1958-01-15 A regular meeting of the Board of County Supervisors of Albemarle County, Virginia, was held at the Office Building of said County on the lSth day of January, 1958. Mr. Garnett nominated Mr. John W. Williams as Chairman, which nomination w~s seconded by Sutherland, There being no further nominations, Mr. Williams was unanimously elected. Mr. Suther!and nominated Mr. Edward L. Smith for Vice-Chairman, which nomination was seconded by Mr. Harris. There being no further nominations, Mr. Smith was unanimously elected. Mr. Harris nominated Mrs. Jun~ To Moon as Clerk, which nomination was seconded by Mr. Suther- ~nd. There b.6ing no further nominations, Mrs. Moon Eas unanimously elected. P~esent: Messrs. John W. Williams, Edgar N. Garnett, H. Ashby Harris, Edward L. Smith, M. Y. Sutherland, Jr. and Robert Thraves. Absent: None. Officers present: Commonwealth's Attorney. The meeting opened with the Lord "s Prayer led by Mr. M. Y. Sutherland, Jr. Minutes of the meeting of December 18, 1957, were read and approved. Request was received from the Cushman Realty and Building Corporation for the inclusion of Woodstock Drive and Guilford Lane in the Secondary System. Mr. H. W. Runkle, Resident Highway Engineer, advised that said streets had been completed in accordance with State specifications and recommended the acceptance of same. On motion of Mr. Harris, seconded by Mr. Smith, the following resolution was unanimously adopted: WHEREAS ~uilford Lane and Woodstock Drive in Hessian Hills Subdivision have been completed in accordance with plans and specifications of the Virginia Department of Highways and have received approval by that Department, NOW, THEP. ~EFORE, BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the State Department of Highways be and is hereby requested to acceptc&nto the Secondary Highway System Guilford Lane from Bennington Road to the intersection of Woodstock Drive, a distance of .09 mile, and Woodstock Drive from Gennington Road to the intersection of Guildord Lane, a distance of .2 mile. AND BE IT FURTHER RESOLVED that the Virginia Department of Highways be and is hereby guaranteed a 50 foot unobstz~cted right of way along this requested addition. The matter of relocating a section Of Route 679 to the Nest Virginia Pulp and Paper Company was a~ain brought before the Board. After discussion of this matter, the following resolution was offered by Mr. ThraEes, seconded by Mr. Sutherland, and unanimously adopted: WHEREAS, a section of road in the secondary system on Route 679, located west of Ivy, Albemarle County, Virginia, has been altered and a new road, which serves the same citizens as the old road, has been constructed in lieu thereof and approved by the State Highway Commissioner by letter dated December 18, 1957, to the Board of County Supervisors of Albemarle County; and WHEREAS, Section 33-76.12 of the code of ViEginia provides for the aban- donment of such alterations on the secondary road system, NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Albemarle County that said zld road be and the same is hereby vacated and aban- doned as follows: That section of Route 679 beginning at 0.03 mile South of the intersection of Route 738 and ending at 0.08 mile South of the intersection of Route 738, a distance of 0.05 of a mile. AND BE IT FURTHER RESOLVED by the Board of County Supervisors of Albe- That section of Route 679 beginning at 0.03 mile south of the intersection of Route 738 and ending at 0.08 mile South of the intersection of Route ?38, a dis- tance of 0.05 of a mile. The above is in accordance with the drawing dated 12-18-57 of Changes in Secondary System Due to Relocation and Construction on Route 679, handed .this Board, as of thi~ date, by H. W. Runkle, Resident Engineer, of the Virginia Department of Highways, and the Clerk of the Circuit Court of Albemarle County is requested to record a copy of this' resolution and the drawing hereinabove referred to. Petition was received requesting inclusion in the Secondary System Road beginning at Route 715 about 2 miles from Route 6 and about .8 of a mile from 723 in the Scottsville District. On motion of Mr. Harris, seconded hy Mr. Garnett, it was ordered that this petiton be referred to Viewers at the regUlar 1958 Viewers meeting. Request was received for inclusion in the Secondary System of HollyRoad and Galloway Drive in Holly Field Subdivision. Mr. H. W. Runkle, Resident Engineer, advised that said road had been com- pleted in accordance with plans and specifications of his Department and recommended acceptance of same. On motion of Mr. Harris, seconded by Mr. Smith, the following resolution was unanimously adopted NHEREAS¥~Holly Road and Galloway Drive in Holly Field Subdivision have been completed in accordance with plans and specifications of the Virginia De- partment of Highways and have received approval b~ that Department, NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the State Department of Highways be and is hereby requested to accept into the Secondary Highway System Holly Road, ~d~tance of .07 of a mile, and Galloway Drive, a _distance of .09 of a mile. AND BE IT FURTHER RESOLVED that the Virginia Department of Highways be and is hereby guaranteed a 50 foot unobstructed right of way along this re- qmested addition. The Clerk submitted statement of Expenses of the Department of Finance for the month of Decem. her, 1957, of which one-half is to be borne by the State. On motion, duly made and seconded, this