1975-02-052-5-75 21 An adjourned meeting of the Board of Supervisors of Albemarle County, Virginia, was held on February 5, 1975~ at twelve noon in the Board Room of the County Office Building, Charlottesville, Virginia, said meeting being adjourned from January 29, 1975. Present: Messrs. Stuart F. Carwile, Gerald E. Fisher, J. T. Henley, Jr., William C. Thacker, Jr., and Gordon L. Wheeler. Absent: Mr. Lloyd F. Wood, Jr. Officers Present: County Executive, T. M. Batchelor, Jr., and County Attorney, George R. St. John. Mr. Wheeler called the meeting.s, to order and immediately asked for an executive session to discuss legal matters. Motion to this effect was offered by Mr. Thacker, seconded by Mr. Carwile and carried by the following recorded vote: AYES: Messrs. Carwile, Fisher, Henley, Thacker, and Wheeler. NAYS: None. ABSENT: Mr. Wood. The Board reconvened at 12:15 P.M. Mr. Batchelor said that several weeks ago the staff had asked Board approval for several positions under the PEP program. These positions have not been filled because there is no one applying for the jobs. Mr. Wheeler said he could not believe that with the hundreds of people the Virginia Employment Commission says they have on their rolls, that there is not someone available to hire for these positions. Mr. Wheeler said there must be some sort of a lack of a coordination and he asked that Michael Carroll talk to Thomas McGe~e. at ~the UEC..~aboUt this situation. Mr. Wheeler noted for the record that the Chesapeake and Potomac Telephone of Virginia Company/has applied for a rate increase with the State Corporation Commission. The proposed tariff rider if allowed to become effective would result in a 13.9% surcharge on rates for local telephone service excluding intrastate toll, coin telephone and certain new services. Prior to March 1, 1975, the State CorPoration Commission will issue an order giving its decision whether or not to suspend the proposed surcharge tariff and establishing any further procedures for investigation and hearing on the company's need for rate relief. ~-- Mr. Wheeler noted that the Board must make a decision on the James Fleming I ~zoning petition next week. He asked that the Clerk notify J~ Harvey Bailey, County Engineer, George Williams, at the Rivanna Water and Sewer Authority, a member of the Highway Department staff, a member of soil conservation staff, the County Planner, and the County Attorney to be present for that hearing. .7 Mr. Wheeler said that an article appeared in the Sunday issue of the Daily Progress concerning taxes for a~.citizen who lives in the Scottsville Di~.trict. This citizen had stated that his 1953 taxes were about $330.00 and in 1974 they were about $700.00. Mr. Wheeler said he had talked to Ben Critzer of the Progress staff who wrote the story. He suggested that Mr. Critzer check his facts and figures since he felt there had been an error. The true facts were, in 1973, this citizen!s personal were property taxes/S176.19, the 1973 real estate taxes were $153.84, the' 1974 personal and the 1974 real estate taxes were $182.60, making a total ~ property taxes were $170.94, due to the county at this time of $683.07. It was also found through the checking ~ that this citizen has not purchased automobil'e tags for his vehicles and the Sheriff has been notified of this. Mr. wheeler sa-id he was disappointed that the true facts were not published in the paper in the first article. ~' l Mr. Fisher noted that three people had called him to say that the real estate department personnel had said to call him about their recent appraisal. Mr. Batchelor said he had checked this and found %hat the real estate department was only telling the citizens if they became involved in discussion of tax rates or what their taxes might be on the new appraisal that the tax rate is set by the Board of Supervisors and that the real estate department does no~ determine the amount of each persons taxes. Mr. Thacker said he had discussed this with Fletcher Simms and this same thing was indicated to him. Mr. Thacker said his biggest problem in discussing appraisals with the citizens is that most people do not understand that the Board of Supervisors has no control over appraisals. Mr. Batchelor said that in talking to the real estate appraisers they have indicated that the overall acceptance of the citizens of the appraisal is better than expected and the number of complaints are much fewer than expected. with Mr. Wheeler said he had recently met/the Chairman of the Planning Commission. Mr. Carr had indicated that the Planning Commission hopes to finalize a draft of Hhe Zoning Ordinance within the next thirty days and get it to the Board of Supervisors by April 1, 1975. Mr. Wheeler said that the Board of Realtors which has approximately three hundred members have officially gone on record as opposing this Zoning Ordinance and have asked that a referendum be held on same. He had told them that i% would~be better to make their suggestions for changes'Lto the Planning Commission rather than oppose the total Zoning Ordinance. However, they did send a delegation to the news media and he feels this is a pressure group trying to pressure the news media into for taking an editorial stand on calling/a referendum on the Zoning Ordinance. At this time, Mr. Ray B. Jones. Assistant Director ~f Finance appeared ~before the Board to report that. the best bid received by the Virginia Public School Authority for the purchase of sixteen million, five hundred and fifty thousand of its bonds called ~ for a net interest cost of 5.4379% and that the Authority has offered to purchase ~ at a price of par and accrued interest the one million one hundred thousand School Bonds Series of 1975, of Albemarle County at an interest rate of 5.53% per year payable on each June 15 and December 15. Motion was then offered by Mr. Carwile, seconded by Mr. Thacker to adopt the 1 following resolution: BE IT RESOLVED by the Board of Supervisors of Albemarle County, Virginia, that the one million, one hundred thousand school bonds series of 1975 of Albemarle County heretofore authorized by resolution 523 2-5-75 adopted by this Board on January 22, 1975ir be and the same are.hersby sold to the Virginia Public School Authority at a price of par and accrued interest from the date of the 'bonds to the dJate of delivery ~and~'~shall bear interest at the rate of 5.53% per year. The foregoing motion was adopted by the following recorded vote: AYES: Messrs. Carwile, Fisher, Henley, Thacker, and Wheeler. NAYS: None. ABSENT: Mr. Wood. Mr. Jones noted that the sale of these bonds will take place on about March 10, 1975, and there will be an interest payment of about thirty thousand dollars due on June 15, 1975.
