1975-08-27A8-21-75 8-2Z-75 (afternoon) Mr. Wheeler noted that he had received a letter from Rountrey and Associates offering the County assistance in the assessment of non-taxable proparty as now required by State legislation passed in 1975. (Section 58-14.1) Mr. Wheeler asked that the Clerk notify Rountrey that this work will be completed with County forces. Mr. Wheeler read the following letter into the record~ "August 14, 1975 Mr. Gordon L. Wheeler Chairman Albemarle Board of Supervisors County Office Building Charlottesville, Virginia Dear Mr. Wheeler: In the midst of the one-sided, adverse criticism of Mr. Batchelor it was refreshing to read the balanced and objective appraisal of Mr. Batche!or's contribution to the read the balanced and objective appraisal of Mr. Batchelor's contribution to the progress and Welfare of Albemarle County by Ray Cary in the Daily Progress of August 11. It is an impressive record and one that I believe few administrative officers have equalled or surpassed. Mr. Cary's appraisal was particularly refreshing to me because I was Dean of the School of Public Administration at Florida State University when Tom Batche~or and Otis Brown received their degrees. I rate them on the same level as one of my earlier students, Governor Reuben Askew of Florida. I think it will be hard for the Board to find a replacement as good as Mr. Batchelor. Many highly qualified people will not be interested in serving a Board which forces or accepts the resignation of a man with Mr. Batchelor's record of achievement; and many people simply will not recommend their best people to the Board. ! think this is one of the more serious aspects of the Board's action from the standpoint of the future progress and welfare of Albemarle County. I should also like to remind the Board that a chief administrator who is not involved in controversy from time to time is usually the one who is not providing strong and farsighted leadership. Some controversy is an inevitable part of the governmental process when there are many conflicting interests and desires among the people being served. Sincerely yours, (Signed) Wilson K. Chairman 8-27-75 (afternoon) An adjourned meeting of the Board of Supervisors of Albemarle County, Virginia, was held on August 27, 1975 at 4:00 P.M. in the Albemarle County Office Building Board Room; this meeting being adjourned from August 18, 1975. PRESENT: Messrs. Stuart F. Carwile, Gerald E. Fisher, J.T. Henley, Jr., William C. Thacker, Jr. Gordon L. Wheeler, and Lloyd F. Wood, Jr. OFFICERS PRESENT: Messrs. T. M. Batchelor, County Executive; Robert Sampson, Assistant to the County Executive; and George R. St. John, County Attorney. Meeting was called to order at 4:10 P.M. Mr. Wheeler requested a resolution of appreciation for services performed by Mr. Brian Donato, in rendering a decision as to possible conflict of interest by Mr. Lloyd Wood and Mr. Stuart Carwile in relation to the South Rivanna River Reservoir Moratorium. Motion was offered by Mr. Thacker to adopt a resolution of appreciation. Mr. St. John, said he felt such a resolution was not in order, and offered the example of not thanking a Judge or the Attorney General for a similar decision. Mr. Thacker withdrew his motion, and subject was dropped from discussion. Mr. Wheeler said that on Thursday, August 28, 1975, 'the Emergency Medical Service Council of the Thomas Jefferson Planning District Commission will be holding a meeting at 8:00 P.M. to discuss a regional communication system. Mr. Carwile said he would be able to attend in Mr. Wheeler's absence. At 4:20 P.M. Mr. Wheeler requested the Board go into Executive Session to discuss a personnel matter, a legal matter, and land acquisition. He stated to the press that any statements from the executive session would be made at the 7:30 P.M. meeting. Motion to this effect was offered by Mr. Wood, seconded by Mr. Fisher, and carried by the following recorded vote: AYES: NAYS: Messrs. Carwile, Fisher, Henley, Thacker, Wheeler and Wood. None 8-27-75 (afternoon) 8-27-75 (night) Mr. Wheeler reconvened the_meeting from executive session into open session at 7:25 P.M., and then declared the meeting adjourned· -J~/~Jf~ Chairman 8-27-75 (Night) A regular meeting of the Board of Supervisors of Albemarle County, Virginia, was held on August 