Statement was examined, verified and approved. The Clerk submitted Statement of Expenses of the Sheriff's Office for the month of December, 1957, of which two-thirds is to be borne by the State. On motion, duly made and seconded, this State- ment was examined, verified and approved. The Clerk submitted Statement of Expenses of the office of the Commonwealth's Attorney for th~ month of December, 1957, of which one-half is to be borne by the State. On motion, duly made and seconded, this Statement was examined, verified and approved. Statement of Expenses incurred in the Maintenance of Jail for the mont$ of December, 1957, was presented along with Summary Statement of Prisoner Days. On motion, duly made and seconded, this State- ment was examined, verified andapproved, Reports of the Department of Public Welfare for the month of December, 1957, were presented in accordance with Sections 63-67.1 and 63-67.2 of the Code of Virginia. Report of the County Executive for the mont~ December, 1957, was presented, approved and ordered filed. Communication waz received from the Honorable E. C. Compton advising that he would be glad to handle any legislation that this Board desires pertainin~ to Albemarle County~ After considerable discussion of this matter, the following resolution was unanimously adopted and the Chairman asked that a committee from the Board deliver same to our representatives: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that this County's representatives in the State Legislature be and are (1) That the fees for service of civil papers by the office of sheriff should be increased to cover the actual cost of service and that this cost should be borne by the party litigants. (2) That Section 24-208 (Compensation and mileage to judges carrying re- turns etc. to cOunty clerk's office; and to commissioners) be amended as follows: The Judge carrying returns and tickets to and from his voting place and to the county clerk's office shall receive the mileage now allowed to jurors for each mile necessarily traveled and one d~ay_~ay for carrying the returns and records to the county clerk's office. The commissioners of election shall ,receive the mileaSe now allowed to jurors for each mile necessarily traveled. (3) That Section 22-152, which provides that no school building shall be built without the approval of the Division Superintendent of Schools and the plans and specifications of such building shall be approved by the Superintendent of Public Instruction, should be repealed and that the Superintendent of Public Instruction should be given advisory powers only ~and that the expenditure of local tax money for the building of schools should be given to the local school board~. Mr. Aubrey Huffman appeared and presented plans and profiles of Section one of The Meadows SubdiVision as approved by the City and County Planning Commissions. On motion of Mr. Thraves, seconded by Mr. Garnett, and unanimously csrried~ these plans were approved and the Chairman and Clerk were authorized to sign same on behalf of this Board. The Board's Attention was called to the fact that Mr. Homer G. Richey had paid $17.60 tax for the year 1957 on an automobile on which he had paid like tax to the city of Starkville, Mississippi. Receipts confirming this fact were presented~ On motion of Mr. Garnett, seconded By Mr. Smith, it was ordered that ~Ir. Richey be refunded the amount of tax paid in this instance to Albemarle County. On motion of Mr. Smith, seconded by Mr. Thraves, rules with regard to second readings were suspended, and the following resolution unanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle Co,mnty, Virginia, that $74,267.48 be and is hereby appropriated for operating expenses of the School Board for the month of February, 1958. The Board was advised that two adding machines, two typewriters and one folding machine had been purchased for the Department of Finance, this being part of the machinery approved by the State -COmpensation Board for the calendar year 1958. On motion, made by Mr. S~ther!and, seconded by Mr. Harris, rules with regard to second readings were suspended and the following resolution unanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that $2,000.44 be and is hereby appropriated to cover the cost of machines for the Department of Finance; including two typewriters, two adding machines and a folding machine. The matter of compensation of new clerks in the Department of Finance was discussed. It appeared that Mrs. Ida Moore was employed at a salary of $220.00 per month and Mrs. Evans a~ a salary of $200.00 per month w~ereas only $215.00 and $190.00 respectively was requested of the Compensation Board through error. On motion of Mr. Sutherland, seconded by Mr. Smith, and unanimously carried, the follow- ing resolution was unanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the employment of Mrs. Ida Moore at a salary of $220.00 per month and Mrs. Kate Evans at a salary of $200.00 per month be and the same is hereby approved, and BE IT FURTHER RESOLVED ~that the State Compensation Board be and is hereby requested to oarticioate in its orooortionat~ shar~ of Mr. James E. Bowen, City Manager, and Mr. John B. Rogan, Chairman of the Chamber of Commerce Aviation Committee, appeared with regard to report of said committee to the Charlottesville-Albemarle Airport Commission, copy ef which report was filed with the minutes of this meeting. Mr. Bowen advised CAA was interested in