He stated that Mr. Moyer is head of the transportation di~ion~of the Post Office located on Route 29 and head of their safety committee. PRESENT: Messrs. Stuart F; Carwile, Gerald E. Fisher, J.T. Henley, Jr., William C. Thacker, Jr., Gordon L. Wheeler, and Lloyd F. Wood, Jr. ABSENT: None. OFFICERS PRESENT: Mr. T.M. Batchelor, Jr., County Executive. 8-7-75 231 Mr. Gordon Wheeler called the meeting to order at 4:08 P.M., and requested an executive session to discuss personnel matters, and a legal matter at the Board's discretion. Motion to go into executive session was made by Mr. Carwile, seconded by Mr. Thacker , and carried by the following recorded vote: AYES: NAYS: Messrs. Mr. Wheeler reconvened the Board back into open session at 4:54 P.M., and proceeded to read a letter handed to him, addressed to the Board of County Supervisors as follows: Mr. Wheeler: Gentlemen, I would like to recommend to the Board p ' Mr. Batchelor's resignation, effective September 1, 1975, and to grant to Mr. Batchelor severence pay in the amount of five months of his salary. What is the pleasure of the Board? Mr. Lloyd F. Wood: Mr. Chairman, I would move the adoption of your resolution, and your recommendati¢ to accept Mr. Batchelor's resignation and offer him five months severence pay. Mr. Wheeler: Do I hear a second? Mr. Stuart F. Carwile: Second. Mr. Wheeler: Gentlemen, before we vote on the motion, I certainly have some comments I'd like to make. I wonder if other Board members have some comments they would like to make. Mr. Henley, do you have any comments you'd like to make? Mr. Henley: Well, I guess there are a lot of things that should be said. I think Tom as well as this present Board has been through a lot, and I think Tom has done well and I think this Board~ has done well considering the problems that we've had. I think Tom has been a capable County Exec~ve, I haven't always agreed with him, but I think he was certainly capable and put forth an honest and 100% effort in carrying out his job. I would like to say though, that I can't support five months severence pay. As I said earlier, I would like to know some experiences of other localities in a situation like this, and since I don't have them, I'll just have to "fly by the seat of my pants", but I think that is a little bit too much. Maybe it's not for what Tom has been through, but I feel this way. Mr.-Carwile: I agree with everything that Mr. Henley said, except for the last part about supporting the motion. It is with personal regret that I see Tom submit his resignation to the Count~ I think he's done a commendable job on behalf of the County and the citizens, and I think this Board and this County will have a difficult time finding a future County Executive that can replace Mr. Batchelor and do the job that he's done for us. Mr. Wood: Mr. Chairman, I can agree wholeheartedly with what Stuart has said, and I know from personal experience of talking to other counties around the State and having seen other County Executives and Executive Secretaries work around the State that Tom is looked upon among his peers as among the best in the state. He has been honored by that group, and it is going to be a difficult task to replace a man of Tom Batchelor's caliber and qualifications. We've been through a lot of ups and a lot of downs in the going on seven years, Gordon, you and I've served here. Tom, you came on a year or two before Gordon and I did, and it kind of gets to me right inside. I kind of feel that Tom is part of the family, and has done an outstanding job. I've come to know his family well, B.J. and his children~ I don't know what his new job capacity is going to be, but it is my sincere hope that he is going to stay in the community. He is a tremendous citizen, and I just couldn't say enough good things about Tom. It is with deep regret that I accept his resignation, and as far as the severence pay, I think five months would be a minimum. t would like to see us do more. Mr. Thacker: Mr. Chairman, I think anything I would say would be repetitious, but I too v~ew this with deep regret. I think Mr. Batchelor has performed an outstanding service to this community, and he is going to be an awfully difficult person to replace. I think on the otherhand too, that Tom-has probably gone through a great deal more than any of these Board members. I for one appreciate what he has put up with and has had to put up with. I certainly wish him well in any future endeavor and I have every intention of supporting this motion. Mr. Fisher: As one member of this Board who has perhaps disagreed with Mr. Batchelor more than anybody else on the Board, I want to state that I agree with his statement, that it is time for a change in administration. I bear him no personal enmity, and I hope he does well in his new positon. I do not feel that I can support the five months severence pay. Mr. Carwile: I'd like to suggest one other thing, Mr. Wheeler, that you appoint a committee of Board members to draw up an appropriate resolution of appreciation of service from the Board. Mr. Wheeler: I certainly expect to do that, and I don't believe there.would be any objections. Gentlemen, I certainly expect to support the motion, and I do have some comments I'd like to make. Tom, in seven and a half years, we've had many battle royals, I think our battles have been fought over what we thought was good for the County. I certainly think you made a contribution to this community, and I think you might be in the same position as our former president, Harry Truman, who had many critics and who just now is being recognized as one of our finer presidents~. I think some of the things that you and I have battled over, and the Board has battled over and the staff has battled over is the watershed program, which you and I and the citizens of this county won't recognize what it is until some years to come. Our recreation program, our school program, that you certainly had a hand in, our building pro- gram, any number of other programs that maybe don't come to mind right now, but this County is moving forward, and I don't believe there is a citizen of this County who would say that this isn't a better place to live right here in 1975, this day of August 7th, then it was when we started out back on January 1, 1968 or when you started ou~ as County Executive. Probably one of the biggest things to be said about Albemarle County during your tenure as County Executive, I think you told me, and in talking to Ray Jones, that you came in here and in order to operate we were at the point of borrowing money. We've gone through, as you know, some quick decisions that have been a drain on the finances of this County, and you leave this County with a surplus that we can operate with and be proud of and this County (as far as finances) is one of the strongest counties in the State of Virginia. I think you'll find as the years go by, that,-you will remember the favor you brought to this County, and you will be proud of it, and I enjoyed serving with you. Let's vote on this. AYES: ..