27, 1975 at 7:30 P.M., in the Albemarle County Courthouse, Charlottesville, Virginia. PRESENT: Messrs. Stuart F. Carwile, Gerald E. Fisher, J.T. Henley, Jr., William C. Thacker, Jr., Gordon L. Wheeler (arrived at 8:25 P.M.), and Lloyd F. Wood, Jr. OFFICERS PRESENT: T.M. Batchelor, Jr., County Executive; Robert Sampson, Assistant to the County Executive; George R. St. John, County Attorney; Frederick Payne, Deputy County Attorney; and John Humphrey, County Planner. Meeting was called to order by Mr. William Thacker, Vice Chairman, who stated Mr. Wheeler would be arriving later in the meeting. The Board then conducted public hearings on zoning matters adver- tised on dates set out in descriptions. No. 1. SP-508, John H. Flick, (deferred from August 15, 1975) request to locate a mobile home on 2+ acres zoned A-1. Property on south side of Route 643. County Tax Map 46, Parcels 102 and 106, part thereof. Charlottesville and Rivanna Magisterial Districts. (Advertised in the Daily Progress on July 8 and 15, 1975). Mr. John Humphrey, County Planner proceeded to read from the staff report: "Property is located on the south side of Route 643, adjacent to the C & 0 Railway and near the old polo field. Area is rural in character with several single-family dwellings, although most are not visible from Route 643. The area is wooded in deciduous trees and is located near Powell Creek. The Powell Creek Interceptor Sewer line is being installed at this time. This mobile home application comes before the Board because of an objection from a.n adjacent property owner. According to the South Fork Rivanna River Flood Plain Information, this property appears to be located on the fringe of the Standard Project Flood level which is at an elevation of 360 feet above mean sea level. This has been checked out by the County Engineers office, and in a letter they stated the site is nine feet above flood stage level as recorded by the Corp of Army Engineers. The Health Department has also viewed the site, and in a letter dated August 12, 1975 from Mr,. Homer Cheavacci addressed to Mr. Robert Tucker, he states "It is highly recommended that Mr. Flick be allowed to hook up his trailer to the public sewer line now being installed in close proximity to where this proposed trailer will sit. If this is not possible, a septic system can be installed in an area behind the trail.er. Such a system would require the in- stal'lation of a dual pump system, a warning device inside the trailer, plus 800 square feet of drainfield line." The Planning Commission and staff recommend approval with the following eight conditions: 3. 4. 5. 7. 8. Approval from appropriate state and local agencies; Setback from Route 643 of 100 feet; Side yard setback of 25 feet and rear yard setback of 35 feet; Skirting around mobile home from base of mobile home to ground level; Mobile home shall not be rented under any circumstances; Screening, if any, to be determined by the Zoning staff; Time limit of five years. Permit issued to applicant and is non-transferable. Mr. Carwile asked if the objection received against this mobile home was in the form of a letter and if so if Mr. Humphrey should read same. "Geoffrey Tait Satyrfield Charlottesville, Va. July 15, 1975 In response to your inquiry concerning Special Permit #508 locating a mobile home on Parcels 102 and 106, part as described in County Tax Map 46, in the Charlottesville Rivanna Magasterial District, I take this opportunity to state my opposition to the placement of the same in that location. I will appear in person at the Planning Commission hearing on August 5, 1975 at 7:30 P.M. in the Board Room of the County Office Building to speak on this matter, as per the form letter you sent dated July 8, 1975." Mr. Humphrey said that Mr. Tait's objection was only that the mobile home would be in the flood Mr. Flick was present in support of his request. No one else from the public was present to speak either for or against the request, and Mr. Thacker declared the public hearing closed· Mr, Wood then made motion to approve the application wi-th the conditions placed upon it by the Planning Commission. Motion was seconded by Mr. Carwile, and carried by the following recorded vote: AYES: Messrs. Carwile, Fisher, Henley, Thacker and Wood. NAYS: None· ABSENT: Mr. Wheeler. .~
