1972-02-234O A regular meeting of .the Board of County Supervisors of Albemarle County, Virginia, was held at the Al.bemarle County Court House on the 2~rd day of February, 1972, at 7:50 P.M. Present: Messrs. Stuart F. Carwile, Gerald E. Fisher, J. T. Henley, Jr., William C. Thacker, Jr. and Gordon L. Wheeler. Absent: Nr. Lloyd F. good, Jr. Officers present; County Executive and County Attorney. The Chairman announced ~. that he had called the news media to inform them that the public hearing scheduled for tonight would be re-scheduled for a later date due to the ice and s~ow that would preclude citizens from participating in the public hearings. RePrese~utative from Virginia Electric and Power Company was at the meeting. Nr. Carwile asked the representative if they had a certificate of convenience and necessity from the State Corporation Commission as was required by law. The VEPC0 representative stated that he did not know if they had acquired a certifi- cate. Mr.' carwile suggested that he would not recommend granting VEPC0 perm~ t until such time as they had gotten their certificate. On motion by Nr. Carwile, seconded by Mr. Fisher, it was moved to defer the VEPCO decision until March 16 or until such time as VEPC0 has obtained certificate of convenience f~.~om the State Corporation Commission. Motion carried by the following recorded vote: AYES: Messrs. Carwile, Fisher, Henley, Thacker and ~heeler. NAYS: None. ABSENT: Nr. Wood. On motion by Nr. Thacker, seconded by Nr. Fisher, Nr. Edgar Paige was named to the Tax Relief Committee. Notion carried by the following recorded vote: ~S: Messrs. Carwile, Fisher, Henley, Thacker and Wheeler. NAYS: None. ABSENT: Mr. Wood. The following resolution was offered by Mr. Fisher, seconded by Nr. Henley, and adopted by the follo'~lng recorded vote: AYES: Messrs. Carwile, Fisher, Henley, Thacker and Wheeler. NAYS: None. ABSENT: Mr. 'Wood. '~r~tEAS, it has come to the attention of the Board of Supervisors of Albemarle County, Virginia, that Senate Bill No. 467 as introduced into the General ASsembly of Virginia calls for the repeal of Virginia Code Section ~6-426; and 'WHEREAS, experience within recent years in Albemarle County has shown that railroad rights of way continue to be fire hazards and the railroads' responsibility for maintainin¢ them as required by Code 4i Section 56-426 i.s deemed ess.ential to the .protection. of the life and property of the citizens of Albemarle County., Virginia, NOW, TN~KE~, BE IT iLESOLFED .that. the Board of. Supervisors of Albemarle County request.,, and. it hereby does request of the General Assembly that Senate Bill No. 467 be defeated. The iGlerk of the Boar&of Supervisors of Albemarle County is directed to mail copies'.of this resolution to the Honorable J. Harry Michael, Jr., the Honorable Thomas J. Nichie, Jr. and the Honorable Daniel G. Van Clief. On motion by Mr. Fisher, seconded by ~ I Henley, the Board went into an executive session for discussion of matters pertaining to annexation and land acquisition. In open meeting, this meeting was adjourned until 4:00 P.M. on March 1, 1972, s~ud public hearings on zoning requests advertised for this date were re- scheduled for 7:50 P.M. on March 8, 1972, motion being made by Mr. Fish, r, seconded by Mr. Henley. Motion carried by the following recorded vote: AYES: Messrs. Carwile, Fisher, Henley, Thacker and Wheeler. NAYS: None. ABSENT: Mr. Mood. Chairman
