The plant schedule labeled "middle entrance" identifies plants proposed for the stormwater management facility located near the middle entrance. The plant schedule labeled "southern entrance" identifies plants for the middle and southern entrances as well as the adjacent Route 29 frontage. This note confirms that North Pointe Middle Entrance Project and all existing and future projects associated with North Pointe Development are subject to Part II C technical criteria until 2024,accepting that the VSMP permit for North Pointe will be renewed in 2019 to extend the permit for another permit cycle. I explained yesterday that Part II C technical criteria is secured for all the North Pointe projects until 2024. This note clarifies that statement. Rights established by statute are proscriptive in that they typically establish limits. Continuing coverage under 9VAC25- 870-47 does not allow alteration of conceptual SWM design in wholesale fashion. Zoning Application Plan(Attached) provides general locations of eleven Stormwater Management/Best Management Practice(SWM/BMP)basins(shaded blue)* consisting of retention, detention, and extended detention facilities. The 268 acre project area and off-site areas have been broken down into three(3)overall drainage areas. Overall Summary Analysis&Narrative(SWPPP,Appendix E.b.)states: "The SWM/BMP compilation are(and shall be)designed to route the 2 and 10 year storm events below the pre-development discharge rates at each analysis point. Where possible,the 100 year storm event shall also discharge storm water at or below the pre-development rates where possible." *Note: SWPPP/rev. February 2015 (App.E.b.)refers to thirteen(13) SWM/BMPs. This is confusing. -see Attached SWPPP/Appendix E provides a list of proposed BMPs for the entire development(Attached). It lists phosphorus removal efficiency for each proposed BMP. SWM/BMP design should be constructed as designed and as shown in the Modified Application Plan(conceptual SWM facility layout)wherever possible. There is expectation that deviation from Modified Application Plan SWM design may require Variation to Approved Zoning,which Engineering supports for WPO201500078(replace basins 2&2A with a single basin). Variation to zoning is a Planning action unrelated to WPO review. Engineering encourages Applicant to coordinate variation requirements with planner assigned to project. For the moment,this appears to be Rachel Falkenstein,and I have discussed this with her. Engineering views a single basin in the same general location as the two basins shown on the Modified Application Plan (2&2A)as a functional design equivalent. With the Middle Entrance,the Modified Application plan(conceptual SWM plan)shows two basins,2&2A,designed to treat a 14.1 acre DA(Attached). WPO201500078(North Pointe Middle Entrance&Rt.29 Improvements) shows a single retention basin II(4 x WQV) designed to treat a 11.17 acre DA(C-7A). Continuing coverage Were development plans to change in the extreme it could affect continuing coverage. If,for example, road networks, land use, size/type/location of BMPs, impervious values,etc.to drastically change, or were effect of such change on runoff entering or bypassing treatment facilities shown to increase runoff leaving the development,then,and without considering zoning implications,this could affect continuing coverage. Continuing coverage rewards conceptual or detailed designs that are in fact built. There is a level of subjectivity to what constitutes drastic or substantial design revision. 1 References: Stormwater Pollution Prevention Plan,North Pointe Development, Townes Site Engineering,Rev. Mitchell email-December 03, 2014 10:14 AM) This note affirms continuing coverage for the entire North Pointe Development. 9VAC25-870-47 is applicable. The Modified Application Plan remains relevant. Your note is accurate,Mona,with limits I hope we can accept. Continuing coverage requires,as a condition,an understanding that a conceptual SWM plan exists,that this plan provides reasonable guide to future development. Without this,without underlying calculations and conceptual layout,North Pointe would not be eligible for Part II C technical criteria through 2024. WPO201500078 provides design that falls within acceptable limits. Retention basins 2& 2A may be replaced with a single basin. It is important that routing data and plan labels(or references)reflect what is now proposed—a single retention basin. After consideration and to limit misunderstanding,please discontinue reference to basins 2&2A, since these basins will not be built. This does not and will not jeopardize Part II C technical criteria applicability. Also,as discussed yesterday,while SWPPP submitted with WPO201500078 is a trove of information, from a practical perspective, since phased development may require adjustment at detail design level that departs from conceptual plan, and since inspection relies on SWPPP as a resource document,we encourage a more streamlined SWPPP document with future submittals. I appreciate Townes Site Engineering patience. It took time to resolve issue of 9VAC25-870-47 applicability. This section of VA Administrative Code states, in part(B.): "Land-disturbing activities that obtain an initial state permit or commence land disturbance prior to July 1,2014, shall be conducted in accordance with the Part II C(9VAC25-870-93 et seq.)technical criteria of this chapter. Such projects shall remain subject to the Part II C technical criteria for two additional state permit cycles. After such time, portions of the project not under construction shall become subject to any new technical criteria adopted by the board." North Pointe qualifies for continuing coverage through 2024. Please be mindful to apply for renewal of General VPDES Permit Coverage(VAR10C806)prior to April 1,2019. Failure to obtain permit renewal may forfeit continuing Part II C technical criteria eligibility: Jul 1,2019—Jun 30,2024. We all should try to avoid this,the potential impact of loss of Part II C eligibility on North Pointe development plans. Nothing in this note should be construed as relieving or exempting North Pointe development from any applicable zoning, planning/engineering, land development,or SWM requirement. We rely upon prior zoning action, State/County code, and Planning Div. for review/approval guidance. June 30,2024 is Part II C eligibility end date. Eff. 1-Jul 2024,Part II B technical criteria(or new technical criteria adopted by the state water resources control board)will apply to portions of North Pointe Development not under construction.
