1960-01-20 A regular meeting of the Board of County Supervisors of Albemarle County, Virginia, was held at the Office Building of said County on'the 20th day of January, 1960. Present: Messrs. Jehu N. Williams, Edga~ N. Garnett, H. Ashby Harris, George C. Palmer, II, M. Y. Suther!and, Jr, and Robert Thraves. Absent: None. Officers present: County Executive and Commonwealth's Attorney. The meeting opened m~ith the Lord's Prayer led by Mr. M. M. Pence. Minutes of the~meetings of December 16, 1959, December 30, 1959 and Jan~mry 1, 1960, were rea¢ and approved. M~. Sutherland advised that he had received complaints about road in Spring Valley section passing through property of Dr. Coleman, regarding lake spillway flooding during rains. Mr. H. W. Runk~: resident engineer, advised that this road could be raised without too much trouble if rights of way could be obtaiRed. After some discussion of this matter, it was d~cided that Mr. Sutherland and Runkle investigate this road in an effort to determine what could be worked out. Communication was received from the Virginia Department of Highways advising that the follow- ing additions to the Secondary System .were. ~approved, effective January 1, 1960, as requested by resolu- tion of this Board of November 18, 1959: Woodhaven S~bdivision - Elizabeth ~Avenue from Route 847 (Holmes Avenue) to dead end. Length 0.07 mile. Azalea Garden~ Subdivision - Aza!aa Drive, from present Route 849 (Azalea Drive.) to Glen Avenue. Length 0.0~ mile. Bids were received on painting the interior of the County~ Office Building and the Court House as follows: D. F. Mowbray and Sons ..................... $1,9~66.38 George W. Wahl .......................... 2,549.70 On motion of Mr. Palmer, seconded by Mr. Garnett, and un~imous!y carried, the low bid of $1,966.38 of D. F. Mowbray & Sons was accepted. Mrl Joe Stevens and other citizens of the County appeared regarding obtaining 'the services of State veterinarians in an effort to rid this County of Bang's disease and requested that the Board adopt a resolution to this effect. On motion of Mr. Suther!and, seconded by Mr. Palmer, the following reso- lution was unanimously adopted: ~HEREAS, a number of citizens of Albemarle County have appeared before this Board in the interest of ridding this County of Bang's disease; NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the State Department of Agriculture be and is hereby requested to make available to Albemarle County the services of State vet- erinarians to come into this County to take tests in an effort to rid this area of Bang,s disease in cattle; and BE IT FURTHER RESOLVED that said services be made available as soon after July 1, 1960, as possible. A committee of the Civic League appeared and requested the Board of Supervisors to establish a system for providing and maintaining a land use map for Albemarle County. This matter was given con- siderable discussion after which the Chairman referred the matter to the Board's Land Use Committee to meet with the Civic League Committee and the Planning Commission to study this matter and report back to the Board at the regular February meeting. An offer of $168.00 was received from Mr. Leroy Snow for three acres of County owned land located in the Rivanna District~ and designated on the County's land identification map as parcel 33, tract 52. Mr. M. M. Pence recommended acceptance of this offer. On motion of Mr. Thraves, seconded by Mr. Harris, the offer of Mr. Snow for the purchase of the above mentioned property was accepted, subject to approval of the Court. An offer of $75.00 waz received from Mr. L, B. Clements for the purchase of two tracts Of County owned land located~in the Charl&ttesville District designated on the County's land identification map as parcel 20, map 75 and parcel 68, map 89. 