1952-06-18[22 A regular meeting of the Board of County Supervisors ef Albemarle County, Virginia, was held at the Office Building of said County on the IS~h day of J~ne, 1952. Present.' Messrs. C. Purcell M¢Cue, E. H. Bain, H. Ashby Harris, Edward L. Smith, J. W. Williams, and W. W. Wood. Absent: None. Officers present: County Executive and Commonwealth's Attorney. The meeting opened with the Lord's Prayer led by Mr. E. H. Bain. Minutes ef the meeting of May 21st, 1952, were read and approved. Mr. Cecil Ma~pin appeared at the request of Mr. J. W. Williams and explained to the board exactly what happened in the shooting of Thomas W. Wolfe and Ike Shiflett. Mr. Maupin stated that Mr. Wolfe and Mr. Earl Davis came by his store and asked that he go with them to serve a warrant against ~r. Shiflett due to the fact that Shiflett was deaf and dumb and Mr. Maupin could make him ~nderstand him. He further stated that in resisting arrest, Shifle~t fire/at least four times and shot Mr. Wolfe before Mr. Davis fired the first shot at him. Dr. Robert King appeared .before the Board and requested ~hat the $!,200.00 balance in the appropriation for fire protection in ~he current budget be divided between the Scottsville and Crozet Volunteer Fire Companies. Upon motion, made by Mr. Harris and seconded by Mr. Williams, the following resolution was unanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the balance of $1,200.00 in the appropriation for fire protection in the current budget be and is hereby divided equally between the SeottsVille and Crozet Volunteer Fire Departments. Dr. S. D. Sturkie, Health Director, reported to the Board on his investigation and study of a rabies program in the Count/. He advised that he had contacted the local veterinarians who had agreed to serve in clinics, if established in the CoUnty, and give vaccine £~r fifty cents per dog'tO be paid by the dog owners, provided the vaccine, a clerk and an assistant were furnished and further provided tha~ a law enforcement officer is on hand. ~r. Sturkie advised that the Health Department could fumaish a clerk and an assistant and that the vaccine would cost approximately' ~hirty-six cents per dog, and he believed, on the basis of the present dog population, an~.appropriation of $2,000.00 would be adequate to provide the required vaccine. ~r. Sturkie also a~ated that he felt the County should adopt an ordi- nance regarding this matter and presented to the Board a draft of such an ordinance. Upon motion, made by Mr. Williams and seconded by Mr. Harris, this matter was taken under consideration. Claim of E. L. Bradley for one ewe and one lamb killed by dogs was presented. Upon motion, made by Mr. Harris and aeconded by Williams, Mr. Bradley. was allowed $15.00 for the ewe and $25.00 for the lamb. Claim of W. E. B~ford for one buck and three ewes killed by dogs was presented. Ne action was taken en this claim. Claim of 6eorge /~Gibson for fifty-four chickens killed by dogs was presented. Upon motion, made by Mr. Bain and seconded by Mr. Wood, Mr. Gibson~.-was allowed $0.50 eqch for these chickens. Claim of Robert Crile for four turkeys claimed to have been killed by dogs was presented. Mr. W. R. Napier, Game Warden, advised the Board that he examined the turkeys and felt that they were not killed by dogs. Upon motion, made by Mr. Williams and seconded by Mr. Wood, the claim was denied on the basis of the information furnished by the Game Warden. Claim of A. L. Blackwell for one c~_~ killed by dogs was presented. Upon motion, made by Mr. Wood and seconded by Mr. Harris, Mr. Blackwell was allowed $45.00 for this calf. Claim of MrS. Nellie Carver for thirty-five chickens killed by dogs was presented. Upon motion, duly made and Claim of E. N. Garnett for one ewe killed by dogs was presented. Upon motion, duly made and seconded, Mr. Garnett was allowed $27.00 for this ewe. Claim of Mr. Rosser Morris for one lamb killed by dogs was presented, Upon motion, duly made and seconded, Mr. Morris was allowed $15.00 for this lamb. Claim of S. W. Barnes for one ewe and one lamb killed by d~ogs was presented. Upon motion, made by Mr. Harris and seconded by Br. Smith, Mr. Barnes was allowed $30.00 for the awe and $15.00 for the lamb. Claim of Tom Cary for four ducks killed by dogs was presented. Upon motion, made by Mr. Harris and :seconded by gr. Williams, Mr. Cary was allowed $3.00 each for these ducks. Claim of Leon S. Dure for one ewe and one lamb killed by dogs was presented along with copy ofll loan receipt of the Fireman's Fund Insurance Company. Upon motion, made by Mr. Bain and seconded by Mr. Smith, $30.00 was a!lowad for this ewe and $25.00 was allowed for the t~mb and it was ordered that check for same be made payable to Leon S. Dure and The Fireman's Fund Insurance Company. Petition was presented by Mr. Earle Lipscomb, and a delegation appeared, requesting that