1972-02-17 A regular meeting of the Board of .County Supervisors of Albemarle County, Virginia, was held ~at the County Office Building of said County on the 17th day of February, 19.72. '~arner advised that traffic signal has been_ ordered for installation at the intersection of Route 29 and Route 866 'with crosswalks for pedestrians also to be provided. He stated a fence is to be erected in the median to protect pedestrians from crossing Route 29 between the StrOmberg-Carlson plant and the Caravan Restaurant. As soon as authoriZation for the signal is obtained and the work can be scheduled, this 'signal will be installed and the fenceerec~d~ Nr. '~arner also advised, that pavement marking was reworked on Route 2~0 near ~est Leigh last fall. Both of these pro~ects were requeSted by the Board of Super- visors on October 21, 1971. Nr. John ~ard presented petition on behalf of residents liVing on a short section of Route 809, Deer Path in Bellair ~bdivision; stating that this road is gravel surfaced whereas ali other roads in the subdivision, including con- tinuation of Deer Path, are hard surfaced. The petition further stated that this section of road provides access to only four residences and a fifth vacant lot, and terminates in a cul-de-sac, precluding the probability of reaching the minimum vehicles per day to qualify for hard-surfacing. The residents requested that this Board take whatever action within their power to correct this situation, specifically to work with the HighWay Department in establishing a procedure whereby the fifty vehicle per day requirement might be waived as a prerequisite in cases of this nature. Nr. "Warner advised that his office is bound by policy at this time but the Hig~hway Research Council is s~udying policy with regard tO traffic count. ~arner was requested by the Board to draft the type of resolution needed for con- sideration by the Board at its next regular meeting. Nfs. Elizabeth Rosenblum appeared on behalf of Citizens for Albemarle, re- questing that the Board of Supervisors and City Council appoint immediately a joint committee to develop the most 'effective organization for joint management of our vital water resources. Ca son to. make his request in writing in order that the Board might make proper investigation and assured Nr. Cason thorough investigation of his claim would be made. Nfs. JudithH~ ~Campbell, Chairman of the Board of Directors of the Youth Employment Service, appeared and presented proposed budget of Y.E.S.for the coming fiscal year, indicatinE request~for $2,Q00 allo~cation ~rom Albemarle County. Nfs. CampDell briefly reviewed past. experience of Y.E.S. in placing youth in summer jobs and. plans for the coming year~ Nfs. At 10:30 A.~. the Chairman called for public hearing on intent to amend Sec- tion 2-~ of the Albemarle County Code so as to increase membership of the Albemarle County Planning Commission from eleven to twelve members, as advertised in the Daily Progress on February 3 and 10, 1972. Nr. Humphrey read the amended ordinance as proposed. No one from the public spoke on this matter. Motion was offered by Mr. Carwile, seconded by Mr. Thacker, to adopt: .the amended ordinance as read. The County Attorney advised that the Code of Virginia provides that only one member of the Board of Supervisors may be appointed to the Planning Commission. After con- sideration of advice fro~ the attorney, motion was offered by Nr. Carwile requesting 3O County Attorney to get an opinion from the Attorney General on this matter, rescind the previous motion, and appoint Nr. Gerald E. Fisher..as advisory consultant to the P~anning Commission. Motion was seconded by Nr. Henley and adopted by the Follow- ing recorded vote: AYES: Messrs. Mike Gleason, Executive Director of the Bicentennial Commission for the City and County, appeared and gave a detailed report on activities of the Commission thus Far on plans and preparations for the coming Bicentennial c~lebration. Nr. Sam Robertson, Dog Warden, appeared at the request of the Board and dis- cussed existing problems in the County with regard to dogs, particularly German Shepherds. Mr. John English appeared concerning this matter and suggested that the Board consider amendments to present CoUnty ordinances. After discussion, the Chair- man appointed Nessrs. Henley, Wood, Robertson and Pickford as a committee to Z~udy this situation and report back to the Board as soon as possible. *Appointment of committee was approved on motion by Mr. Thacker, seconded by Nm. Fisher. WHEP~AS, both the County of Albemarle and the City of Charlottes- ville b~ve many pressing problems in ~ommon, the solution of which might reduce some of their current financial pressures through con~mon action toward their common~ goals, as opposed to the duplicative and divisive efforts, which.inevitabl~ _.