1, or the "Dark Sky Ordinance." Also, as you had discussed with Mr. Myers, the lights located at the front of the site along Seminole Trail are not required to comply with the June 14, 1989 ordinance prohibiting spillover from parking areas because these lights are located in display areas, and not parking areas. All new lighting fixtures will comply with the current ordinance requirements for full cutoff fixtures and spillover requirements. Following is a summery of our rodings. The Owners have kept copies of every drawing of their facilities that has been produmd since the design of the original building which was designed in 1977 and occupied in 1979, With the owners' assistance, I have looked through all existing plaits. In addition, ties 0wriers. have tacked through all purchasingre(wNch only gel back to 1990) relating to their built Mai The owners, also have two employees who have been with the componY since the, construction of the original building and we. were able to interview these two emppoyees. I also made a personal inspection of each light fixture in question where I examined the tis and pole bases then compared thein to other existing poles and uses thatare included on past planning records, Plans that have been referenced in our research include., 1. Original site plan, dated 8110/1977 with revision date 1218178 2. Site Pian to construct a used car facility on the site, dated 1#J W1989 3, Site Plan to construct a Hyundai showroom on the site, dated 122/1004 4. Note that the Owners never requostod or received an 'as -bulk' set of drawings at any of the periods rioted above, • There are 27 existing light flxiures which do not appear on any of the referenced site plans. • No plan could be found anywhere which shows the light fixtures in question. e No purchasing records could be found that indicated a purchase of site light fixtures since 19W, • The employees. who have been with Jim Price Chevrolet since 1979 have no memory of additional light fixtures being installed, At the same time they believed that the fixtures in question haves always been at the current locations. r In a visual inspection of the fixtures in question and an inspection of fixtures that ars recorded on. past site pian indicates that the base and pale of each questioned fixture is identical to those of the fixtures that are on record. This includes signs ofaging, which are identical and suggest that to fixtures were installed at the same line (1978 or 79) . « The site inspection also shows that the pole lights along the north property line that are not shown on plans, have been iGomptately overgrown by :the adjacent evergreen trees, which are shown on the 19771anciscape.plart, Most of the trees have reached or passed the height of the poles and the branches haw spread beyond the pales to where the lighting efficiency is questionable. This suggests that the potes were installed at the same time as the trues, when the trees were small and the distance between pole and tree appeared to the untrained professional to be adequately spaced. As an architect who has worked in this community on and off since 1973 and is familiar with engineering and construction practices as they were at this time, I have come up with what I believe to be the most likely expWation for the absence of 27 light poles on the various record site plans. Based on the information summarized above, I believe that the nein-recorded light fixtures wares installed as a change order during the original construction. Since the site engineer was not needed in order to Install the additional light poles, he never produced any drawings v tich indicated those poles, When the Owners applied for a site plan amendment to add the used car facility in 1989, the Civil Engineer who produced the site plana based his silo plan on the record plan he had prepared in 1877. If he actually went to the site, he did not pay attention to light poles that already existed, As a result, his amendment plan of 1089 only showed what was on the criginat plan from 1977 with the proposed now poles that were lacing added in 19893 The sante thing happ+enO again,in 1994. Evers though the current request is only for a minor amendment to the site plan, It is my recommendation that the current site plan be updated to show all existing conditions as. they are today, including anything And everything haat does not appear on any past record plans. The same should be considered for both site lighting fixtures and for landscape elements. in the ease of landscapes elements, 1 do not suggest recording every individual shrub, but si€rrply. include an accurate record of the areas that are covered by shrubs. Individual trees should be recoil. Parking spaces have already been discussed with the County and I understand that those will be accurately shown on the current plan, along with type of paAing designation.
