1953-10-21 A regular meeting of the Board of County Supervisors of Albemarle County, Virginia, was held at the Office Building of said County on the 21st day of uctober, 1953. Present: Messrs. C. Purcell McCue, E. H. Bain, H. Ashby Harris, Edward E.. Smith, John W. Williams and W. W. Wood. Absent: None. proved. Officers present: County Executive and Commonwealth's Attorney. The meeting opened with the Lord's Prayer led by Mr. E. H. Bain. Minutes of the meetings of September 16, September 23, and October 9, 1953, were read and ap- Communication was received from the State Department of Highways regarding the Board's request to relocate a portion of the Route 250 By-Pass and was ordered filed. Upon motion, made by Mr. Williams and seconded by ~Lr. Bain, it was ordered that a committee from the Highway Commission be requested to meet with the Board at a time convenient to both bodies to discuss this matter further. Mr. Cecil Maupin and several other residents of the Free Union area appeared and requested improvements to Route 609 from Route 665 to Wesley Chapel, a distance of approximately 2-3/4 miles. The requested straightening of curves and black top if possible. Upon motion, made by Mr. Bain and seconded by Mr. Williams, the following resolution was unanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the State Department of Highwa~ be and is hereby requested to give consideration to the improvement of Route 609 from R6ute 665 (Free Union) to Wesley Chapel, a distance of approximately 2-3/4 miles. Mr. Henry Gordon, Attorney, appeared on behalf of a group of citizens from the Barboursville vicinity and requested the inclusion in the Secondary System of an extension of-the Lockhart Road to con neet with the Barboursville Road. Mr. Gordon was advised that this matter would be considered by viewers the next time they are appointed if a written application was submitted. Mr. Catterton and a number of interested citizens appeared and requested improvements, includ-!! ing b~ack-top, on Route 662 in the Earlysville area which they stated was dangerous to the school buses that travel over this road. Upon~ motion, made by Mr. Bain and seconded by Mr. ~illiams, the following resolution was unanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the State Department of Highways be and is hereby requested to give consideration to the i~provement of Route 662 near Earlysville. Mr. Catterton and a group of citizens also appeared and requested improvements to Route 667 from Route 601 to Route 665, a distance of approximately 3½ miles. They requested black-top, straighten. &f curves and grading. Upon motion!, made by Mr. Bain and seconded by ~r. Nilliams, the following reso- lution was unanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the State Department of Highways be and is hereby requested to give consideration to the improvement of Route 667, a~?~distance of approximately 3-1/2 Silos, connecting Routes 601 and 665. Upon request received from Mr. W. W. Shields, Resident Engineer, the following resolution, offered by Mr. Harris and seconded hy Mr. Wood, was uaanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the State Department of Highways be and is hereby authorized to transfer f~nds in the amount of $205.00 from an overage alloted for the road at Burnleys to cover a shortage on Route 712 at Keene. Upon motion, made by Mr. Bain and seconded by Mr. Williams~ the following resolution was unanimously adopted: 258 BE IT RESOLVED by the Board of~ County Supervisors of Albemarle County, Virginia, that the Final Secondary Budget for the year ending June 30, 1954, as presented by Mr. W. W. Shields, Resident Engineer, be and is hereby approved in the following amounts: Ordinary Maintenance $225,065.12 Maintenance Replacements 52,575.00 Construction 116,100.00 Total $393,740.12 Mr. M. M. Pence, Director of Finance, submitted a Statement of Expenses of the Department of Finance for the month of September, 1953, one-third of which to be borne by the State. Upon motion, duly made and seconded, this Statement was examined, verified, and approved. Mr. M. M. Pence, Director of Finance, submitted a Statement of Expenses of the Sheriff's Offic for the month of September, 1953, two-thirds of which to be borne by the State. Upon motion, du~y made and seconded, this Statement was examined, verified, and approved. Mr. M. M. Pence, Director of Finance~' submitted a Statement of Expenses of the Commonwealth Attorney's~ Office for the month of September, 1953, one-half of which to be borne by the State. Upon motion, duly made and seconded, this Statement was examined, verified and approved. Statement of Expenses incurred in the maintenance of Prisoners confined in the County Jail was submitted along with a Statement of Prisoner Days. Upon motion, duly made and seconded, this Statement was examined, verified and approved. Claim of Dr, Richard T. Ergenbright in the amount of $12.00 for services as Jail Physician for the month of September, 1953, was presented, and upon motion, made by Mr. Wood. and seconded by Mr. Smith, was approved for payment. Report of the County Executive for the month of September, 1953, was presented, 'Approved, and ordered filed. Reports of the Department of Public Welfare were presented in accordance with Section 371 of the 1950 Acts of the General Assembly. Claim of the University of Virginia