County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to
act on any VSMP permit by issuing a project approval or denial. This plan is denied. The
rationale is given in the comments below. The application may be resubmitted for approval if all
of the items below are satisfactorily addressed. The VSMP application content requirements can
be found in County Code section 17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must
contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
1. Provide a signed registration statement. Rev. 1: Comment addressed.
2. Provide a signed certification. Rev. 1 : Comment addressed.
3. Clarify total disturbed area. Registration statement and narrative say 2.75 AC, however Sheet 4 of
the plan says 3.25 AC and the nature of activity says 3.33 AC. Rev. 1: Comment addressed.
B. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404.
1. The PPP shows disturbance outside of the limit of construction shown on the plans (the parking,
staging, and porta-pottie area). Revise the E&S plan to include perimeter controls for this area.
Rev. 1: Comment addressed.
C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a
SWMP. This plan is disapproved, and the reasons are provided in the comments below. The
stormwater management plan content requirements can be found in County Code section 17-403.

Provide the VRRM spreadsheet showing that no nutrient reduction is necessary. Rev. 1: Comment
addressed, however please put the spreadsheet directly on the plan. Rev. 2: Comment addressed.
Provide additional note on Sheet 3 stating that stormwater quantity and quality requirements are
met. Rev. 1: Comment addressed.
3. Rev. 1: Plat and deed showing SWM forest & open space must be recorded. Rev. 2: Still valid.
N/A
4. Rev. 1: SWM maintenance agreement must be executed. Contact Ana Kilmer (434-296-5832 or
akilmergalbemarle.org) to complete this process. Rev. 2: Still valid. N/A
D. Erosion and Sediment Control Plan (ESOP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP.
This plan is disapproved, and the reasons are provided in the comments below. The erosion control
plan content requirements can be found in County Code section 17-402.
1. Show the wash rack and area for water/sediment to settle out at the construction entrance. Rev. 1:
Comment addressed.
2. Provide diversion dikes to direct water to the sediment basin. Rev. 1: Comment addressed.
3. Show outlet protection detail on plans. Rev. 1: Comment addressed.
4. Show trash rack detail on plans. Rev. 1: Comment addressed.
5. Sheet 2 shows an existing stockpile, however contours do not indicate a stockpile? Please show
correct existing conditions on this sheet. Rev. 1: Comment addressed.
6. Sheet 4 shows only an existing stockpile area, not proposed. Is the stockpile area going to get
bigger? Ensure the entire proposed stoockpile area is shown on this plan. Ensure the perimeter
controls and limits of grading are outside of this area. Rev. 1: Comment addressed.
7. Clarify the final stabilization plan. Provide note stating that 2:1 is the maximum slope for the final
grading plan. Rev. 1: Comment addressed.
8. The baffle calculations do not match the length and width labeled on the plan view. Please clarify.
Rev. 1: Baffle calculations say 117ft x 53.6ft while the plan view shows 11 lft x 39 ft. Rev. 2:
Comment addressed.
9. As discussed on the phone on 9/6/18, please re -submit the plan as a VESCP only, not VSMP.

Control Program Application.pdf
The difference in the fee will be refunded. ($1350 vs $300).
10. Include the attached notes on the plan.
The VSMP permit application and all plans may be resubmitted for approval when all comments have
been satisfactorily addressed. For re -submittals please provide 2 copies of the complete permit package
with a completed application form.
Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to
discuss this review.
Process;
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate
request form and fee to the Department of Community Development. One of the plan reviewers will
prepare estimates and check parcel and easement information based on the approved plans. The County's

Management Analyst will prepare bond agreement forms, which will need to be completed by the owner
and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need
to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to
obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded.
The County's Management Analyst or other staff will prepare the forms and check for ownership and
signature information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ
database for state application processing. DEQ will review the application information based on local
VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid
directly to the state. For fastest processing, this is done electronically with the emails provided on the
application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the
application, they will issue a permit coverage letter. This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference.
Applicants will need to complete the request for a pre -construction conference form, and pay the remainder
of the application fee. The form identifies the contractor and responsible land disturber, and the fee
remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction
conference will be scheduled with the County inspector. At the pre -construction conference, should
everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that
work may begin.
County forms can be found on the county website forms center under engineering;

5.1.28 BORROW, FILL OR WASTE AREAS
1. Each active borrow, fill or waste area shall be shaped and sloped so that no undrained
pockets or stagnant pools of water are created to the maximum extent reasonably practicable
as determined by the program authority. All undrained pockets and stagnant pools of water
resulting from drainage shall be treated as required by the Virginia Department of Health to
eliminate breeding places for mosquitoes and other insects.
2. No fill or waste area shall be located either within the flood hazard overlay district, except as
authorized by section 30.3 of this chapter, or in any stream buffer area as defined by Chapter 17
of the Code of Albemarle. (Amended 10-3-01; 7-3-02)
3. Each fill or waste area shall be only for the disposal of soil or inert materials. The disposal of
any other materials in a fill or waste area is prohibited.
b. If the aggregate area of a borrow, fill or waste activity will be greater than ten thousand (10,000)
square feet, then, as part of any permit issued pursuant to section 17-207 of the Code of Albemarle, the
program authority shall first approve a plan or a narrative for such activity that satisfies the
requirements of subsection (a) and the following:
1. All inert materials shall be transported in compliance with section 13-301 of the Code of
Albemarle. Before a transporting vehicle leaves the parcel or parcels on which the borrow, fill or
waste area is located, it shall be cleaned so that no inert materials outside of the vehicle's load -
bed can be deposited on a public street.
2. The borrow, fill or waste area and the access roads thereto shall be treated or maintained to
prevent dust or debris from blowing or spreading onto adjacent properties or public streets.
Depending on the anticipated intensity and duration of the activity and the character of the
development of adjoining properties, the program authority may require setback, fencing and
landscaping requirements as deemed appropriate, but which shall not exceed the requirements
of sections 30.4.6, 30.4.7 and 30.4.9 of this chapter.
3. Borrow, fill or waste activity involving industrial -type power equipment shall be limited to the
hours of 7:00 a.m. to 9:00 p.m., except in cases of a public emergency declared pursuant to
section 2-1003 of the Code of Albemarle.
4. Borrow, fill or waste activity shall be conducted in a safe manner that maintains lateral
support, in order to minimize any hazard to persons, physical damage to adjacent land and
improvements, and damage to any public street because of slides, sinking, or collapse.
5. The placement of fill or waste shall be completed within one (1) year of its commencement,
except for reclamation activities and any other activities associated with the final stabilization of
the area. The program authority may extend the date of completion upon the written request of
the applicant, demonstrating that factors beyond the control of the applicant prevented the
completion within the one-year period. The program authority may then extend the permit for a
period of time that, in its sole discretion, is determined adequate to complete the work.
Sec. 13-301 Transporting refuse in vehicles. It shall be unlawful for any person to transport any refuse
upon the streets, roads, or highways in the county in a motor vehicle unless the vehicle is constructed or
loaded to prevent any of the load, consisting of the refuse and refuse containers, from dropping, sifting,
leaking or otherwise escaping therefrom. A vehicle may be deemed to be constructed or loaded to
prevent the load from dropping, sifting, leaking or otherwise escaping if the refuse is transported in one
or more secured covered containers within the vehicle which do not allow sifting, leakage or the escape
of refuse therefrom, and each container is loaded in the vehicle in a manner that prevents it from
dropping or otherwise escaping from the vehicle. Any person convicted of violating this section shall be
guilty of a misdemeanor punishable as provided in section 1-115 of the Code.
