1961-08-0SPECIAL August 7, 1961 Pursuant to the following waiver, members of the Board of County Supervisors of Albemarle- County, Virginia, met in special session on this date in the County Office Building, Charlottesville, Virginia, at 3:00 P.M. with the following present: Garnett, M. Y. Sutherland, Jr. and Robert Thraves. County Executive and Commonwealth's Attorney. We, the undersigned, members of the Board of County Supervisors of Albemarle County, Virginia, do hereby waive notice and special service thereof, of a meeting to be held at 3:00 P.M. on the 7th day of August, 1961, for the purpose of considering matters pertaining to ~oning, and we do hereby consent to any and all business and the taking of such action at said meeting upon the matter hereinabove me~ioned as may be lawful, incident, and necessary thereto. ~ ~ ~ -~~ ./,,~'" Jo W. s ~ gdgar N. uarnett Messrs. Sutherlasd, Jr. Robert Thraves The Chairman explained that a special meeting was called regarding opposition to the proposed construction of an apartment ~ilding on Brandywine Drive at the Court House on August 2, 1961. He stat~ that since there was not a quorum present, he and Mr. Sutherland being the only members present, no action could be taken after the public hearing and this meeting was called as a result of such public hearing. The Board was advised that Mr. Joseph Richmond, attorney representing the opposition in this cawe, had asked if it were possible for the County to request the City to zone that portion of the Count~ which is to be arn~exed within the next eighteen months. The Commonwealth's Attorney advised that the Ci~ has no authority in this matter until January l, 1963. However, at the request of those present and the Board, he stated that he would contact the City Attorney to see if anything could be worked out although he strongly doubted the legality of such an arrangement. Several persons present expressed a desire for zoning in the County to prevent further situati, of this nature. The Commonwealth's Attorney explained the channels through which the County would have to proceed to effect a zoning ordinance. After much discussion of this matter, motion was offered by Mr. Harris, seconded by Mr. Sutherland, and unanimously carried, requesting the Planning Commission to prepare a map and zoning ordinance and to pursue the present studied on land use to this end. The Chai~ manCappointed a committee consisting of Messrs. Garnett, Palmer and Th~aves ~e meet jointly with the Planning Commission regarding this matter and requested that a preliminaryreport be brought back to th~ Board at the regular August meeting. On motion of Mr. Sutherland, seconded by Mr. Harris, the following resolution was ~muanimously adopted: WEEREAS, the Board of County Supervisors of Albemarle County is proud of Rutledge Subdivision and the manner in which it has been developed; and WH~EAS, it is the feeling of this Board that it would be in the best interest of the County if the proposed apartment buildings on Brandywine Drive not be constructed; NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors that Mr. Henry Koch be and is hereby requested to reconsider his plans for the construction On motion, the meeting adjourned. August 17, 1961 On motion of Nr. Thraves, seconded by Mr. Palmer, the regular August 17, 1961, meeting was adjourne~ until August 31, 1961, due to the fact that ~ quorum could.not be present for said meeting. Chairman