'Mr'j Thraves advised that he considered this a fair offe ~or this land. On motion of Mr. Harris, seconded by Mr, Palmer the offer of Mr. Clements was accepted, subject to approval of the Court. ~ Mr. Legh Walker and several, other residents of the Scottsville District app&ared and requested relief in the h~nting problem in that~area, particularly with regard to thehnnting of deer with dogs. Theyrecalled numerous incidents which had occUrred in that area during the past~deer hunting season. Communications in this regard were also received from Mr. W. Lloyd-Reese.f Mr. Ellis P~ Jones, Mr. Harry F. Langhorne, Mr. Stuart A. Morgan and Mr. Daniel .G, vanclief. Those present were assured by the Board Shat law enforcement in the Scottsville District would be increased during the deer hunting'season. The Board also stated that it would arrange a meeting of these landowners with Ur. Compton, member of thetHouse of Delegates representing Albemarle County. Plat of William S. Roudabush on Addition II to Azalea Gardens Subdivision, owned by Zella Harris, as approved by the County and City Planning Commissions, was presented. On motion of Mr. Palmer seconded by Mr. Harris, and unanimously carried, this plat was approved and the Chairman and Clerk were authorized to sign same on behalf of this Board. Statements of Expenses of the Department of Finance, the Sheriff's Office, and the office of the Commonwealth's Attorney for the month of December, 1959, were presented, and on motion ~f Mr. Suther lamd, seconded by Mr. Garnett, were examined, verified and approved. Statement of Expenses incurred in the maintenance of the County Jail was submitted along with Summary Statement of Prisoner Days for the month of NeCember, 1959. On motion of Mr. Harris, seconded by Mr. Palmer, these Statements were examined, verified and aPProved~ Reports of ,the Department of Public Welfare for the month of December, 1959, were presented in accordance wit~ Sections 63-67.1 and 63-67.2 of the Code of Virginia, and were apprOved. Reports of the County Executive for the month of December, 1959, were prese~nted, approved and ordered filed. Report en inspection of the County Jail was received from the Division of Corrections of the Department of Welfare and Institutions and was ordered filed. The Board's attention was called to the fact that the terms of Dr. McLemore Birdsong, Mrs. Fred Liady, and Mr. Arnold Smith es members of the County Planning Commission expired on December 31, 1959. On motion of Mr. Sutherland, seCOnded by Mr. Harris, the foregoing members were reappointed to the Planning ~mmission. Communication was received from Mr. Edward D. DaughtreY in. which Mr~ Daughtrey submitted his resignation as a member of the Crozet Water Committee effective December 17, 1959. On motion of Mr. Garnett, seconded by Mr. Harris, and unanimously carried, the resignation of Mr.~ Daughtrey was accepted with regret and the County Executive was directed to write 'Mr.'Daughtrey, expressing the appreciation of this Board for his services. The Chairman suggested that the Board set up an election of members to the Crozet Water Committee by residents of the Crozet Sanitary District and referred this matter to the Crozet Water PrOblems Committee for study and report to the Board at the regular.-February meeting. Mr. Garnett,~ reporting for the Water Shed Committee, advised that his committee felt the time had arrived when definite action should be taken on the water shed matter. He recommended that each the water shed project as a whole with his committee and set the date and hour of such discussion at 8:00 P.M. on Tuesday, February 2, 1960. Annual report of the Circuit Court for. the year 1959 was received and ordered filed. The Board:~s attention was called to the fact that an Equalization Board for the year 1960 should be appointed at this time. On motion of Mr. Sutherland, seconded by Mr. Thraves, Mr. A. E._ Cut- right 9as appointed to the Equalization Board. Mr. Campbell Holt was appointed to this Board. and Mr. Thraves nominated Mr. Hamilton Burner. On motion of Mr. Harris, seconded by Mr. Emthertand, Mr. Garnett nominated Mr. Guy Via as the third member After some discussion, motion was offered by Mr. Barnett seconded byMr. Palmer, and unanimously carried, carrying over the appointment of the third member of the Equalization Board until the regular February meeting. Claim against the Dog Tax Fund was receiVed from Mr. Larned D. Randolph for one ewe and one lamb killed by dogs.. On motion of Mr.. Sutherland, seconded by Mr. Harris, Mr. Randolph was allowed $15.00 for this ewe and $10.00 for this lamb. Claim against the Dog Tax Fund was received from Mr. E. R. Sutherland for two ewes and one lam killed by dogs.