1978-06-21AJune 21,'.1978 (Afternoon-Adjourned from June 14, 1978) An adjourned meeting of the Board of Supervisors of Albemarle County, Virginia, was held on June 21, 1978, at 3:00 P.M. in the Board Room of the County Office Building, Charlottesville, Virginia, said meeting being adjourned from June 14, 1978. Present: Messrs. Lindsay G. Dorrier, Jr., Gerald E. Fisher, J. T. Henley, Jr., F. Anthony Iachetta, C. Timothy Lindstrom and W. S. Roudabush. Officers present: Robert W. Tucker, Jr., County Planner, and George R. St. John, County Attorney; also Mrs. June Moon, Administrative Assistant, sitting in Fhr the County Executive. Agenda Item No. 1. Call to Order. The meeting was called to order at 3:03 P. M. by the Chairman, Mr. Fisher, who noted receipt of a notice that the Northern Piedmont Electric Cooperati~ will be holding a hearing regarding a rate increase on June 26, 1978. Agenda Item No. 2. June 7, 1978.) SP-78-15. F. Bosley Crowther (Biscuit Run). (Deferred from Mr. Fisher said this petition was deferred from June 7 because of questions the Board had about the road networks which would serve the immediate area and in order to try and determine in advance how the traffic would be handled. He questioned, whether four-laning of both Routes 631 and 20 South along the short pieces in front of this property is appropriate, since both the north and south ends of this road would still be two-lanes. He asked if it would not be better to four-lane just one of these roads in order to better manage the traffic all the way to this property .from the City. Mr. Dan Roosevelt, Virginia Department of Highways and Transportation, was present. He said, at the time this project is completed, the traffic count on Route 631 is expected to be 4,500 cars per day, and the traffic count on Route 20 from this property north is expected to be 10,500 cars per day. At this time, Route 20 carries about 2,950 cars per day. Although there are some funds allocated for improvement of Route 20 from Scotts~ille to Charlottesville, there are not enough funds for improvement of the entire section, and the location of these improvements has not yet ~een determined. Mr. Romsevelt said the Highway Department's recommendations were based on trying to get improvements which they know will be needed (4-lane, divided highway) without spending Highway Department funds. Also, the improvements between Charlottesville and this development could not be accomplish- ed without getting additional right-of-way. Mr. Bryan Coburn, Assistant Resident Highway Engineer, suggested that the rights-of-way be dedicated with the first phase of development, and as the entrances are constructed, road improvements in the immediate area be made. Mr. Dorrier asked Mr. Roosevelt if the design criteria for a scenic byway is different from that for a normal highway. Mr. Roosevelt said they are treated the' same; also, if this petition is not approved, improvements to Route 20 probably won't be necessary for many years in the future. Dr. Iachetta asked what improvements the Highway Department will make on Route 631. Mr. Roosevelt said improvements to Route 631 are scheduled in the six year plan, but it will remain a two-lane road. If Biscuit Run is approved, it will be necessary to make it a four-lane road, which would cost approximately $200,000 more. These funds would have to be diverted from some other secondary road project in the County. He further recommended that in order to save the County's secondary road money, that the developer be required to make at least the two-lane road improvements on Route 631. There were no more questions for Mr. Roosevelt, and Mr. Fisher asked Mr. Tucker to discuss the additional conditions he and Mr. Crowther came up with 'since 'the pubIic hearing. Mr. Tucker said condition No. 7 would be changed to read: "Dedication of' the' 30 acre public area to the County of Albemarle, together With up to three aares ~a's''neC'e's~s~ry'for~ the fire department/rescue squad/polic~ fac'ility?" Condition No. i4 changed to read: '"'Wh~ere~ soil erosion permit ~ required~ County Engineer approval of grading and site work on slopes of 15% or greater; ~rovided that not more than 25% of the land area of such slopes shall be graded on any individual site." Also four additional conditions be added: No. 17. "No development shall result in drainage to Lake Reynovia. No. 18. Approval by the Planning Commission of a preliminary master pIan for the industrial area prior to any site plan approval for that area. The preliminary plan at a scale