1957-09-27 September 25, 1957 The adjourned meeting of September 18,. 1957, was held at 7:30 P.M. on this date with the following present: Messrs. John W. Williams, Edgar N. Garnett, H. Ashby Harris, Edward L. Smith? and Robert Thraves. Absent: Mr. M. Y. Sutherland, Jr. Officers present: Commonwealth's Attorney and Asst. County Executive. Mr. J. J. Edwards appeared with several other citizens with further regard to telephone ser- vice in the Burnley area. Letter was read~r~n Mr. Garnett of the Telephone Company stating that the area surveyed by this company for prospective telephone subscribers did not include the entire area in which Mr. Edwards had circulated his petition, and requested time in which to further study the matter. Mr. Edwards stated that the felt the Virginia Telephone and Telegraph Company was stalling for time and requested the Board of Supervisors to appoint a committee to appear with a delegation from the Mutual Company before' the State Corporation Commission. After considerable discussion regarding this matter, / Mr. Edwards was advised to have the attorney for the Mutal Company to appear before the Telephone Compan~~ advising of its intent to go before the Corporation Commission if the matter coUld not be strai§~tened out between the two companies. It was the expressed feeling of the Board that a committee would be ap- pointed as requested if satisfactory arrangements could not be worked out after the Mutual Company's and attorney appeared before the Telephone Company. On motion of Mr. Thraves, seconded by Mr. Garnett, unanimously carried, it was moved that this Board wmll- recommend to the State Corporation Commission tha~ the Virginia Telephone and Telegraph Company furnish telephone service to the area from the Airport to Burnley in the event the Mutual Telephone Company find it~necessary to appear before the Commission. Mr. James H. Michael, Jr., Attorney for the Greenbrier Corporation, appeared with further regard to request of that corporation that this Board take the necessary action by advising ~ that the roads in Greenbrier Subdivision be taken into the State system within a year. Mr..¥~chael gave assurance to the Board that twenty-four houses would be completed within twelve month~,~and stated that sufficient bond would be posted with the County to assure completion of the roads to the proper standards. After considerable discussion of the matter, and on recommendation of the Commonwealth's Attorney, the follow- ing resolution was offered by Mr. Smith, seconded by Mr. Thraves, and unanimously adopted: · BE IT RESOLVED by the Board of County Supervisors of Albemarle CouSty, Virginia, 'that this Board will recommend to the State Highway Department, that roads in Greenbrier Subdivision beginning at the intersection of E~sex Road and Brandywine Drive in Section 4 of Rutledge Subdivision and ending at Rio Road will be recommended for acceptance into the Secondary System provided said roads are constrUcted to standards of the State Highway Department within one year, and also, that an acceptable bond be posted to assure completion of said roads. At the request of Mr. Edgar L. Bradley of the Soil Conservation Service, the following reso- lution was offered by Mr. Gar~ett, seconded by ~r. Harris, and unanimously carried: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the week of October 13-19 be and is hereby declared Conservation Week in Albemarle County. ~t ~he~reque~t o~'~t~e Right mOf~Way Department of the Department of Highways, the following resolution was .offered by Mr. Smith, seconded by Mr. Garnett, and unanimously adopted: WHEREAS, the Commonwealth of Virginia, thr~ough the..~Depar~men~ of Highways, ~ has prepared and submitted plans to the Board for the construation~r~.~improvement of a section of Route 679 of the State Secondary System, Project 1302-26, in Albemarle County, from 0.265 Mi. S. Int. Rt. 738 to Int. Rt. 738 (C. & O. Railroad ~rossing), approved March 21, 1957; and WHEREAS, it is the desire of this Board that said road be improved in ac- cordance with said plans. NOW, THEREFORE, BE IT RESOLVED: That this Board approves the ~.ans and requests the Department of Highways to proceed with construction in accordance there- with, and this Board hereby agrees to assist and cooperate in the acquisition of the right of way shown on plans as being required, it being understood~ that costs for each right of way are to be paid from Secondary funds allocated or to be allocated to Albemarle County. It is further understood and agreed .that in the event one or more property owners refuse to execute a deed covering land required from their properties for right of way purposes that the Commonwealth of Virginia, Department of Highways, will institute and conclude condemnation proceedings and that all costs are to be paid from Secondary funds allocated or to be allocated to Albemarle County. On motion, the meeting adjourned. Chairman A regular meeting of the Board of County Supervisors of Albemarle Gounty, Virginia, was held at the Office Building of said.County on the 16th day of October, 1957. Present: Messrs. John W. Williams, Edgar N. Garnett, H. Ashby Harris-, Edward L. Smith, M. Y. Sutherland, Jr. and ~Robert Thraves. Absent: None. Officers present: County Executive. The meeting opened with the Lord's Prayer ledby Ne. M. M~ Pence. Minutes of the meetings of September 18 and September 25, 1957, were read and approved. Communication was received from the Department of Highways advising that as requested by this Board in resolution of September 18, 1957, River Road, beginning at Route 7&8 and extending in a nor- therly direction for 585 feet, was accepted into the State Secondary System, effective October 4, 1957. The Board was advised that Brandywin~ Drive in Rutledge Subdivision had now been brought up to State standards and was ready for acceptance into the Secondary System. On motion of Mr. Harris, seconded by Mr. Thraves, the following resolution was unanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the Virginia Department of Highways be and is hereby~irequested to take into the Secondary System Brandywine Drive in Rutledge Subdivision from the intersection Of Route 743 to the intersection with King Mountain Road, said Brandywine Drive having been brought up to standards of the State Highway De- partment. BE IT FURTHER RESOLVED that the Virginia Department of Highways be and is hereby guaranteed a 50 foot unobstructed rightof way along this requested addition. The revised policy prefacing recoKmnendation for the acceptance of sub-division roads into the State Secondary System was again brought before the Board and on motion of ¥~. Sutherland, seconded by Mr. Harris, was unanimously adopted as follows: POLICY PREFACING RECOMMENDATION FOR THE ACCEPTANCE OF SUB-DIVISION ROADS INTO THE STATE SECONDARY SYSTEM All sub-dividers upon approval of their plat and plans by the ~lbemarle County Planning Commission and the Planning Commission of the City of Charlottes- ville shall be required to present such plat and plans to the County Board of Supervisors of Albemarle County for its signature before the same can be recorded. No recommendation for the acceptance of the dedication of any road or street for maintenance into the secondary system wiS1 be approved untilthe rol- l. lowing condit%ons and provisions have been fulfilled. (1) all streets in new subdivisions must be constructed to conform in general to standards for streets as established by the State Highway Commissioner, namely: (a) Right-of-Way width shall not be less than 50 feet. (b) Roadway shall be graded to a minimumwidth of 28 feet exclusive of side ditches to standards approved by the Resident Engineer of the State Highway Department..