~ On motion of Mr. Harris, seconded by~r. Garnett, Mr. Sutherland was allowed $20.00 for each o2 the ewes and $12.00 for the lamb. Claim against the Dog Tax Fund waz received from Mr. James H. Seale for eleven ewes and two lambs killed by dogs. On motion of Mr. Harris, seconded by Mr. Sutherland, Mr, Seale was allowed $7.00 for the lambs, $10.00 for the older ewes and $15.00 for the younger ewes. Claim against the Dog Ta~Fund was received from ~. Kenneth Maupin for seven five pound hens and three seven pound hens killed by dogs. On motion of Mr. Harris, seconded by Mr. Sutherland, Mr. ~aupin was allowed $0.75 for the five pound hens and $1.00 for the seven pound hens. Claim against the Dog Tax Fund was received from Mr. Nelson Jones for one rooster,t~eeNew Hampshire Red Hens and two White Rock Hens killed by dogs. On motion of Mr. Harris, seconded by M~. Sutherland, Mr. Jones was allowed $0.75 for the rooster, $1.O0 for the first hens and $0.60 for'the latter hens. On recommendation of the County Executive and on motionoof Mr. Harris, seconded by Mr. Palmer, and unanimously carried, the firm of Hunton, Williams, Gay, Moore and Powell of Richmond, Virginia, was employed to represent the County of Albemarle in the proposed annexation by the City of Charlottesville. On motion of Mr. Sutherland, seconded by Mr. Harris, rules with regard to second reading were suspended, and the following resolution unanimously adopted: ~BE IT RESOLVED by the Beard of County Supervisors of Albemarle County, Virginia, that $5,000.00 be and the same is hereby appropriated for payment ef retainer fee to the firm of Hunton, Williams, Gay, Moore and Powe!l for their services in representing this County ih the proposed amnexation. The County Executive adEised that due to change in State law, the County's Ordinance with regard to Slot Machine licenses should be amended to Comply with State law. On motion of Mr. Palmer, seconded by Mr. Suthert~nd, and unanimously carried, February 17, 1960, at lO:O0 A.M. was set as the date and hour for public hearing on this proposed amendment, and the Clerk was instruct~d~ to advertise intent to amend said Slot Machine Ordinance in accordance with law. Huff appezred regarding Free Union bridge over Mooreman's Ri.ver~ Mr. H. W. Runkle, Resident Highway Engineer, ~dvised Mr. Huff that this bridge had been placed in'the Federal Aid Program but that work would not be begun on same until about 1962. Mr. Huff also apps~d regarding road over the C&O Railroad at the~Woolen MillS and this matter was referred to Viewers. Mr. LeghWalker and Mr. Curtis Thacker appeared on behalf of the Monticello Memorial Foundatio~ requesting that road to Monticello ben,straightened. Mr. Thacker advised that during the past year 1158 buses visted Monticello and there were 240,000 paid visitors. He also stated that the majority of the necessary right of way could be given by the Monticello Memorial Foundation. After consideration.of this request~the following resolution was offered by Mr. Harris, seconded by Mr. Palmer, and unanimousl adopted: - BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the State Department of Highways be and is hereby requested to give consideration in its budget for the allocation of sufficient funds to imDrove and straighten Route 53 from Route 20 to the entrance of Monticello and thence, if funds are available, to the foot of Monticello Mountain along the road leading to Ash Lawn. Communications were received from the State Department of Highways advising that the following additions to the Secondary System had been approved effective January 1, 1960:_ (1) Forest Hills Subdivision (Rock Creek Road) From. S.C.L. of Charlottesville to Intersection Laurel Circle - length 0.03 mile. (2)Forest Hills Subdivision (Laurel Circle) from Intersection Rock Creek Road to Dead End - length 0.10 mile. (3) Greenbrier Subdivision - ~Banbury Street) from Intersection Route 1403 (Tarleton Drive) 0.05 mile S.W. Intersection Rt. 631 to Intersection Route 1403 (Tarleton Drive) 0.25 Mil S.N. Intersection Rt. 631 - length 0.35 mile.
