Mr. Winchell:
In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
• The Property is located with the County of Albemarle and is zoned PD-SC, Planned
Development - Shopping Center. The permitted uses of the Property are provided in
Section 25 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). The
Property is subject to the Entrance Corridor ("EC") Overlay, and the Steep Slopes
Overlay Districts as described in Section 30 of Chapter 18 of the Zoning Ordinance.
• The use described in the request letter as a "Quick Service Restaurant with and outdoor
patio and drive thru" is a by -right use within the PD-SC zoning district as a restaurant
and a drive -through window with the approval of an application plan (See next bulleted
item).
• Development of The Property with any use will require the property owner to obtain an
approved application plan as defined in Section 3 and 8 of the Zoning Ordinance. To
obtain approval of an application plan the property must go through the Zoning Map
Amendment process outlined in Section 33.13 thru 33.29.
• Development of the Property will also be subject to Section 32 of the Zoning Ordinance
and to Chapter 17 of the County Code.
This office has no record of an open violation for the Property.
• There are no proceedings, pending or threatened, to revoke, rescind, alter, or declare
invalid any laws, ordinance, codes, approvals, permits or certificates applicable to or
issued in connection with the Property by the County.
• Copies of any applicable records may be obtained via the noted links or from this office
with a request through the department's Records Manager, Paul Bjornsen, at
pbjornsen albemarle.org once they have been approved or issued.
