Approximately 146.07 acres zoned R-1 and HC (Highway Commercial) to NMD Sweetspot of Albemarle, LLC is the owner of Tax Map Parcel 07500-00-00-04800; RBD Gold Eagle, LLC is the owner of Tax Map Parcels 07500-00-00-05300 and 07500-00-00-054A0; The Pines Group, LLC is the owner of Tax Map Parcels 07500-00-00-05400 and 07500-00-00-05600; JW Sieg & Company, Inc. is the owner of Tax Map Parcels 07500-00-00-05500 and 07500-00-00-055C0; all of the owners of such parcels are referred to herein, collectively as the "Owner" and the parcels are referred to herein as the "Property'. The Property is the subject of the rezoning application identified by Albemarle County (the "County') as "ZMA 2022-02" for a project known as "Sieg"(the "Project'), which includes the application plan prepared by Collins Engineering entitled, "Sieg Neighborhood Model District (NMD) Application Plan," last revised June 21, 2022 (the "Application Plan"), and a Code of Development entitled the "Sieg Neighborhood Model Code of Development," last revised on June 20, 2022 (the "Code of Development'). Capitalized terms, not otherwise defined in these Proffers, shall have the same definitions as set forth in either the Code of Development or the Application Plan. Pursuant to Section 33 of the Albemarle County Zoning Ordinance, the Owner hereby voluntarily proffers the conditions listed below which shall be applied to the Property if it is rezoned to the zoning district identified above. These conditions are proffered as a part of the proposed rezoning, and the Owner acknowledges that the conditions are reasonable. 1. Transportation Improvements. A. U.S. 29 at Gold Eagle Drive / Teel Lane. Pursuant to road plans approved by the Virginia Department of Transportation ("VDOr) and as generally described in the Sieg Traffic Impact Analysis, prepared by Ramey Kemp Associates and dated February 2022, the Owner shall construct all median and turn lane improvements on Route 29 at Gold Eagle Drive and Teel Lane, as conceptually depicted on sheet 3 of the Application Plan ("Gold Eagle Drive and Teel Lane Improvements"). The appropriate timing of construction of Gold Eagle Drive and Teel Lane Improvements shall follow VDOT requirements and shall be mutually determined by VDOT, Albemarle County and the Owner during the site plan review process. B. U.S. 29 at Proposed Site Driveway. Pursuant to road plans approved by VDOT and as generally described in the Sieg Traffic Impact Analysis, prepared by Ramey Kemp Associates and dated February 2022, the Owner shall construct improvements within the Route 29 right of way as generally described here. Exact details of improvements and construction shall be as approved by VDOT. The Owner shall construct site driveway access, inclusive of necessary turn lanes, stop lights and other improvements as determined by VDOT near the southern area of the property frontage as conceptually shown on sheet 3 of the Application Plan ("Green T Improvements"). The appropriate timing of construction of the Green T Improvements shall follow VDOT requirements and shall be mutually determined by VDOT, Albemarle County and the Owner during the site plan review process. This Proffer Statement may be executed in any number of counterparts, each of which shall be an original and all of which together shall constitute but one and the same instrument.