moving its weather station from Gordonsville to the Charlottesville-Albemarle Airport and in the event said move was made, CAA could use the present administration building and would participate in the construction of a new administration building which would meet the present re- quirements and take care of the anticipated increase in the future. He further advised that the estimate cost of said building was $150,000.00 which would mean the County and City would each participate to the extent of $37,500.00. After considerable discussion of this matter, the following resolution was offere~ by Mr. Thraves, seconded by Mr. Harris, and unanimously carried: BE IT RESOLVED by the Board of County Supervisors of Albemarle Co,muty, Virginia, that this body is willing to participate in the construction of a new administration building at the Charlottesville-Albemarle Airport provided CAA is willing to pay one-half of the cost and providing the total cost of said building does not exceed $150,000.00. A representative of the Peoples National Bank appeared before the Board and asked for per- mission to substitute City~ of Charlottesville Bonds in place of some of the U. S. Treasury Bonds now held in escrow to protect the County's deposits in said bank. On motion of Mr. Harris, seconded by Mr. Smith, this request was approved. Claim against the Dog Tax Fund was received from Mr. E. R. Sutherland for one lamb and nine ewes killed by dogs. On motion of Mr. Harris, seconded by Mr. Garnett, Mr. Sutherland was allowed $15.O0 for each of these sheep. Claim against the Dog Tax Fund was received from Mr. P. H. Gentry for twenty-eight chickens killed by dogs. On motion of Mr. Sutherland, seconded by Mr. Harris, Mr. Gentry was allowed ~1.75 for each of these chickens. Claim against the Dog Tax Fund was received from Mr. Robert Crile for seven turkeys killed by dogs. On motion of Mr. Harris, seconded by Mr. Garnett, this claim was denied due to lack of evidence. Claim against the Dog Tax Fund was received from Mr. Robert Crile for forty-three turkeys killed by dogs. On motion of Mr. Garnett, seconded by Mr. Harris, Mr. Crile was allowed $1~.00. for each of these turkeys. Request was received from the State Chamber of Commerce for an increase in the County's annual dues from $?5°00 to $150.00 per year. On motion of Mr. Garnett, seconded by Mr. Smith, it was ordered that the County's subscription be continued at $75.00 per year. Notice was received from the State Corporation Commission advising of application of Common- wealth Utilities, Incorporated for operation of water and sewerage facilities and advising that formal hea_~ing on said application would be held in Richmond at lO:O0 A.M. on February 3, 1958. Mr. Paul Cale, Mr. Leslie Walton and certain members of the School Board appeared at l:O0 P.M. and presented the following resolution which was a~dopted by the School Board on January 3, 1958: "BE IT RESOLVED, that (1) The school construction program begun in 1948 and suspended in 1954 be permanently terminated since the recommendations of the 1948 study were based on school needs at that time which have changed materially in the interim. (2) The report of the special committee appointed by the State Superin- tendent of Public Instruction dated October 1957 be accepted and filed to be used only as a guide in the future development of Albemarle County Schools. (3) The School Board hereby requests authority from the Board of Supervisors to proceed with the building of the additional class rooms and other facilities needed in Albemarle County at such rate as funds are available to meet these pressing~ needs. (4) In order to undertake the first step of this program, the School Board immediately requests the Board of Supervisors for authority to undertake simultaneously the construction of a new Negro elementary school near the site of the Burley High School and the necessary improvements and additions to the Scottsville 'High and elementary school, to immediately employ architects 153 After considerable discussion by both members of the Board of Supervisors and the School Board, the requests of the school board as outlined above were granted on motion of Mr. T~ra~es, seconded by ~ Harris and unanimously carried. We, the undersigned, members of the Board of County Supervisors of Albemarle County, Virginia, hereby waive notice and special service thereof, of a meeting to be held at 7:30 P.M. on the fourteenth day of February, 1958, in the County Court House, Charlottesville, Virginia, for the purpose of holding public hearing on matters per- raining to firearms, and we do hereby consent to the transaction of any and all business and the taking of such action at said meeting upon the matter hereina~ove menti°ned as maybe lawful' incident and necess~0'~ ~ / / Joh . The following petition, signed by a number of citizens from the South side of Albemarle County, was received and read: "~e, the ~madersigned residents of Albemarle County, Virginia, hereby, petition the Board of Supervisors of said county to request our representatives in the legislature presently meeting in Richmond, namely Senator E. Oo McOue, Jr., and Delegate E. C. Compton to attempt to have said legislature pass statutes to accomplish the following in Albemarle County, Virginia: (1) The prohibition of hunting er attempting to hunt with firearms any game bird or game animal on or within 100 yards of the State highway (See Section 29-147.1 Code of Virginia 1950, as amended).
