1953-12-16N A regular meeting of the Board of Co~mty Supervisors of Albemarle County, Virginia, was held at the Office Building of said County on the 16th day of December, 1953. Present: Messrs. C. Purcell McCue, E. H. Bain, H. Ashby Harris, Edward L.. Smith, John W. Wi!lis~s. Absent: Mr. W. W. Wood. Officers present: County Executive and Commonwea!th~s Attorney. Minutes of the meetings of November 18 and December I were read and minutes of November 18 were ordered corrected. ~v~. M. M. Pence, Director of Finance, submitted a Statement of E~penses of the Department of Finance for the month of November, 1953, one third of which to be borne by the State. Upon motion, duly made and seconded, this Statement was examined, verified and approved. ~JIr. M. M. Pence, Director of Finance~ submitted a Statement of Expenses of the Sheriff's Office for the month of November, 1953, two-thirds of which to be borne by the State. Upon motion, duly made'and seconded, this Statement was examined, verified and approved. Mr. M. M. Pence, Director of Finance~ submitted a Statement of Expenses of the Commonwealth Attorney's. Office for the month of November, 1953, one~hal~ of which to be borne by the State. Upon motion, duly made an5. seconded, this Statement was examined, verified and approved. Statement of Expenses incurred in the maintenance of the county jail along with summar~ statement of prisoner dayw was submitted. Upon motion~ d~J_y made and seconded, these statements were examined, verified and approved. Claim of Dr. Richard T. Ergenbright, Jail Physician, in the amount of $16o00, was presented, and upon motion of ~r. Bain, seconded by Nr. Williams, was approved for payment. Reports of the Department of Public Welfare for the month of November, 1953, were presented in accordance with Section 371 of the 1950 Acts of the General Assembly and on motion of. Mr. Bain seconded by Mr. Williams, were approved and accepted. ClaLm of the University of Virginia Hospital in the amount of ~l,l$O.20 of which one-half i~ due by the Cbunty, was presented and approved for payment on motion of Mr. Bain, seconded by Nr. Smith. Report of the County Executive for the month of November, 1953, was presented and upon motioni! of Mr. Williams, seconded by Mr. Harris, was approved and ordered filed. The County Executive reported that the Burton property which the Board had authorized to be leased for a CountyD~p had been sold. He further advised that Mr. Clark and Mr. Shields would inves. tigate another tract on Miller School Road near Stockton Creek v£nich had been recommended by the Crozet Lions Club. The method of the General Reassessment for 195~ was discussed at length. Mr. J~ R. ~Vingfield appeared in opposition to having this work done by experts from the State Department of Taxation. Upon advice from the Commonwealth's Attorney and upon an opinion from the Attorney General, the followi were appointed to serve as a Board of Assessors on motion of Mr. Williams, seconded by Mr. Harris: Mr. A. Gaines Fray~ ~r. Hugh Clark and Mr. F. L. Clark. Mr. Bain offered a motion to adopt the recom~ men8ation of the County Executive to use present day values in making this re~ssessment. Mr. Rain's motion received no second. Mr. 7filliams offered a motion to use 19g~ values as a basis for the reasses merit which motion was ~econded by Mr. Harris. This motion carried by the following vote - Ayes: ~r. Harris, Nfo Smith, and Mr. Williams. Noes: Mr. Bain. ~ro Pence advised the Board that the parking lot in front of the Old Repair Shop would cost ~6~.8~ in additio~%o the original amount approved by the Board. Up6n motion, made by Mr. Williams and seconded by Mr. Harris, the following resolution was unanimously adopted: BE IT RESOLVED by the Board of Co~mty Supervisors of Albemarle County, Virginia, that $~E.$~ be and is hereby appropriated from Unappropriated Reserve ~g PetitiOn was received requesting hS~"surfacing o£ two'miles of road' beginning at the inter- m~S~ectioll known as "Cash Corner". onRoute 231 from Cismont to Gerdonsville~and 'ending at intersection at Cobham on Rout~ 22. Mr. Laurence Boocock and Col.. Clark Lawrence also appeared on behalf of the citize~ signing said petition. ~ Upon motion, .made'~by Mr. Bain and seconded by Mr. Harris, it was ordered that this petition be referred to the Highway ~Be~a~tment for action as soon as possible. Mr. Randolph Perry~ and a group representing the Monticello Guards appeared and requested an appropriation of $3,000.00 to match a like appropriation from the City of Charlottesville for the purcha of colonial uniforms for the Guards. Upon motion, this matter was taken under advisement and the Com- monwealth's Attorney was instructed to investig~te~the matter of appropriatinECoumty funds-for this purpose. Mr. Samuel S. Clark approached the Board regarding-the closing of a portion of Route 656 through the Bell property which had been abandoned due to the Relocation of this road at the new high school. Upon motion, made by-Mr.~ Bain and seconded by Mr.~ Harris, this matter was tabled until the next meeting of the Board. Mrs. Ruth B~u-~uss Huff appeared-and advised the Board that when Miss Roller was employed as Asst. Home Demonstration Agent, the County reduced its appropriation from $1320.00 to $1200.00 per annum and requested that, in v~ew of the fact that the County was not requested to raise its appropriation while Miss Roller was employed in this position, the County leave its appropriation for ~e new Asst. Agent at $1200.00. Upon motion, made by Mr. Williams;and seconded by Mr, Harris, it was ordered that the County's appropriatiom-toward the salary of the Asst. Home Demonstration Agent remain at $1200.00. The County E~ee~tive reported that the League of Virginia Counties would hold its twentieth anniversary next year and stated that since the League was organized here and since the County is a charter member, ~he felt they shoUld be inVited to hold the 1954 convention ~u Charlottesville. Upon motion, made by'Mr. Bain and seconded by Mr. Smith, it was ordered that an i~vitation be extended to the League to hold its 1954 convention here and Mr. Pence was directed to take care of the details in this connection. The County Executive reported that he and Mr. Smith had viewed the property cn which the County receiVsd an offer from N.r. Godwin but that there was some question as to whether or not they had viewed the right tract. He reported' further that they would investigate this matter and report back to the Board. Mr.