of 1" equals 100' shall show: a) The date of the drawing and north point; b) Boundary lines of the property and departing lot lines of adjoining parcels; topography at a minimum contour interval as available from US~S quadrangles including slope analysis showing ~rades of 0 -.14%; 15 - 24%; and 25% and over; natural drainage channels and easements, water courses and bodies including name, location, and 100-year flood plain limits. c) Proposed land uses including industrial sites, greenspace, and buffer areas, general road alignments with proposed right-of-way widths; general alignment of sidewalks and pedestrian ways, if proposed; general water main layout plan indicating the size and location of lines and the locations of fire hydrants and other appurtenances; general sanitary sewer main layout indicating the size and location of lines, location of pump stations and manholes and other appurtenances; general storm sewer layout indicating the location and sizes of lines and culverts. ~ No. 19. The flow of Biscuit Run shall adhere to those standards required by the State Water Control Board. (Referring both to qdantity and quality of water flow.) No. 20. This special permit shall not be effective until the applicant, or his successors in title under contracts dated February 17, 1978, and March 11, 1978, has title to all the parcels of land comprising the tract, which shall occur no later than October 17 1978. June 21, 1978 (Afternoon-Adjourned from June 14, 1978) 3!5 Mr. Crowther said it was his intent to build the dam as quickly as possible in~ ~onnection with the development of this community. He said he was concerned with all the approvals the dam requires, and how it would affect the entire project. He also felt there is a certain amount of duPlication in vehicle count figures done by the Highway Department, and that possibly the total number of cars projected for Route 20 and Route 631 would not ~ctually be so high~ Mr. Bruce Rasmussen wondered haw many important.problems can be solved at the site plan review stage.' He also noted that the Comprehensive Plan does not ball for develop- ment of a community this large outside the urban area, or for an industrial site this large in the rural area. He said the site is on very steep slopes, and it is not good land for industrial development or residential development. Mr. Butch Houchens said he felt this was the wrong area for an industrial site. Dr. Charles Beegle handed the Board a letter from the Farm Bureau requesting they keep the Biscuit Run site as farm land. He also noted that to ignore the Comprehensive Plan with this request Would leave the Board open to all types of requests in the future, mone of which they would be able to deny. . Mr. Fisher read the letter from Mr. Moffet, Director of Program Development, Virginia Farm Bureau, dated June 21, 1978: "The leadershiP of the Virginia Farm Bureau wishes to express concern to the problem of massive developments taking more igricultural ~and out of production each year. We not o~ly are concerned over the amount of land being diverted to economic development, but the amount of productive land being taken out of production. Public concern is expressed almost daily over rising food cost. Loss of our most productive land will ultimately increase food cost to consumers. The reason is simple, We will have to produce on the poorest land available. This will require more cost to provide productive i~puts that nature once provided. We hope your action will help us preserve our best Agriculture lands." Mrs. COnnie Houchens asked how much of the traffic would be related to the industrial tract of land. Mrs. Jean Beegle asked if any answer has been reached as to the tax rate of the rezoned property. Mr. St. John said that land use taxes are figured on two things, fair makket value and tax on the use itself. The fair market value would immediately change according to the zone whereas the roll back would not be triggered until either a~2at is put to record or~- there is a change in use. ~Mr. Crowther said he did not necessary~gree with the opinion that Mr. St. John had just given regarding the taxation of the property. Dr. Iachetta asked if the developer would be allowed to develop only 10 acres at a time as allowed in the P.U.D. standards. Mr. Tucker said the conditions of "Phasing" would prevent this unless the developer amended his special use permit. Mr. Roosevelt then gave traffic count figures for the industrial portion of the project by itself, saying that there would be approximately 3700 