Hospital in the amount of $1,303.70, of which one-half is due by the County of Albemarle for indigents patients was presented, and upon motion of Mr. Bain, seconded by Mr. Williams, was approved for payment. Col. Henry B. Goedloe, Chairman of the EleCtoral Board. and Mr. Malcolm Christian, General Registrar, appeared before the Board re~arding supplies and equipment for setting up new files in the office of the General Registrar and for preparing new files for the precincts. ~r. Christian advised that he had obtained bids from three companies, and it appeared that the initial cost would be approxi- ma~e!y $2,500.00. Mr. Pence was ahthorized to purchase the equipment needed and the following resolutic offered by Mr. Bain and seconded by Mr. Williams, was unanimously adopted: BE .2T RESOEVED by the Board of County Supervisors of Albemarle County, ~irginia, that $2,500.00 be and is hereby appropriated from Unappropriated Reserve of the General Fund to cover capital outlay expenditures in the office of the General Registrar for files and other equipment. Mr. Rosenkrans appeared as a representative of the Post Office Department regarding the water in the Crozet Sanitary DistriCt. He stated that although the filter plant is in operation, that all of the water is not being filtered and that it has a distastful flavor. Mr. Pence advised that the con- tractor has been contacted regarding this matter and that the wells and springs would be pumped into the filter plant if possible and also, that carbon had been ordered to correct the taste of the water. Upon motion, made by Mr. Bain and seconded by Mr. ~illiams, the Director of Finance was authorized to defer the sale to the Commonwealth of 19~' delinquent lands until ~pril, 1954. Report was received from Mr. ~E. H. Bain, Chairman of the proposed lake committee, on a site in Fluvanna County on Cunningham Creek and after some discussion, the following resolution, offered by- Mr. Bain and seconded by Mr. Smith, was unanimously adopted: 1, UHE~$, this Board has been advised that the. Commission of Game and Inland Fisheries has under consideration a proposal to construct a lake in this area, and; WHER~LAS, this Board has investigated possible lake sites in this area, and it is the considered opinion of this Board that the best available site for a lake is on Cunningham Creek, Fluvar~ua County, Virginia. NOW, THF~ORE, BE IT RESOLVED by the Board of County Supervisors of Albemarle County, that it recommends and urges the Commission of Game and Inland Fisheries to select the site on Cunni~ham Creek in Fluvanna County as the loca- tion for the proposed lake. BE IT FURTHE~ RESOLVED that a copy of this resolution be delivered to the Commission of Game and Inland Fisher&~s. The matter of county dumps was discussed. Upon motion, made by Mr. Smith and second?d by Mr. Bain, it was ~rdered the ninety days written notice be fowarded to Mr. Marvin E. Neast for the termina- tion of lease of his property formerly used for a County dump on Route 250 west, Upon motion, made by ~r. Bain and seconded by Mr. Williams, execution of a lease was authorized for property on Route 689 between Route 250 and Batesville belonging to Mary Burton and the Chairman was authorized to sign said lease, the terms to be the same as those in the Weast lease. An offer of $100.00 was received from Mrs. Reva Marshall for the Hawthorne Fitzgerald property recently purchased by the County for delinquent taxes. Mr. McCue stated that he would view this proper- ty with Mr. Clark and the matter was tabled until the next regular meeting of the Board. Communication was received from the County Planning Commission advising that the terms of Mrs. Fred Liady, Dr. McLemore Birdsong and ~lr. William Stevens on said Commission would expire on December 31 1953. Upon motion, made by Mr. Williams and seconded by Mr. Bain these members were reappointed for a term of three years. The following resolution was also received from the Planning Commission: ~ "BE IT RESOLVED that the present act of the General Assembly to require a referendum on Zoning in Albemarle County is contrary to the principle established when the County Executive form of Government w~s approved gi~ing the Board of Super~ visors the authority ~f governing all phases of County Government. Therefore, the Board of Supervisors are requested to ask our representatives in the General Assembly to work for the repeal of the present law requiring a referendum on zoning in Albe- marle County." This matter was discussed and upon motion, made by?~Mr. Williams and seconded by Mr. Bain, it was ordered that the Board meet with the Planning Commission to discuss this matter. T~he matter of the general reassessment for 1954 was again brought before the Board and upon motion, made by Mr. Bain and seconded by Mr. Uilliams, it was ordered that Mr. Forberg of the State De- partment of Taxation be informed that the County would have a complete reassessment. A request was received from the Church of Christ to continue the use of the Trial Justice Cour~ Room through the winter months for their Sunday morning worship services since said Church still did not have a church of its own although property had been purchased and plans drawn for same. Upon motion, made by Mr. Bain and seconded by Mr. Smith, it was ordered that the Church of Christ be granted permis- sion to continue to use