~essrs. Chairman 8-13-75 A regular meeting of the Board of Supervisors of Albemarle County, Virginia, was held on August 13, 1975 at 7:30 P.M., in the Albemarle County Courthouse, Charlottesville, Virginia. PRESENT: Messrs. Stuart F. Carwile, Gerald E. Fisher, J. T. Henley, Jr., William C. Thacker, Jr., Gordon L. Wheeler and Lloyd F. Wood, Jr. OFFICERS PRESENT: Messrs. T. M. Batchelor, Jr., County Executive; Robert Sampson, Assistant to County Executive; James Bowling and Frederick Payne, Deputy Counvy Attorneys; George R. St. John, County Attorney; Hartwell Clarke, Zoning Administrator & Building Inspector; and Mrs. Mary Joy Scala, Senior Planner. Meeting was called to order at '7:35 P.M. No. 1. Moratorium Clarification. Mr. Wheeler noted that the emergency ordinance adopted on August 6, 1975, temporarily prohibiting the County-of Albemarle from accepting or acting upon certain applications relating to development in the watershed of the South Rivanna River Reservoir, needed clarification, as certain problems have arisen since its enactment. Mr. Batchalor commented that this amendment to the ordinance would allow for repair or replacement of structures neces- sitated by forces beyond the control of the owners of the structures. Mr. St. John presented a resolution to the Board, which was read into the record by Mr. Fisher. WHEREAS, on August 6, 1975, the Board of Supervisors of Albemarle County enacted a certain ordinance temporarily prohibiting the CoUnty of Albemarle from accepting or acting upon certain applications relating to development in the watershed of the South Rivanna River Reservoir (Hereinafter referred to as the Interim Moratorium Ordinance); and WHEREAS, through an oversight, no provision was made in the said ordinance for the issuance of building permits on an emergency basis to permit the repair and/or reconstruction of structures necessitated by forces beyond the control of-the owners of such structures; NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Albemarle County that~ Section (6) of the Albemarle County Interim Moratorium Ordinance be, and the same hereby is,' amended by the addition thereto of the following proviso: (1) "provided,~ however, that, nothing in this Ordinance shall be construed to prohibit the issuance of building permits for the repair and/or reconstruction of any structure which repair and/or reconstruction is necessitated by forces beyond the control of the owner of such structure, which repair and/or reconstruction shall be necessary to prevent a clearly demonstrable hardship approaching confiscation or a situation dangerous to the public health, safety and welfare, and which repair and/or reconstruction will, in the opinion of the~Albemarle County Building Official, have no significant impact on the qualify of water in the South Rivanna River Reservoir;" (2) An emergency being found to exist, this amendment shall be effective immediately. Mr. Thacker said the moratorium he prop@sed ~on~-Au$~st ~h_i~posed more hardship to the public than he expected or intended. He did not intend to preclude repairs, single-family homes, renovation or improvement type work, and could see no harm in allowing repair work of the nature proposed at Miller School. Mr'. Thacker offered motion to adopt the resolution as presented, to be effective immediately. Mr. Fisher asked for a definition of reconstruction, and Mr. Thacker said in his opinion it would mean restoring a building to its original condition, not an addition thereto. Mr. Wood suggested in order to simplify the handling of the proposed ordinance amendment, Mr. Hartwell Clarke, Building Official, be allowed to issue emergency permits at his discretion, pro- vided he is given the proper guidelines. Mr. Thacker asked Mr. Clarke if he felt this ordinance could be implemented in this fashion. Mr. Clarks's comments were inaudible to the clerk. Mr. Carwile said he felt the Building Official could probably handle the issuance of the emergency permits, as long as there was no soil disturbing activity involved. Mr. Wheeler asked Mr. St. John to redraft the resolution to include the suggestions. Mr. Thacker said he would withdraw his motion until Mr. St. John presented the amendment. After considerable discussion as to whether or not to include single-family homes in the emergency amendment, and exactly what constituted emergency earth moving, Mr. Frederick Payne suggested the following revision in the proviso of the amendment to the Interim Moratorium Ordinance: "provided, however, that, nothing in this Ordinance shall be construed to prohibit the issuance of building permits for the construction of any single-family residence, for any work not involving any land disturbing activity as defined by the Albemarle County Soil Erosion and Sedimentation Control Ordinance, nor for the repair and/or reconstruction of any structure which repair and/or reconstruction is necessitated by,forces beyond the control of the owner of such structure, which repair and/or reconstruction shall~be necessary to preVent a clearly demonstrable hardship approaching confiscation or a situation dangerous to the public health, safety and welfare, and which repair and/or reconstruction will, in the opinion of the Albemarle County Building Official, have no significant impact on the quality of water in the South Rivanna River Reservoir;"