~follow from any failure of these governmental ~units. to work together~; and '~/{EREAS, the best~ ir~terests of the Charlottesville-Albemarle community would surely be promoted by common act~ion through the medium of the B~gion 10 Planning District, ~which is the tool established by the General Assembly of Virginia to foster and implement such join~ efforts toward these .common goals; and. ~WHEREAS, the Begion 10 Planning District has not yet become opera- ~tive because of the refUsal, upon the advice of its annexation counsel, of the City of Charlottesville to participate in this joint undertaking, NOW, THEEEFOBE, ~he BOard of Supervisors of Albemarle County by adoption of this resolution does once again invite, request, and urge the City of Charlottesville to join in the creation and_ operation of the Region 10 Planning District at this time, to the end that ~eir joint interests and efforts may be coordinated and directed more effec- tively through this channel toward the early and economical accomplish- ment of their joint goals. Wood. ~EEREAS, the City of Charlottesville, Virginia, has filed an annexation suit against the County of Albemarle, Virginia; and ;~qEAS, in said annexation suit the City of Charlottesville is seeking to annex approximately 12.1 square miles of Albemarle County; and ~HEKEAS, the area sought to be annexed by the-City of Char- lottesville contains approximately one-fifth of the total popula- tion of Albemarle County; and ~iESE~ AS, said area sought to be annexed contains two of the County' s major industries; and ~AS, it is estimated that preparing for trial and the trial of said annexation suit will cost the City of Charlotte~;ille and the County of Albemarle in excess of Five Hundred Thousand Dollars and could foreseeabl~ cost as much as One Nillion Dollars; and ~qEAS, both the City of Charlottesville and the County of Albemarle have many pressing financial needs to which the money required to prosecute and defend the annexation suit could be spent to the better a~[vantage~l of the total community; and~ '~HEREAS, the best interests of the Charlottesville~Albemarle community woul~ be Dromoted~bY the..fOrmation of the ttegion 10 Plan- ning District to deal with many of the problems common to both governments; and WHEREAS, on the ad, ice of its special .annexation counsel, the City of Charlottesville has refused to join the Eegional Planning District; and ~qE_AS, the General Assembly of the Commonwealth of Virginia has created a Commission on City-County Belations~ips to study the existing relationships between counties and independent cities, and to recommend to the General Assembly what changes should be made in the existing relationships between counties and independent cities; and ~AS, the House of Delegates of the General Assembly presently has under consideration House Bill No. 328, which would stay annexa- tion suits by cities with population in excess of forty-five thousand (~,000), which bill has been ~eferred to the Committee on Counties, Cities and Towns; and ~HEREAS, the Board of Supervisors of Albemarle County, Virginia, believes it to be in the best interests of Albemarle County and the entire Commonwealth that House Bill No. 328 be amended to make it general legislation applicable to all annexations throughout the Commonwealth and that House Bill No. 328 be further amended to include a provision "staying" i~orther proceedings in any annexation suit which has been filed since the convening of this session of the General Assemb%y; NOV, THEREFOP~, BE IT ttESOLVED that the Board of Supervisors of Albem~le County, Virginia, hereby respectfully requests the General Assembly of the Commonwealth of Virginia to enact into law House Bill No. 328 as general legislation in order to make the provisions of said bill apply to all annexation so_its instituted since the convening of this session of the General ASsembly, and that said bill be amended to contain a provision "staying" all such annexation suite until the Commission on City-County Belationships has reported to the General Assembly and the General Assembly has had the opportunity to enact~ such legislation as it may deem advisable based upon the recommendations of said commission; and BE IT FURT~ RESOLVED, that a certified copy of this resolution be sent to all of