The County of Albemarle Division of Current Development will grant or recommend approval of the Family
Subdivision plat referenced above once the following comments have been addressed: [Each comment is preceded
by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14-303(E),14-412] Based on the available development rights, it is suggested that the 20' easement be
increased to a minimum of 30' wide for future subdivision purposes. Also, revise and labeled the street as:
"New 30' foot Private Street Easement ". Rev 1. Comment addressed.
2. [14-302(10)] Stream Buffers. Depict and label the stream buffer on TMP 130-2B. The stream appears to follow
the property line, same as depicted on Parcel X. Rev 1. Comment addressed.
3. [14-412(A)4] Streets serving family subdivisions. Provide the following note: "The existing and/or proposed
right-of-way is of adequate width and horizontal and vertical alignment to accommodate a travelway passable
by ordinary passenger vehicles in all but temporary extreme weather conditions, together with area adequate
for maintenance of the travelway, as required by section 14-412 of the Albemarle County Code. "

4. [14-303(C)] Boundary lines. On the 1982 plat (see below) which divided TMP 130-2C from Parcel 2B, TMP
130-2C fronts on Rte. 20; however, the plat currently under review doesn't match this and instead gives Parcel
B frontage across Rte. 20 across the entire duration of TMP 130-2C. Please comment on this, revise if
appropriate. Rev 1. Comment addressed.
5. [14-316] Approval of entrance onto public streets. Prior to final plat approval submit documentation from
VDOT that the entrance along State Rte. 20 complies with their standards for the number of lots served by the
entrance. Please provide this documentation. Rev 1. Comment addressed.
6. [14-212(B)] Conditions of approval. The subdivider shall place a restrictive covenant on the lots created by the
family subdivision. A template for this covenant is attached. Please utilize the template and submit the
completed affidavit. County Attorney approval is required prior to final plat approval. Rev 1. Comment still
relevant.
7. [14-309 & 14-3101 Soil evaluations & Health director approval of septic systems. The soil work for the
proposal was sent to the Health Department and is pending a review. Health Director approval is required prior
to final plat approval. Rev 1. Comment still relevant.
8. [14-302(B)1] General Information. When the plat is revised provide the date of the last revision on the plat.
Rev 1. Comment addressed.
9. [Recommendation] Instrument evidencing maintenance of certain improvements. It is recommended a private
street maintenance agreement be provided for the proposed private street. A template for this agreement is
attached. Please utilize the template and submit the completed agreement. Rev 1. Comment still relevant.

10. [14-316] Explain what the "Existing R/W for parcel 3A " is? Is it public right of way that was previously
dedicated, thus making it part of Rte. 20. The reason why I ask, is the new 30' private street easement needs to
touch/connect to Rte. 20. Please address this item.
Staff has provided references to the County Code. The Code is kept up-to-date by the County Attorney's office and
may be found at www.albemarle.or /cg ountycode. In accord with the provisions of Section 14-229(B) of Chapter 14,
if the subdivider fails to submit a revised plat to address all of the requirements within six (6) months after the date
of this letter, then the application shall be deemed voluntarily withdrawn. Please contact Christopher Perez at the
