1953-07-15 A regular meeting of the Board of County Supervisors of Albemarle County, Virginia, was held at the Office Building of said County on the 15th day of July, 1953. Williams. Present: Messrs. C. Purcell McCue, E. H. Bain, H. Ashby Harris, Edward L. Smith, and Jo W. Absent: Mr. W. W. Wood. Officers present: County Executive and Commonwealth's Attorney. Minutes of the meetings of Nay 22, May 29, June 3, June 9, June 17, June 20 and June 25, 1953 I were read and approved. The Lord's Prayer was led by Mr. E. H. BhLn. Mr. M. M. Pence, Director of Finance, submitted a Statement of Expenses ef the Department of Finance for the month of June, 1953, one-third of which to be borne by the State. Upon motion, duly made and seconded, this Statement was examined, verified and approved. Mr. M. M. Pence, Director of Finance, submitted a Statement of Expenses of the Sheriff's Offic for the month of June, 1953, two-thirds of which to be borne by the State. Upon motion~~ duly made and seconded, this Statement was examined, verified and approved. Mr. M. M. Pence, Director of Finance, submitted a Statement of Expenses of the Commonwealth Attorney's Office, 2or the month of June, 1953, one-half of which to be borne by the State. Upon motio~ duly made and seconded, this statement was e~mined, verified and approved. Statement of Expenses incurred in the maintenance of the COunty Jail for the month of June, 1953, along with a Summary Statement of Prisoner Days, was submitted. UpOn motion, duly made and seconded, this Statement was examined, verified and approved. Claim of Dr. Richard T. Ergenbright, Jail Physician in the amount of $18.00 was presented for the month of June, 1953. Upon motion, made by Mr. Williams and seconded by Mr. Harris, this claim was approEed for payment. Reports ef the Department of Public Welfare for the month of June, 1953, were presented in accordance with Secti~on 371 of the 1950 Acts of the General Assembly. Contract was received from the University of Virginia Hospital for care of indigent patients per day from the County of Albemarle at a rate of $15.70~ the same as now in force, for the period from July l, 1953 through September 30, 1953. Upon motion, made by Mr. Williams and seconded by Mr. Bain, it was ordered that this contract be accepted and that the Chairman be authorized to execute same on behalf of the Board of County Supervisors. The following report was received from the Committee appointed to study the matter of compul- spry vaccination of dogs: "Board of County Supervisors Albemarle County, Virginia Gentlemen: At the regular ~am~JJ~m~eting of the Board of County Supervisors the matter with respect to an ordinance requiring the compulsory vaccination of dogs was re- ferred to this Committee for study and report. After due discussion, it is the recommendation of this Committee that the Council of the City of Charlottesville be approached and asked to appoint a Com- mittee to confer with a Committee from this Board for joint action with regard to this matter. Report of the County Executive for the month of June, 1953, was presented, approved and ordered filed. In reference to a recommendation received from the Crozet Water Committee at the last regular meeting to extend the six inch water main on Hilltop Avenue in the Blue Ridge Motor Company Subdivision,i 238 recommending that this main be extended for 400 feet rather than the 600 feet as previously proposed, the Blue Ridge Motor Company advance one-third of the cost, the County to bear the remainder of the cost which would be approximately $800.00. After a considerable discussion of this matter, motion was offered by Mr. Bain to adopt the recommendation of the Water Committee. and no further action was taken on this matter. Mr. Cecil Maupinappeared and requested a continuation of the Federal Aid Project en the road from Free Union to White Hall. Mr. ~. W. Shields, Resident Engineer, advised that this entire This motion received no second, project has been programmed and that work will be continued as soon as federal money becomes available. The following Viewers' Report was presented and upon motion of Mr. Bain, seconded b~JMr. Williams, was accepted in accordance with Section 2039 of the Virginia Code: We, the undersigned, being Viewers appointed by your Board at its regular meeting on May 20, 1953 to view the following described section of road and make report to your Board, hereby wish to advise that on