the~re~presentatives of-Albemarle County, Virginia, in the General Assembly, to all .the ,members.of the House Committee on Counties, Cities and Towns, to~ all the members of the corresDonding ~enate Committee, and to the Governor of the Commonwealth of Virginia. The Chairman asked the County Attorney to make report on legal notices with regard to Service Authority project hearings. Nro Pickford advised that previous notices listed capital projects, including estimated costs, in jurisdictional areas which had previously been designated. He advised that such a notice need only include new jurisdictional areas to be designated. It was pointed out that of~ the~projects proposed, the Ivy area is the only one which has not been desig- nated. However, since the usual meeting place of the Board has been changed for the public hearing scheduled on February 16 for February 29, two notices of the changed location must be given. After general discussion, motion was offered by Nr. Fisher, seconded by Nr. Carwile, to propose an Ivy area to include Flordon and Glenaire, but to exclude everything south of l~oUte 250. A RESOLUTION SIGNIFYING THE INTENTION OF THE BOARD OF SUPERVISORS~'OF ALBENAB~F~ C0~, VIRGIllIA, TO CONSIDER SPECIFICATION OF ~UDITIONAL PROJECTS TO BE UNDER- TAKEN BY THE ~~JE COUNTY SERVICE AUTHORITY INCLUDING THE ACQUIRING, FINANCING, CONSIRUCTING, OPERATING AND MAINTAINING ONE OR MORE WATER SYSTEMS AND ONE OR MORE ~'~P~AGE SYSTEMS, OR ANY COMBINATION THEREOF, A~ ~R THE P~POSE OF EXERCISING TEE P0~ERS CONFEERED BY TEE SAID ACT AND AMENDATORY THEREOF. John Humphrey introduced Nr. Chris Lang, Intern in the Planning Office. Nr. Lang reviewed study he has been making on ~a street numbering system for the County, particularly with regard to subdivision areas. · ith regard to pending request from the .Community College, the County Executive suggested that the request be referred to a committee to study and review with Dr. Harold McGee, Pre,dent of the College. WHEELS, the City of Charlottesville has fimled another annexa- tion suit ~against~ AlBemarle ~Cuunty seeking to~ annex a substantial number of citizens and.t.erritory of the County; and ~HEREAS, in the opinion of the Bo~d of Eup~rvisors of.Albemarle County the proposed annexation isnot in the best interest of the County, the area sought, .nor the city; NOW, THEREFORE, beLit resolved: That the County of Albemarle opposes the said annexation suit to the utmost and to such end, The County of Albemarle hereby employs the law firm of Fitzgerald, Emith & Davis of Fairfax, Virginia, as special counsel to act as chief counsel for the County in the annexation suit and consultants in related matters. Further, the County of Albemarle hereby employs the accounting firm of Daniel A. Robinson and Associates of Charlottesville, Virginia, as financial consultants for said annexation suit and matters related thereto. The following resolution was offered by Nr. None. ~REAS, the Board of Supervisors of Albemarle County has determined to oppose the annexation suit filed by the City of Charlottesville; and WNE~EAS, pursuant to such end the Board has employed special counsel and consultants to represent, defend, and advise the County in said annexation suit; and ~WNE~EAS, the Board of Supervisors desires to provide all possible assistance in the defense of the said annexation suit; NO~#, THEREFORE, BE IT RESOLVED that the attorney for the Common- wealth, Mr. Charles R. Haugh, and the County Attorney, Mr. Herbert A. Pickford, be and they are requested to associate with special counsel, Robert C. Fitzgerald and ~yron C. Smith of Fitzgerald, Smith and Davis and to provide all possible assistance in the defense of the annexation suit. ~S: NAYS: An offer of $2,000 was received from Randall L .... Smith and~ others for the pur- chase of Parcel 3, Section 119, Scottsville District, recorded as 79.15 acres. The letter noted that this tract contains only fifty plus acres and' has no public access. The Board was advised that this tract was included in auction sale held by the County some months ago and was one of two or three which did not sell. Also, Er. Hugh Bims of the real estate department had advised that he would recommend acceptance of this offer in order that it might be placed back on the tax rolls. On motion by Er. Carwile, seconded by lir. Fisher, it was ordered that the property still owned by the County be included in the next auction of County vehicles and that a minimum bid of $2,000 be put on the subject parcel of land. ~[otion carried by the following recorded vote: AYES: ~essrs.