the Trial Justice Court Room through April 4, 1953. Communication was received from Mr. Luther G. Wertz offering to sell to the County his proper~ on Fourth Street, N.E., adjoining the County Jail, for $7,800.00, stating that Mr. Robinson had been interested in this property for the County. Upon motion, made by ~r. Williams and seconde~ by ~r. Harris it was ordered that ~-r. Wertz be advised that the County was not interested in purchasing this property. Mr. Williams reported that the lowest bid on grading the area in front of the old County Shop was received from L. C. Chishol~ and Sons in the amo~ut of $1,320.00 and he rece~mended that the County proceed with this work in order that the shop might be rented as soon as possible. Upon motion, made by Mr. ~illiams and seconded by~Mr. Harris, this contract was awarded to Mr. Chi~.ho!m. Several communications were received expressing appreciation for the picnic supper at the Locai Government Officials' Conference. Claim against the Dog Tax Fund was received from Er. C. E. Eddy for seventeen sheep killed by dogs. Upon motion, made by~r. Bain and seconded by Mr. Harris, Mr. Eddy was allowed $19.00 for each of these sheep. Claim against the Dog Tax Fund was received from Mr. James B. NUrray for one ewe killed by dogs. ~pon motion, made by Nr. Harris and seconded by Nr. Bain, Mr, Murray was allowed $16.00 for this ewe. Claim against the Dog Tax Fund was received from Mr. Robert Crile for three turkeys killed by dogs. Upon motion, made by Mr. Harris and seconded by Mr. Bain, Mr. Crile was allowed $0.40 per pound for these turkeys which averaged 8~ lbs. on two and 6 lbs. on the ~ther. Claim against the Dog Tax Fund was received from Nr. J. S. Barney for nineteen turkeys averag~ 2½lbs. killed by dogs. Upon motion, made by Mr. Bain and seconded by Mr. Harris, Mr. Barney was allow~ $1.20 for each of these t~keys. Claim against the Dog Tax Fund was received from Mr. J. S. Barney for forty-six turkeys avera~ ing 3~ 2 lbs. killed by dogs. Upon motion~ made by Mr. Bain and seconded by ~r. Harris, Mr. Barney was allowed $1.50 for eac~ of these turkeys. Claim against the Dog Tax Fund was received from ~r. J. T. Via for two ewes killSd by dogs. Upon motion, made by Nr. Harris and seconded by Mr. Wood, Mr. Via was allowed $12.50 for each of these ewes. Claim against the Dog Tax Fund was received from Nr. W. F. Via for one ~we killed by dogs. Upon motion, made by Mr. Harris and seconded by Mr. Wood, Mr. Via was allowed $16.00 for this ewe. Claim against the Bog Tax Fund was received from Mr. Jack Clark for five ewes killed by dogs. Upon motion, made by Mr. Wood and seconded by Mr. Harris, Mr. Clark was allow6d $17.00 for each of these ewes. Mr. Bain advised that he had been approached by a p!nmbing contractor in the county who re- quested an ordinance governing plumbing contractors in the comuty. The Commonwealth's Attorney was re- quested to investigate this matter. Upon motion, made by Mr. Bain and seconded by Nr. Wood, it was ordered that a resolution be drawn requesting two representatives from each congressional district on the ~eague of Virginia Counties Executive Board. Communication was received from Mr. Russell Bargamin requesting ~ata on the Crozet Sanitary District. '~The Clerk was instructed to write Mr. Barga~in ~dvising that all information of record was open and available. Upon motion, made byMr. Bain and seconded by Mr. Smith, the following resolution was ~nani- mously adOPted: BE iT RESOEVED by the Board of County Supervisors of Albemarle County, Virginia, that $1,500.00 or as much thereof as necessary be transferred from the Unappropriated reserve of the General F~nd for purchase of automobiles in the Sheriff's Office. We, the undersigned, members of the Board of County SupervisOrs of Albemarle County, Virginia, hereby waive notice, and special service thereof, of a meeting to be held at 8:30 A.M. on the twenty-sixth day of October, 1953, in the County Office Building, Charlottesville, Virginia, for the purpose of considerLug and acting upon matters per- taining to the prevention of forest fires'~.due to the drought and also pertaining to the water supply in the Crozet Sanitary District, and we do hereby consent to the transaction of any and all business and the taking of such action at said meetiug upon the matters hereinabove mentioned as may be lawful, incident and necessary thereto. Blai~ Mr. Dallas Wilfong and Mr. Julian Thomas. The meeting opened with the Lord's Prayer led by Mr. E. H. Bain. Capt. Blai~ requested that the Board declare state of emergency regarding fire hazard amd re- quested the Board to ask the Governor to dec~&re state of emergency. Mr. Wilfong stated that he would like th~ Board to do anything possible to prevent forest fires. After considerable discussion, the following proclamation was adopted: PROCLA~TiON: "The Board of Supervisors of Albemarle County is gravely concerned with the danger to forest and woodlands from fire, especially at this time of almost unprecedented drought. The woods are tinder dry and any fire can very easily grow into most serious proportions. The State Forest Service is doing all it can possibly do to prevent forest fires. Our local forest wardens are also alert to the menace and are doing their utmost to extinguish all fires that are out of control. A further effort is re~ quired to reduce this danger.