v.t.p.d, toward ~oute 20, and 1600 toward Route 631. He said the difference in development, with or without the industrial site, would require that the four-laning still be done on Route 20, and that on Route 631 a shorter distance would have to be four-laned if the industrial p~rtion is/allowed to be built. ~Z/~//~/~ Mr. Dorrier asked about the water situation. Mr. Tommy~ Thompson of the Albemarle County Service Authority said a feasibility study would have to be made. He said it would be based on the condition that the water systems presently in the area would be made adaptable to the Service Authority's system. Dr. Iachetta offered the following addition to condition number twelve: ~"The interim means of sewage disposal shall require approval by both the Health Department and the Board of Supervisors." In condition number seventeen, Mr. Fisher suggested the addition of the words "any surface water" between the words "in" and "drainage". Discussion next centered on the dam and road intended to cross the proposed dam. Mr. L~ndstrom said he did not want to spend a great deal of time working out the ~ine points if the majority of the Board did not intend to vote for approval of the overall plan. Mr. Fisher summarized his opinions by saying that h~ could not vote in favor of the plan if ~he industrial site is included, mainly because it would create the need to either change the Comprehensive Plan in order to conform, or create a situation where the site does not conform with the Plan. Mr. Lindstrom said he could not vote in favor of this project mainly because he feels it is inconsistent with the area designated "urban" in the Comprehensive Plan. He also felt it was inconsistent with the jurisdictional boundaries of the Albemarle County Service Authority. He also felt the proposed roads for the community and those leading toward the community were totally inadequate for the proposed increase in population. Mr. Dorrier said he could not support this proposal, mainly because he felt the in- dustrial portion was incompatible with the surrounding lands and Comprehensive Plan. Mr. Roudabush and Mr. Henley both said they supported the concept of the plan, mainly because it typified the description in the Comprehensive Plan of a Planned Unit Development. 316 June 21, 1978 (Afternoon-Adjourned from June 14, 1978) June 21~ 1978 (Regular-Night ~ Mr. Lindstrom offered motion that the Board approve the basic concept of the plan presented. If the vote for the motion is favorable, they go on to vote on the specific conditions of'the special permit. Motion was seconded by Mr. Roudabush. Mr. St. John recommended against taking such vote, and recommended the Chairman just take a poll of the Baard. Mr. Lindstrom withdrew his motion. Mr. Lindstrom then offered the following motion; to deny the application for SP-78-15 as proposed. Motion was seconded by Dr. Iachetta, and carried by the following recorded vote: AYES: NAYS: Messrs. Dorrier, Fisher, Iachetta and Lindstrom. Messrs. Henley and Roudabush. Dr. Iachetta commented that this application was too big and too early in this location. Mr. Dorrier said it was a difficult decision because the plan had a great deal of merit, but he couldn't support the plan because of the location and the proposed industry on the site. Mr. Lindstrom hoped the Board would seriously restudy the Planned Unit Development part of the Zoning Ordinance before one is approved that is seriously inadequate. Agenda Item No. 6. Mr. Fisher noted the time has run out for the remainder of the agenda, but h~. requested a motion to go into executive session to discuss personnel matters. Motion to this effect was offered at 5:45 P.M. by Mr. Roudabush, seconded by Mr. Lindstrom, and carried by the following recorded vote: AYES: NAYS: Messrs. Dorrier, Fisher, Henley, Iachetta, Lindstrom and Roudabush. None. The Board reconvened into open session at 7:30 P.M. and immediately adjourned. Call to order: the Chairman, Mr. Fisher. The meeting was called to order at 7:30 P.M. by Agenda Item No. 4. Meeting Dates: (from the June 21, 1978, Afternoon Agenda.) Discussion of July Mr. Fisher said a survey indicated that a quorum would not be present for the meeting of July 19th, but that all Board members could be present at an alternate date of August 7, 1978, which is a Monday night. Motion was offered by Dr. Iachetta, seconded by Mr. Roudabush, to cancel the meeting of July 19, 1978, and advertise all public hearings scheduled for that night for August 7, 1978, at 7:30 P.M. in the Albemarle County Courthouse.