the Board recommend to the State Highway D~partment that Route 630, betgeen Alberene and Route 6, at Tinnell Filling Station, be widened, graded and hard-surfaced. Mr. W. W. Shields, Resident Engineer, advised the delegation that no money was included in the current construction budget for improvements to this road but that-he felt that improvements would be made after this year. Mr. Leslie H. Walton, Asst. Superintendent of Schools, appeared and discussed with the Boar~ and Mr. Shields, the need for improvements to the road by the Central High School. After a discussion of the matter, motion was made by Mr. Williams and seconded by Mr. Harris, requested that Mr. Walton ~ meet with Mr. Shields, Resident Engineer, and Mr. Downing Smith, Commonwealth's Attorney, to work out plans for needed improvements on said road and to prepare a resolution for this Board. Communication was received from Jo A. Anderson, Highway Commissioner, acknowledging receipt o2 this Board's resolution of May 21 regarding the need for widening bridges on Route 240 near Crozet ~i and assuring the Board that the Commission would give all possible consideration to the request. Petition was received from a number of citizens requesting that a cross road be built connect- ing the Scottsville Road with the Old Lynchhurg Road. It was ordered that this petition be acknowledg~ and filed. Mr. D. A. Robinson, Director of Finance, submitted a Statement of Expenses of the Department of Finance for the month of May, 1952, ~ne-thir~ of which to be borne by the State. Upon motion, duly made and seconded, this Statement was examined, verified, and approved. Mr. D. A. Robinson, Director of Finance, submitted a Statement of Expenses of the Sheriff's Office for the month of May, 1952, two-thirds of which to be borne by %he-state. Upon motion, duly made and seconded, this Statement was examined, verified, and approved. Mr. D. A. Robinson, Director of Finance,ssubmitted a Statement of Expenses of the Common- wealth Attorney's Office for the month cf May, 1952, one-half of which to be borne by the State. Upon motion, duly made and seconded, this Statement was examined, verified and approved. Statement of Expenses incurred in the maintenance of prisoners confined in the County Jail during the month of May, 1952, along with a Summary Statement of Prisoner Days, was submitted. Upon motion, duly made and seconded, this Statement was examined, verified and approved. Claim of Dr. Richard T. Ergenbright, Jail Physician, in the amount of $7.00 was presented, and upon motion, made by Mr. Williams and seconded by Mr. Wood, was approved for payment. Report of the County Executive for the month of gay, 1952, was presented, approved, and ordered filed. The matter of compensation for the widow of Thomas W. Wolfe, Deputy Sheriff, was again dis- '~ cussed, and upon motion, made by Mr. Williams and seconded by Mr. Bain, the following resolution was una~_mous!y adopted: 124 BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that Mrs. Thomas W. Wolfe, widow of the late Thomas W. Wolfe, Deputy Sheriff of this County, who was Rilled in the line of alu%y, be paid a lump sum of $1,500.00 and that she also be paid $I~6.66 per month for thirty-six months beginning July 1, 1952. Upon motion, made By Mr. Bain and seconded by Mr. Williams, the following resolution was also unanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that $1,500.00 be and is hereby appropriated from the Unappropriated ~eserve of the General Fund to cover amount approved for payment to Mrs. Thomas W. Wolfe. Upon motion, made by Mr. Williams and seconded by Mr. Harris, Mr. D. A. Robinson was appointed chairman of a campaign to raise funds for a scholarship at the University of Virginia for Thomas Wolfe The following resolution was received from the Albemarle County School Board: BE IT RESOLVED that the Albemarle County Board of Supervisors be and is hereby requested to transfer funds as need arises from the Special School Capital Outlay Fund to funds for the construction of individual school buildings as the School Board carries out its school construction program. Upon motion, made by Mr. Williams and seeonded by Mr. Harris, the following resolution was unanimously adopted :~ BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that $147,608.05 be and is hereby authorized to be transferred from the Special School Capital Outlay Fund to the Albemarle Central High School Construction Fund. BE IT FURTPJ~R RESOLVED that a temporary loan of $260,000.00 be and is here- by authorized from the General Fund to the Albemarle Central High School Construction Fund. Mr. Henry Chiles appeared in protest to the use of garnishments in the collection of taxes. This matter was discussed at length but no action was taken by the Board. Upon motion, made by Mr. Bain and seconded by Mr. Wood, $1,500.00 was approved as the County's~ share of the salary of Mr. Edward Button, Assistant County Agent. Mr. Clark, District Agent from Euray, appeared and discussed this matter with the Board. At 2:00 P.M. Mr. R. B. Deputy The Board's attention was called to the fact that. a uniform was ordered for~heriff Earl H. Davis on October 29, 1952, at which time the County was paying for uniforms, and was not received until February 26, 1952, at which time the Deputies were required to pay for their own uniforms. The Board was advised that Mr. Davis felt that .under the circumstances he should not be required te pay for this uniform and this matter was referred te the Sheriff's Committee on motion of ~. Bain seconded by Mr. Mr. D. A. Robinson requested ~he Board's consideration in keeping Mr. J. Mason Smith employed as a helper as the County Jail as long as possible, supplementing the amount which he will receive from Social Security Benefits up to $100.00 per month. Williams, it was ordered that Mr. Smith's employment by the County be continued as long as possible as a helper at the Jail, his salary to supplement S. S. benefits up to a total salary of $100.00 per month. Mr. Williams advised the Board that Mr. W. S. Cock, Sheriff, had asked the he request the Board's approval of the employment of Mr. Fred Frazier, formerly of the City Police Force, as a Deputy Sheriff at an annual salary of $2520.00. Upon mo~i~n, made by Mr. Williams and seconded by Mr. Wood, it was ordered that Mr. Cook's request be honored as of July l, 1952. · he matter of Waynesboro's participation iu the District Home was again discussed and the Commonwealth's Attorney was instructed te ~zkenthis matter under advisement and make recommendation to this Board. The matter of fire equipment for the County was discussed and Mr. Williams advised that a truck, carrying 500 gallons of water would cost approximately $10,000. O0 and that two men for the opera-' tion of such a truck would be about $5,000.00 per annum. He recommended that the Chairmah appoint a committee to meet with the City Council to discuss the possibilities of an arrangement with the City, such somm~.tee to report back at the next meeting of the Board. Mr. McOue appointed Mr. Williams, Mr. Bain and Mrs. ~mith to serve on this committee. Mr. Robinson advised the Board that he had received several inquiries as to whether or not the delinquent lists on 1951 taxew ~uld be published. No action was taken on this matter. Gommunication was received from the League of Virginia Counties regarding the Local Governmen~ Officials' Conference being planned for ~ume 25th through June 28th at the University of Virginia.' Mr. Robinson suggested that the County be host to the visitors of thms' Conference. The Chairman appointed Mr. Robinson$ Mr. _Williams, Mr. Bain and Mr. Wood to serve as a committee to make plans for this event. Elaim of the University of Virginia Hospital in the ame~ut of $873.00 was presented, erie-half of which to be borne by the County, and was approved f~r payment. Reports of the Department of Public Welfare for the month of May, 1752, were presented in accordance with Section 371 of the Acts of the ~eneral Assembly of 1950. The 1952-53 budget of the Welfare Department was received from the Department of Welfare and Institutions. Nr. Robinson suggested that this Budget be referred to the Welfare Department £~r com- pletion and returned to this Board. Annual reports were received from the County Agent and Assistants and were ordered filed. Communication was received from Mr. R. Granville Ergenbright, Credit Nanager of the University of Virginia Hospital regarding the hospital expenses of Ike Shiflett. This matter was left in the hands of Nr. Robinson. Upon motion, made by Mr. Wood and seconded by Mr. Williams, the following resolution was unanimously adopted: BE IT RESOLVED by the Hoard of County Supervisors of Albemarle County, Virginia, that the offer of $100.00 from Mr. Lawrence Wi!kerson for the folloWing tracts of land in the Rivanna District be and is hereby accepted: 2.25 acres - I~entified on Nap No.' 34 as parcel 88. 1.00 acres - Identified on Map No. 34 as parcel 89. 1.19 acres - Identified on Nap No. 34 as parcel 90. Communication was received from the Safety Committee of the Chamber of Commerce requesting tha~ 8, 1952 at 8 o'clock 'in the City Hall. Mr. McCue appointed Mr. Bain to attend this meeting. Request was received from the Chamber of Commerce for an appzopriatien of $400.00 for the the Board appoint one of its members to attend the organization meeting of a Safety Council on July /L26 fcl!ewi~ resolution was unanimously adopted: BE IT ~ESOL~ by the Board of County Supervisors of Albemarle County, Virginia, that $300600 be and is hereby app~priated from Unappropriated Reserve of the General Fund in the 1952-53 Budget to be used for contribution to the Adver- rising Fund of the Chamber of Commerce.
