Subject: SUB201700129 North Pointe Northwest Residential Area —Final Subdivision Plat
The County of Albemarle Planning Division will recommend approval of the plat referenced above
once the following comments have been satisfactorily addressed. (The following comments are those
that have been identified at this time. Additional comments or conditions maybe added or eliminated
based on further review.): [Each comment is preceded by the applicable reference, which is to the
Subdivision/Zoning Ordinances unless otherwise specified.
General Comments
1. [14-301] Revise scale to 1"=50'. Rev 1. Comment addressed.
2. [14-303(G), ZMA2013-14, ZMA2000-9] Application Plan. Clarify ownership of common
areas. Is open space to be retained by the HOA with an easement dedicated to public use over
certain portions? If so, please state as such and clarify ownership Note 14 on sheet V 1.
Rev 1. The ownership of the open space parcels shall be revised on the plat, as it is not
clear that the County is being dedicated all of open space A, B, and C through fee simple
ownership. Additionally, open space A and B need to be revised to divide out the County
dedicated portion and that of the HOA portion which contains the SWM facilities. The
portions with SWM facilities shall be part of the open space the HOA owns.
To be clear the County seeks fee simple ownership of these open space areas as the
rezoning originally intended, see sheet G of the application plan. Please revise notes and
graphics throughout the plat.
3. [14-303(N)] Are any private streets proposed with this development? If not, this statement
(Note 9) can be removed. Rev 1. Comment addressed.
4. [14-303(Q)] Is the residue lot to be served by public water and sewer? If not, please note such
on the plat. Rev 1. Comment addressed.
5. [14-303(T)] Include note for special lots as required by this section. Rev 1. Comment
addressed.
6. [14-310] Health Director approval is required if the residue lot is to utilize individual private
well and/or individual onsite sewage systems. See attached comments from VDH. Rev 1.
Comment addressed, VDH has approved the soil work.
7. [14-314] Provide deeds for areas to be dedicated to public use for review and approval by the
County Attorney. Also, provide deeds for all public access easements. Rev 1. Comment not
addressed.
8. [14-317] Provide instrument evidencing maintenance of all improvements that are not to be
maintained by the County or other public agency. Rev 1. Comment not addressed.
9. [14-400] Lewis and Clark Drive needs to be built or bonded prior to approval of plat to provide
frontage for lots 1 and 2. Rev 1. Comment partially addressed, as lot 1 is currently depicted
as having frontage on Rte. 29. But what is the purpose of the 69' temporary access
easement? Currently road plans are not approved for Lewis and Clark Drive (public
right -of --way), thus the alignment can and most likely will change. Why plat this
easement? The easement should be revised and platted as a public right -of --way for Lewis
and Clark Drive.
10. [14-400] The .301 acre "future lot" does not have street frontage and is not a permissible lot.
Rev 1. Comment addressed.
11. [ZMA Application Plan] Continuous public access should be provided from the public right-
of-way to the greenway in locations shown on the ZMA application plan. Show public access
easements on sheet V3 to verify that public access is provided to dedicated greenways.
Rev 1. While the easements have been depicted on the plat they do not match the width as
provided for in the final site plan. Ensure the plat and the site plan mirror each other in
location, width, and labeling of these easements.
12. [Comment] This plat cannot be approved until Engineering, ACSA, Parks & Rec, VDOT and
Health Department complete their reviews and grant their approval. Engineering, VDOT and
VDH comments are attached. Additional reviewer's comments will be forwarded upon receipt.
Rev 1. Approvals have been received from ACSA &VDH. Outstanding review comments
exist with Planning, Engineering, Parks and Recreation, and VDOT.
Additional Review Comments on the Revision
13. [Comment] The plat should be held till the Final Site Plan, WPO Plan, and Road Plan are
further along in their reviews and closer to approval to ensure that the easements and
features associated with the proposal are approvable and match these other plan sets.
14. [SP02-72(7B)] In addition to the other open space "dedication to public use" language that
is required on the plat for open space a, b, and c, provide a separate note on the plat that
reads: "The greenway and pathways are dedicated for public use "
15. [ZMA2013-14, ZMA2000-9] Proffer 9.1. The plat should be revised to also include the
necessary SWM easements and public lUW dedication for Lewis and Clark Drive which
cross onto TMP 32-22P. Ensure all applicable platting information is provided to allow this.
16. [ZMA2013-14, ZMA2000-9] Application Plan. The location of the lot line for Open Space
B closest to Lewis &Clark Drive (public R/W) doesn't appear to match the site plan. Staff
is basing this analysis on the location of the existing 50' private access easement. Based on
the application plan the publically dedicated open space should abut the public R/W
dedication.
17. [Comment] On sheet 1, under area calculations, the original TMP is listed as 78-59;
however, this should truly be TMP 32-22K. Revise.
18. [ZMA2013-14, ZMA2000-9] Setbacks. Currently the plat lists the front setback maximum
as 50'; however, 30' is the maximum. Revise it to 30' maximum.
19. [ZMA2013-14, IX, 9.1] Provide all temporary construction easements to allow Stormwater
Basin #10 to be redesigned and enlarged to accommodate the school lot Stormwater.

Engineering —Matthew Wentland
1. A Deed of Dedication will need to be signed and recorded for the SWM facility easements and
the SWM Forest and Open Space easements. This will filled out by the County and forwarded
to the applicant when the plat is nearing approval. A Stormwater Maintenance Agreement will
also need to be completed first, please contact Ana Kilmer to begin that process.
2. Engineering recommends performing the BLA with TMP 32-22P to provide the necessary
ROW width, but this can also be done with the Final Plat
VDOT —Adam Moore/Justin Deel
1. The Route 29 Improvement plans (SUB2016-196) for the entrance of this site and the Road Plan
(SUB2016-112) have not been approved at the time of this letter.
Parks and Recreation -Dan Mahon
1. The County requests this land (greenway and floodway) dedicated be fee simple, not in
easements.
2. A pedestrian crossing/connection under the stream crossing culvert was previously discussed
under the entrance road. Please depict this on the final site plan.

RE: Review pf Proposed Subdivision Plat and attached Soils Information for Individual Onsite
Sewage Systems as part of a division of Tax Map 32 Parce122K located in Albemarle
County, Virginia.
Dear Mr. Cockrell:
On February 2, 2018, the County of Albemarle requested the Virginia Department of Health (via the Albemarle
County Health Department) review the proposed subdivision plat identified above. This letter is to inform you
that the above referenced subdivision plat is approved for individual Onsite Sewage Systems in
accordance with the provisions of the Cade of Virginia, the Sewage Handling and Disposal Regulations,
and local ordinances.
This request for subdivision review was submitted pursuant to the provisions of § 32,1-163.5 of the Code of
Virginia which requires the Health Department to accept private soil evaluations and designs from an
Authorized Onsite Soil Evaluator (AOSE) or a Professional Engineer working in consultation with an AOSE for
residential development. This subdivision was certified as being in compliance with the Board of Health's
Regulations by: Steve Gooch OSE #1940001284. This subdivision approval is issued in reliance upon
that certification.
Pursuant to § 360 of the Regulations this approval is not an assurance that Sewage Disposal System
Construction Permits will be issued for any lot in the subdivision identified above unless that lot is specifically
identified on the above referenced plat as having an approved site for an onsite sewage disposal system, and
unless ail conditions and circumstances are present at the time of application for a permit as are present at the
time of this approval. This subdivision may contain lots that to do not have approved sites for onsite sewage
systems.
This subdivision approval does pertain to the requirements of local ordinances.