~ P~nce~advlsed the BOard that in transferring a tract of~ land from Mr. W. F. Starke, the ~W~t~ing thereon had been assessed twice. Upon motion, made by Mr. Smith and seconded by Mr. Harris, the following resolution was ~nanimously adopted: BE IT RESODVED by the Beard of County Supervisors of Albemarle Count2-, Virginia, that $36.75 be and is hereby transferred from Unappropriated Reserve of the General Fund to Tax Refunds to cover refund to Mr. W. F. Starke for taxes errenously assessed on buildings on this property. M~. Pence reported to the Board that the Compensation Board had not allowed any mileage for the Sheriff's Office for the year 1954 and was ~authorized te go to Richmond to investigate this ~matter. ~ Mr. ~Pence advised the Board that he had employed ,Mrs. Betty N~lstead as extra help through the tax rush as $140.00 per month and requested permission to continue her employment through the reassess- merit at $150.~0 per month, effective January 1, 1954. Upon motion, Mr. Pence's request was approved. The Board met with assessors and members of a committee appointed at the last meeting of the Board,~ to discuss values of livestock for assessment pmrpeses for the coming year. After a lengthy dis- cussion of this matter and after receiving recomm~e~dations from this committee, the following resolution~ offer~ by Mr. Bain and seconded by Mr. Williams, was unanimoUSly adopted and Mr. Pemce wa~ l~structed to give a copy of this letter along w~th a letter of instructions to each assessor: ~e BE IT RESOLVED by the Bo~rd of County~Supervisors of Albemarle County, Virginia, that the following be~the policy for the assessment of~taxable property for the.year 1R54:~ 1. BE IT FURTHER RESOLVED that the assessors be and are hereb~ instructed to use their discretion in raising and N~wering assessments using the let,going only as a yardstick. BE IT FURTH~ RESOLVED that the recommendations of the Commenwea!th's At- terney to lay a separate levy on each category of personal property also be followed. Mr. Williams recommended that the Chairman appoint a committee to meet with Mr. Compten and Mr. McCue regarding passage of legislation which would classify household furniture and automobiles in separate oatagories.. ~$e ~hai~an appointed Mr. Williams, Mr. Dovmi~g Smith and Mr. Pence to serve on this committee and instructed Mr, Pence to make arrangements for the meeting of this committee with e the representatives. Upon motion, made by Mr. Bain and seconded by Mr. Williams, Mr. Pence was authorized to remov the restrictions placed on the use of water in the Crozet Sanitary District as imposed by resolution of 272 Claims against the County amounting te $304,037.78 were presented, examined and allowed and certified to the Director of Finance for payment, and charged against the following funds: General Fund School Fund Crozet Fire District Fund Crozet Sanitary District Fund Dog Tax Fund Joint Health F~ud Albemarle Central High School Constr. C. Purcell McCue, E. H. Bain, H. Ashby Harris, Edward E. Smithe JAbsent: Messrs. John W. Williams and W. W. Wood. 'Officers present: County Executive and Commonwealth's Attorney. Mr. E. C. Compton, Stat~ Legislator, was also present. The meeting opened with the Lord's Prayer led by Mr. E. Ho Bain. The Sheriff serv~ Process on the Board in session relative to suit instituted against the and taxpayers Board by certain citizensl/of ~he Cr0zet Sanitary District. Mr. Downing Smith, Commonwealth's Attorney, discussed with the Board said suit and recommended the employment of Mr. T. J. Michie as additional council in this case. Mr. Michie appeared before the Board and discussed this matter. Upon motion, made by Mr. Harris and seconded by Mr. Smith, it was ordered that council-be employed to assist the Commonwealth's Attorney in the suit regarding the Crozet Water System. Upon motion, made by Mrl Bain and seconded by Mr. Smith, ~Wa~ 6rdered that the County retain Mr. T. ~. Michie to assist the Com- monwealth's Attorney. Legislative-matters were discussed at length with Mr. E. C. Compton. Upon motion~ made by Mr. Smith and seconded by Mr. Bain, the following resolution was unani- mously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that representatives of this district in the General Assembly be requested to support and urge the passage of certain legislation as recommended by the League of Virginia Counties, namely: (1) That the monies new paid into the State Treasury by the Clerk's Office be paid to the general fund of the localities. (2) That the State of Virginia be required to participate to the exten~ to ~0% of the cost of the operation of the Commissioner of'Revenue's Office a~d the-Of- lice of the Treasurer, which cost shall include'~h~ cost of office space. (3) That the Board of Supervisors, by resolution duly adopted, should be entitled to opinions from the-office of the Attorney General. (4) That a general sales tax at wholesale ~e~el be adopted by the General Assembly with the entire revenue derived therefrom to be distributed to the localities on an equi%able basis and to abolish the personal property tax.
