The County of Albemarle Planning Division will recommend approval of the plat referenced above once the
following comments have been satisfactorily addressed (The following comments are those that have been
identified at this time. Additional comments or conditions may be added or eliminated based on further review.):
[Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless
otherwise specified.]
Conditions of Preliminary Plat Approval (from letter dated 11/16/12):
[14-302(A)4 & 5] Private and Public easements. Any necessary easements must be documented and
approved during the road plan or WPO application process.
Final: Comment not fully addressed. Address the following:
• Provide the reauired documentation to sunaort and create all easements.
• All deeds. aareements and suDDlemental aareements that are reauired for the easements
and maintenance must be submitted, reviewed by the County Attorney's office and recorded
with this plat. For items that require maintenance include a filled out "Review of Private
Improvement Maintenance Instrument" and highlight in the proposed or existing document
where each of the required checklist items are located.
• A Deed of Easement for the public drainage easements must be approved by the County
Attorney's Office and recorded with this plat; please submit for review. See the attached
template.
Rev. 1: Comments not fully addressed. Address the following:
a) The Stormwater deed of dedication and easement should be revised. Please note and address the
following:
i. It appears from the engineering comment that they have a draft of the deed of dedication ready
once the plat is close to completion. Please see there comment.
ii. The County Attorney's office noted that the draft submitted is based on an older template. The
deed will need to be based upon the most current template. Coordinate with Engineering.
iii. Ensure that all stormwater facility and drainage easements are included in the final version of the
deed of dedication.
b) Revise the Supplemental Declaration to add an "and to the following deed descriptions "Lots 92 through
137, inclusive, Westhall Drive, San Marcos Way, Pecos Court, and Phase IV Open Space".
c) Clarify where in the Supplemental Declaration, and the existing Declaration of Covenants, Conditions
and Restrictions, the specific terms for those easements and who has the right/responsibility to maintain
them. The County Attorney's office stated that Article VI, Section 1(e) of the existing declaration only
addressed landscaping in the "Common Area". If the documents to not do so revise them to specify
ownership and maintenance for the proposed landscaping easements.
Final Plat Comments:
7. [Comment] Although Fire Rescue has specified the need for a second fire apparatus access road it is not
required because the approved preliminary plat is still valid. Should you wish to connect through, as
specified by Fire Rescue in order to protect the safety of the development and its residents, contact the
planning reviewer to discuss doing so. Based on the information we have at this time it may be possible to
cross the preserved steep slopes and the public greenway easement. However, that would need to be
verified and if it is possible the steps to do so would need to be determined. It appears that a parcel at the
end of Clearfields Lane (Western Ridge Phase 4A Parcel X - TMP56E-02-C - DB 1698 PG 116) was
"reserved for future road dedication".
Rev. 1: Comment not fully addressed. Planning has been in discussion with Fire Rescue since their
comment was provided (see current comment attached). It is hoped that there will be an updated
comment from Fire Rescue in the near future. Information will be forwarded to you when it is
available. It is the planning reviewers understanding that Fire Rescue will revise their comment,
however planning wishes to get an updated comment from them prior to this comment being fully
addressed because of state codes that could have the ability to override the approved preliminary
plat, despite the preliminary plat still being valid.
8. [14-302(A)2] Vicinity map. Revise the vicinity map to include hatching for Phase IV.

9. [14-302(A)8 &14- 303(D)] Proposed lots; Acreage of lots. Revise sheets 3 to include lot number labels on
all proposed lots.
Rev. 1: Comment not fully addressed. Also include lot numbers for Phase II on sheet 3.
10. [14-302(A)11] Instrument creating property proposed for subdivision. Revise the plat to provide the deed
book and page number of the recorded subdivision plat that created the Phase III residue on Sheet 1. It
appears to be D.B. 5045 Pg. 1-16.

11. [14-302(A)14 & 15, 14- 303(G) & 14-317] Land to be dedicated in fee or reserved; Identification of all
owners and certain interest holders; Ownership of common areas; Instrument evidencing maintenance of
certain improvements. Address the following:
• Provide the required documentation for the creation and ownership of the open space and the
landscape easements.
• All deeds, agreements and supplemental agreements that are required must be submitted reviewed
by the County Attorney's office and recorded with this plat. For items that require maintenance
include a filled out "Review of Private Improvement Maintenance Instrument" and highlight in the
proposed or existing document where each of the required checklist items are located.
Rev. 1: Comments not fully addressed. Address the comments specified in comment #1 above.
12. [14-302(B)6] Tax Map and parcel number. Revise the plat to include the correct TMP for the Phase III
Residue lot in multiple location on the Cover Sheet and on Sheet 2. Please note that the Albemarle County
GIS shows the parcel as TMP 56-53R1.

13. [14-302(B)6] General information. Revise the plat to include scale bars on sheets 4 through 10.

14. [14- 303(A)] Statement of consent to division. Revise the plat to specify the correct information for TMP56-
53R1 in the statement of consent to division.

15. [14- 303(J)] Restrictions. Address the following:
• On the coversheet under "Density (Phase III)" revise the title to be for Phase IV.
• On the coversheet under "Density Platted (Actual)" revise the phase shown in the calculation to be
Phase IV.

16. [14- 303(M)] Street names. Revise the plat to include street names on sheet 3.

17. [Comment] Address the following labeling issues:
a) On sheet 2 the deed book and page number for the phase II portion of Westfield cannot be read. Adjust
the text so that all text can be read.

b) On sheets 3 through 10 add the deed book and page number to the label for the Phase III open spaces.

c) On sheets 7 & 9 revise the label for the "New Easements Legend:" to instead be "Easements Legend"

d) On sheets 7 & 9 under "New Easements Legend:" correctly label the hatch for the Public Greenway
Easement. The hatch for the public greenway is currently labeled as a second "Denotes New 10'
Landscape & Maintenance Easement".

1. The WPD and Road bonds will need to be posted prior to approval_ Estimates have already been provided to Ana Kilmer.
2. A Deed of dedication will need to be signed and recorded for the SWM facility easements. This will filled out by the County
and forwarded to the applicant when the plat is nearing approval. A draft of the deed has been included for review, but will not
be ready for signatures until the plat receives a final revision date.
3. Some of the SWM easements do not match what is shown on the approved road plans, such as the ditch easements on
either side of Lot 125 and the access easement to the facility between Lots 93 and 137_ (Rev. 1) The proposed easement
locations are acceptable. Please be aware that the road bond cannot be released until all as -built structures and SWM access
roads are shown within platted easements_

dated May 23, 2018 (with most recent revision dated July 31; 2O18). It was noted in the attached conditions that all deeds:
agreements and supplemental agreements that are required for the easements and maintenance must be submitted, reviewed
by the County Attorney's office and recorded with the plat. RWSA will need to review the proposed deed of easement for the
access easements to be granted to RWSA. A template can be provided to aid in preparing the document.
