1954-06-29 ~pon motion by Mr. Bain, seconded by Mr. Smith, the meeting adjourned until Tuesday, June 29, 1954, at 7:30 o'clock P.M, Chairman An adjo~rned meeting of the Board of County S~pervisors of Albemarle County, Virginia, was held at ~:30 P.M. on Tuesday, June 29, 1954, in the County Office Building,~ Charlottesville, Virginia, with the following members present: Messrs. C. P~rcell McCue, E. H. Bain, H. Ashby Harris, Edward L. Smith, John W. Williams and W. W. Weed. Absent: None. Officers present: County Executive and CommOnwealth's Attorney. The meeting opened with the Lord's Prayer le~ by Mr. E. H. Bain. Mr. Nms~ offered for adoption the ordinance regarding vaccination of dogs against rabies as approved and recommended by the joint committee of this Board and the City Council, motion to adopt be- ing seconded by Mr. Bain. After considerable discussion, motion was made by Mr. Williams, seconded by Mr. Bain, and unanimously carried, adopting the following Ordinance:' AN ORDINANCE Requiring that all dogs in the County of Albemarle, Virginia, four (4) months and over, be mn-l! oc~lated or vaccinated against rabies; requiring the owner of any such dog, or his agent, to have such dog inoculated or vaccinated against rabies; prohibiting the issuance of license tags for the dogs in the County of Albemarle unless satisfactory evidence.be furnished the Directo~ of Finance of said County that such dogs have been inoculated or vaccinated against rabies, and empowering the health officer to confine animals having bitten a person or exposed to r~bies; providing penalty for the violation of any of the provisions of this Ordinance. authority of Sections 29-195, 29-196 and 29-1~8.1 of the Code of Virginia 1950, the Boa~ Under of Smpervisors of ~h~County of Albemarle, Virginia, doth ordain as fellows: SECTION 1. On and after September l, 1954, no dog ever four (4) months old shall be permitted within the boundaries of Albemarle County, unless such dog shall have been vaccinated or immunized against rabies within a period of thirty-six (36) months with a chicken em~yo (-Flury Strai~ ~abie~ vaccine. It shall be unlawf~l for any owner or hie agent to allow a dog to run at large in the Coun- tyefAlbemarle at any time without a collar and tag evidencing latest vaccination. The Health Officer for Albemarle County is empowered to order the owner or person responsi- ble for any anim~l suspected of having rabies or of hav&ug been in close proximity of a rabid animal to confine such animal under competent observation at the expense of the owner for a period reasonably necessary to determine whether the animal is actually infected with rabies. At the discretion of the Health Officer for Albemarle County, any animal which has bitten a person shall be confined at the expense of the owner ~nder competent observation for ten days ~nless the animal develops active symptoms of rabies. This Ordinance shall not apply to any dogs temporarily brought into the County for a period not to exceed thirty (30) days, for showing or breeding purposes, said dogs to remain con- fined at all times. Any person wh° fails to comply with or violates any of the terms of this Ordinance shall be punished by a fine of not less than Five ($5.00) Dollars nor more than Three Hundred ($300.00) Dollars, each violation and each day's continuance thereof shall constitute a separate of- fense. This Ordinance shall be effective September 1, 1954. Mr. M. M. Pence advised the Board that the auditors had inquired as to whether or not the Board wished the Joint Health Fund and Airport Committee Fund to be ~audit and recommended that this be done. On motion of Mr. Bain, seconded byMr. ~"earried, it was ordered that the Joint Health Fund and the Joint Airport be audited along with the regular County audit. Mr. Pence also advised the Board that he would call a special meeting within the next few days in order that the Board might adopt the Appropriation Ordinance for the year 1954-55. The Commonwealth's Attorney advised that the regular July meeting w~uld be acceptable for the passage of said Ordinance. Upon motion, the meeting adjourned. Chairman
