1975-03-31A3-31-75 An adjourned meeting of the Board of Supervisors of Albemarle County, Virginia, was held on March 31, 1975 at 4:00 P.M. in the Board Room of the County Office Building Charlottesville, Vir- ~i~a, said meeting being adjourned from March 27, 1975. PRESENT: Absent: Messrs. Stuart F. Carwile, Gerald E. Fisher, J.T. Henley, Jr., William C. Thacker, Jr., Gordon L. Wheeler, Lloyd F. Wood, Jr. None. OFFICERS PRESENT: Mr. T. M. Batchelor, Jr., County Executive. The meeting began however at 4:25 P.M. The Chairman requested an executive session to discuss personnel matters. Motion was offered by Mr. Wood, seconded by Mr. Fisher and carried by the fol- lowing recorded vote: AYES: NAYS: Messrs. Carwile, Fisher, Henley, Thacker, Wheeler and Wood. None. The Board reconvened at 6:00 P.M. and recessed for supper. The first item on the 7:30 P.M. agenda was to adopt a resolution abandoning sections of Milton Road. Mr. Gordon Wheeler abstained from discussion on this matter, and Mr. William Thacker took the Chair. Mr. Frederick Payne, Deputy County Attorney, presented the proposed resolution which reads as follows: WHEREAS, a portion of State Route 729 has been altered; (Project #0729-002-I32, C501) and; WHEREAS, a new road has been constructed in lieu of the old which serves the same citizens; and WHEREAS, a portion of the old road is no longer necessary to be retained as a public road; and WHEREAS the remainder of the old road is needed to provi~de public access to certain park facilities to be constructed by the County of Albemarle; NOW THEREFORE BE'IT RESOLVED by the Board of Supervisors of Albemarle County as follows: 1. That the portion of State Route #729 lying on the westerly side of the Rivanna River between the center line thereof and the intersection of the said portion and State Route #732, being further described as that portion of old State Route #729 lying between station 43+50 and station 27+50 as shown on the records of the Virginia Depart- ment of Highways, be and the same hereby is, abandoned pursuant to Section 33.1-155 of the Code of Virginia (1950), as amended; 2. That the Virginia Department of Highways be, and it hereby is, requested to accept for maintenance as part of the State Secondary Highway System the newly constructed portion of State Route #729 lying between station 30+00 and station 44+20.52 on the records of the Virginia Department of Highways; and 3. That the Virginia Department of Highways be, and it hereby is, requested to continue maintenance of the remaining portion of old State Route #729 lying on the easterly side of the Rivanna River between the center line thereof and the newly constructed portion of State Route #729, being furthe~ described as that portion of old State Route #729 lying between station 30+00 and station 43+50 on the records of the Virginia Department of Highways, such remaining portion to be used for access to the park facilities to be constructed by the County of Albemarle on the easterly bank of the Rivanna River. Mr. Joseph Henley stated a guard rail would be put up and that the State indicated they would ~ake a turn-around up to the guard rail. He also noted there was adequate parking on the road, and hat a fence would have to be put up between the turn-around area and the road, costing approxi- .ate!y $500. Mr. Sampson added that an adjacent property owner, Mr. Garrett W. Kirksey was in agreement with andling the boat launch site in the proposed manner. He said Mr. Kirksey's only request was that he Parks Department maintain the area, keep it clean, and install the fence to keep out trespassers. Motion to adopt the aforementioned resolution as presented, was made by Mr. Henley, seconded by r. Wood, and carried by the following recorded vote: YES: Messrs. Carwile, Fisher, Henley, Thacker, and Wood. AYS: None. BSTAIN: Mr. Wheeler. The remainder of .the meeting was a work-session devoted to the discussion of the 1975-76 roposed budget. The Board reviewed each department's budget requests, and indicated final changes hich would be presented at the public hearing on April !6th. Chairman 4-9-75 (Night) A regular meeting of the Board of Supervisors of Albemarle County, Virginia, was held on April 9, 1975, at 7:30 P.M. in the Albemarle County Courthouse, Charlottesville, Virginia. Presenb: Messrs. Stuart F. Carwile, Gerald E. Fisher, William C. Thacker, Jr. and Lloyd F. Wood, Jr. Absent: Messrs. J. T. Henley, Jr. and Gordon L. Wheeler. Officers present: County Executive, T. M. Mr. Tucker said the applicant has again requested that these petitions be deferred for at least one month. Motion was offered by Mr. Wood, seconded by Mr. Fisher, to defer any action until May 28, 1975. The motion-carried by the following recorded vote: AYES: Messrs. Fisher, Thacker and Wood. NAYS: None. ABSENT: Messrs. Henley and Wheeler. ABSTAINING: Mr. Carwile. No. 2. Marshall Manors Subdivision: Request for restricted road and waiver of lot size requiremen' for individual well and septic systems. (Deferred from March '12, 1975.) Mr. Tucker said there are 41 lots shown on the plat. Five have already been recorded. There are eight lots in the subdivision which are below the minimum requirements of 60,000 square feet and these lots require a waiver. The property is zoned R-1. The average lot size if 2..3 acres, with the minimum lot size being 1.14 acres. This restricted road is for Rima~Ridge Road and will serve only three lots. The Planning Commission approved the waiver of minimum lot size and they also recommend approval of the restricted ro~d with the following conditions: 1) and 2) The County Engineer's approval of road plans for the restricted road; County Attorney's approval of~the deed restrictions concerning the restricted road. Mr. Fisher asked the minimum acreage required by the Subdivision Ordinance for Ri. Mr. Tucker said it is 1.38 acres or 60,000 square feet. Mr. Fisher asked if these lots were put to record before adoption of the new ordinance. Mr. Tucker said no. There was a preliminary plat on file, but it expired a year ago. Mr. William Roudabush was present to represent the applicant. He said the preliminary plat was presented several years ago, based on the subdivision ordinance in existence at that time. The final plat was drawn and ready to be submitted, but Mr. Marshall decided to build the roads to state standards, at his leisure. During that .time, requirements changed. The roads have now been complet~ but without final stone and surface treatment. The plat has been redrawn to alter lot lines to conform to the 60,000 square feet requirement where this could be done without losin~ lots. Mr. Roudabush said percolation has been no problem. The wells drilled do deliver a sufficient quantity of water. This request is for a restricted road to serve lots 11, 12 and 13. The remalnder of the roads in Marshall Manors will be State-maintained. The Highway Department has approved plans for the road. Motion was offered by Mr. Wood to approve a waiver of minimum lots sizes as recommended by the Planning Commission and a restricted road, with deed restrictions'approved by the County Attorney's Office. The motion was second, ed by Mr. Carwile and carried by the following recorded vote: AYES: Messrs. Carwile, Fisher, Thacker, and Wood. NAYS: None. ABSENT: Messrs. Henley and Wheeler. No. 3. Lewis Hill Subdivision: lots zoned A-1. Restricted road located on east side of Route 678 to serve seven Mr. Tucker said this request was approved by the Planning Commission. The road plans have bee~ approved by the County Engineer and the deed restrictions by the County Attorney.