June 15, 1953 we did view the follow- ing section of road and make report on same: Beginning at the end of maintenance at the end of Route 610 at Eastham section and continuing to the east for a distance of i8 of a mile. After viewing the entire section of this road and talking with the people living on same, we are ~uanimous in the opinion that there is not and will not develop sufficient public service to justify the cost of constructing and maintaining, this section of road. However, we do recommend that when the people interested, will have graded, drained, and stabalized with crusher stone that sections beginning at the end of the present State Maintenance and continuing for approximately .2 of a mile to the location of gate and cattle guard, that this .2 of a mile will be added to the State Secondary System. Cale a~peared before the Board re~arding the overall school construction and improvement program. Mr. Henley reported onthe progress which has been made thus far and Mr. Paul~t discussed the proposed improvements at the S¢ottsville School which he stated was the next step in the school improvement program. He requested authority of the Board to employ an architect to make a survey of the needs and draw preliminary plans at the Scottsville School He stated that it was the feeling of the School Board that there should be an addition of one room to the primary school, the installation of a heating plant and a change in the toilet facilities. After considerable discussion, motion was of 2ered by Mr. Williams and seconded by Mr. Harris, requesting the Chairman to appoint a committee from this Board to work with a Committee from the School Board in this matter and report back to the Board. The Chairman appointed the following to serve on this Committee: Messrs. H. Ashby Harris, J. W. Williams and E. H. Bain. Mr. Robert Musselman appeared and presented to the Board a report on the t~rn-over audit. At the suggestion of Mr. Nusselman, motion was made by Mr. Bain and seconded by Mr. Smith, approving a supplemental informal report on the audit. Mr. Musselman advised the Board that in a com~erence with Mr. J. Gordon Bennett, Auditor of Public Accounts, Mr. Bennett had ruled that two signatures on all checks were a necessity and that the signatures should be on two separate plates. After considerable discussion the following resolution was unanimously adopted on motion of Mr. Bain seconded by Mr. Williams: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the Clerk of the Board of County Supervisors shall counter sign all checks on all of the County's accounts in lieu of the Chairman, said Clerk to be bonded in the amount of $5,000.00 in addition to the blanket bond covering em- ployees of the Department of Finance, and BE IT FURTHER RESOLVED that there shall be a separate signature plate for the Director of Finance and a separate signature plate for the Clerk of the Board, and BE IT FURTH~ RESOLVED that the Board of County Supervisors and the Commonwealth's Attorney be furnished with a list of all checks once a~month. Upon motion, made by Mr. Bain and seconded by Mr. Williams, tentative bill in the amount of Claim against the Dog Tax Fund was received from Mr. Guy Via for four ewes and one lamb killed by dogs. Upon motion, made by Mr. Bain and seconded by Mr. Harris, Mr. Via was allowed $20.00 for each i of the ewes and $22.50 for the lamb, a total of $102.50. Claim against the Dog Tax Fund was received from Mr. J. S. Barney for fifteen turkeys killed by dogs. Upon motion, made by $~. Bain and seconded by Mr. Harris, Mr. Barney was allowed $4500 for each of these turkeys, a total of $60.00. Claim against the Dog Tax Fund was received from Mr. J. S. Barney for tRirteen turkeys killed by dogs. Up°n motion made by Mr. Bain and seconded by Mr. H~arris, Mr. Barney was allowed $3.50 for each of these turkeys, a total of $45.50~' Claim against the Dog Tax Fund was received from Mr. J. S. Barney for twenty-three turkeys killed by dogs. Upon motion, made by Mr. Harris and seconded by Mr. Bain, Mr. Barney was allowed $4.50 for each of these turkeys, a total of $103.50. Claim against the Dog Tax Fund was received from W. %. CA~ter for thirty chickens claimed to have been killed by dogs. This claim was denied due to the fact that the Game Warden did not view the carcasses. Claim against the Dog Tax Fund was received from Mr. J. W. Apperson for twenty-two hens killed by dogs. Upon motion, made