Subject: SUB201800149 Riverfront Pantops Boundary Line Adjustment
The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above
once the following comments have been addressed: [Each comment is preceded by the applicable reference,
which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14-302 (A)(5)] Please state the deed book and page number for the South Pantops Drive right of way
in the street name label on Sheet 1.
2. [14-302 (A)(16)] Please show the limits of the Dam Break Inundation Zone on the plat. Please state the
name of the dam to which the DBIZ pertains in Note 6.
3. [14-302 (B)(5)] Please state the primary zoning district and all applicable overlay districts for each
revised parcel. Note 9 should be revised as follows:
a. Add the word "Revised" before each TMP number.
b. Revised TMP 78-15C9 is zoned HC Highway Commercial (portion) and R-15 Residential
(portion).
c. Revised TMP 78-20R is zoned HC Highway Commercial (portion) and R-15 Residential
(portion).
d. Revised TMP 78-20R lies within the Preserved Steep Slopes Overlay District and the FH Flood
Hazard Overlay District.
e. Revised TMP 78-15C9 lies within the Managed and Preserved Steep Slopes Overlay Districts,
and the FH Flood Hazard Overlay District.
4. [14-302 (B)(10)] Please show the location of stream buffers required by the water protection ordinance
on both parcels, with the following note: "The stream buffer(s) shown hereon shall be managed in
accordance with the Albemarle County Water Protection Ordinance."
5. [14-302 (B)(1)] Provide a date of last revision on both sheets.
6. [14-303 (D)] The existing acreage provided for both parcels appears to be incorrect. Please revise the
parcel labels and area calculations as necessary, or provide documentation that the stated acreages are
correct. See below:
a. DB 3354, pages 1-6 plat notes state that TMP 78-15C9 measures 1.280 acres, not 1.279 acres as
currently stated on the plat.
b. DB 2913, pages 156-162 plat notes state that TMP 78-20R measures 5.741 acres, not 5.345
acres as currently stated on the plat.
7. [14-303 (H) and 14-4211 Please add a legend to the plat stating the types of monuments found or that
will be installed, and re -symbolize the property corners to match the legend (i.e. IF = Iron Found, etc.).
8. [14-4001 Please verify the acreages of each primary zoning district that will be within the revised parcel
boundaries for both parcels. The minimum acreage allowed for lots in the R-15 Zoning District is 2,904
sq. ft. Will this amount of square footage be within the revised boundaries of TMP 78-15C9?
a. Staff requests that a note be added stating the acreage and/or square footage of HC and R-15
Zoning Districts that will be within the revised boundaries of both parcels.
9. [14-4051 The revised side lot lines of TMP 78-20R (western parcel boundary) and TMP 78-15C9
(eastern parcel boundary) do not meet the ordinance requirements for being approximately at right
angles or radial to the street line of S. Pantops Drive. The final plat can only be approved if the applicant
submits an Application for Subdivision Variation or Exception for review and approval of an exception
to the side lot line requirements.
a. The Application for Subdivision Variation or Exception must contain all of the information
required by Section 14-203.1 of the Subdivision Ordinance. The exception cannot be approved
unless the applicant submits a justification statement that meets the findings specified in Section
14-203.1 (13)(3) of the Subdivision Ordinance.
b. The applicant may also revise the southeastern parcel boundary of revised TMP 78-15C9 so that
it intersects the western property corner shown at 555.18' 18"E. This will create a 15' long side
parcel line within revised TMP 78-15C9 that extends into the parcel at a right angle from S.
Pantops Drive. This 15' boundary segment is currently shown as part of the revised TMP 78-
20R.
