1961-06-28SPECIALJune 28, 1961 Pursuant to the following waiver, members of the Board of County Supervisors of Albe- marle County, Virginia, met in special sewsion on this date in the County office Building, Charlotte~vil] Virginia, at 1:30 P.M. with the following present: Messrs. John W. Williams, Edgar NgoGarnett, H. Ashby Harris, George C. Palmer, II, M. Y. Sutherland, Jr. and Robert Thraves. Absent: None. Also present: Mr. M. M. Pence, County Executive. We, the undersigned, members of the Board of County Supervisors of Albemarle County, Virginia, do hereby waive notice and special service thereof, of a meeting to be held at~12:00 Noon on the 28th day of June, 1961, For the..i.pUr-pose of considering matters pertaining to the following: (1) Temporary loan. (2) Appropriation to cover over-expended accounts. (3) July~4th Holiday. (4) Policy of assessment of trailers. (5) Shadwell Road, And we do hereby consent to any and all business and the taking of such action at said meeting upon the matters hereinabove mentioned as may be lawful, indident, and necessary thereto. ~. Robert Thraves The County Executive advised that a temporary loan would be necessary to meet the County's needs until proceeds of the School Bond issue are received. He stated that the County had~ $600,000.00 on time deposit which was drawing three percent and that if this was used, the County would lose this interest an~ it would be more economical to make a temporary loan. After discussion of this matter, ~he following resolution was offered by Mr. Palmer, seconded by Mr. Harris, rules with regard to second reading being suspended, by the following recorded vote: Ayes - Messrs. Williams, Garnett, Harris, Palmer, Sutherland, and ~Thraves. Nays - None.: WHEREAS, pursuant to Section 15-250 of the Code of Virginia, 1950, as amended, the Board of County Supervisors of Albemarle County, Virginia, is authorized to borrow, for the purpose of meeting casual deficits in the revenue, or creating a debt in anticipation of the collection of the revenue of the County, a sum of money not to exceed one-fourth of the amount produced by,he County levy for the calendar year 1961; and, WHEREAS, said board finds that it is in need of temporary financing in the sum of $300,000.00 for the operation of the government of the County until tax reve- nues for the current year 1961 become available; and, WHEREAS, the contemplated loan in the principal sum of $300,000 is less than one-fourth of the amount produced by the County levy for the calendar year 1961: NO~, THEREFORE, BE IT RESOLVED, by the Board of County Supervisors of Albemarle County, Virginia, that it borrow from The Peoples National Bank of Charlottesville and the National Bank and Trust Company at Charlottes- ville, for the purposes above set forth, said sum of $300,000, such in- debtedness to be evidenced by two negotiable notes, each in the principal sum of $150,000, bearing interest at the rate of 3% per annum, to be dated the 30th day of June~ 1961, and maturing December 15, 1961, one. of said notes to be payable to the order of The Peoples National Bank of Charlottes- ville, and the other to the or,er of National Bank and Trust Company at Charlottesville; RESOLVED, FURTHER, that John W. Williams, Chairman of the Board of Supervisors of Albemarle County, Virginia, be and he is hereby authorized, empowered and directed to execute said negotiable notes in the name and on behalf of said board and to deliver the s~m~. The County Executive also called to the Beard's attention to certain over-expended accounts for the fiscal year. On motion, rules with regard to second reading were suspended and the following resolution unanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the following amo~unts be ~nd the same are hereby appropriated to cover over-expenditures: GENERAL REVENUE FUND: laa Miscellaneous Services 7b Operation Dump No. 1 8d Lunacy Commission GETH~AL REVENUE FUND, DEPARTMENT OF EDUCATION: 17.51 Other Auxiliary Agencies 17.6 Operation of School Plant 17.61 Maintenance of School Plant 17.8 Capital Outlay 17 Scholarships in Aid of Education MCINTIRE TRUST FU~D: $ 6,262.70 19.83 355.4O $ 17,272.98 t,436~03 8,347.67 237.O1 18 $ 3,030.41 TEXTBOOK FUND 20 $ 12,011.61 SEEOIAL SCHOOL CAPIT.A.L....OUTLAY FUND: 61 TO.~AL 'ALL FUNDS The Chairman recommended that County employees be given holiday on Monday, July 3, in accor- dance with the State policy this year. On motion by Mr. Harris, seconded by Mr. Thraves, this recomm, en- dation was accepted. Mr. Hugh F. Simms appeared with regard to the assessment of trailers and requested that the Board establish a definite policy with regard to same. On motion of Mr. Sutherland, seconded by Mr. Thraves, the following resolution was unanimously adopted: BE IT.RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that trailers shall be assessed as personal property as a general policy; however, the same shall be assessed as real estate when meeting +the following re- quirements: The person owning the trailer shall also own the land on which said trailer is situated. (2) All parts which make the trailer movable shall be removed. (3) The trailer shall be attached to a permanent foundation which is permanently attached to the ground. Mr. Simms also appeared with regard to Shadwell Road in the Shadwell Estates Subdivision, advising that the executive committee of the Planning Commission had investigated this road in accordan. with resolution of this Board adopted June 21, 1961. After discussion of the matter, resolution ~dopted on June 21, 1961, waz rescinded and the following resolution unanimously adopted on motion of Mr. Thrave~ seconded by Mr. Sutherland: WHEREAS, the following section of Shadwell Road in the Shadwell Estates and Milton Heights subdivisions has been completed in accordance with standards and specifications of the Virginia Department of Highways, NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Albe- marle County, Virginia, that the Virginia Department of Highways be and is hereby requested to accept into the Secondary System of Highways an extension of Shadwell Road for a distance of approximately 1,350 feet from the end of p~esent State BE IT FURTHEH RESOLVED that the Virginia Department of Highways be and is hereby guaranteed a fifty-foot unobstructed right-of-way along this requested addition, the same having been dedicated along with drainage easements and re- corded in Deed Book 339, page 458(c) in the Office of the Clerk of the Circuit Cotlrt. On motion, the meeting adjourned.