by Mr. Williams and seconded by ~'~r. Harris, Mr. Apperson was allowed $1.50 for each of these hens, a total of $33.00. C~aim against the Dog Tax Fund was received from Mr. P. H. Gentry for ten hens killed by dogs. Upon motion, made by Mr. Williams and seconded by Mr. Harris, Mr. Gentry was allowed $1.25 for each of these hens, a total of $12.50. Claim against the Dog Tax Fund was received from Mr. Henry C. Page for five ewes and one lamb killed by dogs. Upon motion, made by Mr. Harris and seconded by Mr. Bain, Nrc Page was allowed $22.50 for each of these ewes and $20.00 for the lamb, a total of~$132.50. Claim against the Dog Tax Fund was received from Mrs. Earle Eipscomb for seven rabbi~s claimed to have been killed by dogs. This claim was denied due to the fact that the Game Warden did not view the carcasses. Claim against the Dog Tax Fund was received from Highland Orchards for one lamb killed by dogs. Upon motion, made by Mr. Williams and seconded by Mr. Bain, $22.50 was allowed for this lamb. Claim against the Dog Tax Fund was received from Mr. Earl A. Clark for one ewe killed by dogs. Upon motion, made by Mr. Williams and seconded by Mr. Bain, Mr. Clark was allowed $75.00 for this pure- bred ewe. Upon motion, made by Mr. Nilliams and seconded by Mr. Smith, the following Resolution was unan imously adopted: WHEREAS, the following salary adjustments of certain County officers and employees of the Albemarle County Department of Finance have been approved by this Board and incorporated in the County's 1953-54 budget, effective July l, 1953;~ NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Albe- marle County, Virginia, that the Compensation Board of the State of Virginia be and is hereby requested to approve these salary adjustments and to participate in its proportionate share of same: Name and Posit_Son M. Harris, the followi~ngResolution was un~ani- mously adopte~: BE IT RE. SOLVED b2-the Board of County Supervisors of Albemarle County, Virginia, that pursuant to Section 59-215 of the 1950 Code of Virginia, the County Executive be and is hereby directed ~nd authorized to issue permits for the display of fire works upon application in writing by a fair association, amusement parks, or by any organization or group of individuals, on the condition that the Sheriff of Albemarle County or some person designated by him will be present at the diwplay of such fire works. Mr. Pence a~wispd that communication had been received from the Calhoun Chevrolet Company offering to renew its contract with the County for purchase of automotive equipment, for the coming year and also advised that an order had been issued for a Ford Police Car for comparative purposes. Upon motion, made by Mr. Bain and seconded by Mr. William, the purchase of the aforementioned Ford car was approved. Upon motion, made by Mr. Smith and ~econded~'~Nr. Williams, the following offer was accept~ from the Calhoun Chevrolet Company to furnish the County's automotive equipment for the year ending June 30, .1954: ~ Net cost, F.O.B ..... ~ Freight ~ Delivery and Handling ($25.00 per unit) Tire Tax Total of the above items plus 5% is cost to the County of~d~lbemarle. The Board's attention was called to the fact that Mr. Campbell Holt had resigned from the Board. of Public Welfare. Upon motion, made by Mr. H~r~isJand secondedby Mr. Williams, Mr. Elmer Johns¢ was appointed to serve on the Welfare Board for a term of three years, expiring June 30, 1956. Co~unication was received fromCharlotte Thomas advising the Board that every time it rains the water pours from the brick building behind her home at 420 Four, Street, N.E. owned by the County. Mr. Pence advised the Board that he would observe this situation and report back. Communication was received from the Fidelity and Camualty Company returning check No. 5483 drawn to W. H. Sutherland in the amount of $70.00 for hog killed by dogs due to the fact that the insur~ company had reimbursed ~r. Suthertand. Upon motion, duly made and seconded, the following resolution was UUanimouslyadopted: WHEREAS, Mr. Floyd E. Johnson has given unstintingly of his time and ability in the designing and supervision of the air warden shelters located throughout the County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Albe- marle County that the sincere thanks and appreciation of this Board be expressed to Mr. Johnson for his personal interest and most able contribution in this matter.
