1954-11-09Absent: November 9, 1954 Pursuant te the following waiver, the members of the Board of County Supervisors of Albemarle County, Virginia, met in special session on this date in the County Office Building at 9:00 A.M. with the following members present: Messrso H. Ashby Harris, E. H. Bain, Edward L. Smith and John W. William Mr. C. P~rcell McCue and Mr. W. Warre~ Wood. We, the ~ndersigned, members of the Board of County Supervisors of Albemarle County, Virginia, hereby waive notice and special service thereof, of a meeting to be held on the ninth day of November, 1954, at 9:00 A.M., in the County Office Building, Charlottesville, Virginia, for the purpose of amending resolution adopted by this Beard on June 23, 1954, regarding authorization of issuance of one hundred thousand dollars of Crozet Sanitary District Bonds, said amendment to include the National Bank and Trust Company in addition to the office of the Director .of Finance for pay- meat of said bonds; and we do hereby consent to the transaction of any and all busi- ness and the taking of such action at said meeting upon the matter hereinabove mentioned as may be lawful, incident and necessary thereto. WHEREAS, the Board of County Supervisors of Albemarle County adopted a reso- lution on June 23, 1954, entitled, "A RESOLUTION AUTHORIZING THE ISSUANCE OF ONE HUNDRED THOUSAND DOLLARS ($100,000.00) OF BONDS OF THE CROZET SANITARY DISTRICT OF ALBEMART2 COUNTY, VIRGINIA, TO BE KNOWNAS WATER SUPPLY BONDS"; and, WHEREAS, the Board of County Supervisors desires to a~mend said resolution of June 23, 1954, by adding to the description of said Bonds "SERIES OF 1954", and to provide that said bends and interest thereon shall be made payable '"at the Nationald Bank and Trust Company, Charlottesville, Virginia", in addition to the office of the Director of Finance of Albemarle County. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Supervisors of Albe- marle County, Virginia, that said resolution of June 23, 1954, be ammended to read as follows: A RESOLUTION AUTHORIZING THE ISSUENCE OF ONE HUNDRED THOUSAND DOLLARS ($100,000.00) OF BONDS OF TEE CROZET SANITARY DISTRICT OF ALBEMARLE COUNTY, VIRGINIA, TO BE KNOWN AS WATER SUPPLY BON~S, SERIES OF 1954. WHEREAS, the issuance of net to exceed Two Hundred and Fifty Thousand Dollars ($250,000.00) of bonds of The Crozet Sanitary District of the COunty of Albemarle for the construction of a water supply system in The Crozet Sanitary District, has been approved by a resolution adopted by The Board of Countyi Supervisors of the County of Albemarle, Virginia, on the l~th day of September, 1946, and spread in Minute Book 3, p. 159, and approved by the voters of The Crozet Sanitary District at an election held for that p~pose on November 5th, 1946, in accordance with the previsions of Chapter 126 of the Acts of Assembly of Virginia of 1946; and, WHEREAS, THE Board of Coun%y Supervisors has heretofore issued One Hundred~and Fifty Thousand Dollars ($150,000.00) of said bends on February 13, 1947, pursuant to a resolution adopted by said Board NOW, THEREFOP~E, BE IT RESOLVED by The Board of County Supervisors of Albemarle County.- 1. This bond is issued by The Crozet Sanitary District of Albemarle County under and by virtue of, and in full conformity with and pursuant to a rexolution of The Board of County Supervisors of Albe- marle County, Virginia, adopted September 18th, 1946, and spread in Minute Book 3, P. 159, and approved by the voters of The Crozet Sanitary District at an election held for that purpose on November 5th, 1946, in accordance with the provisions of Chapter' 126 of the Acts of Assembly of Virginia of 1950, as amended. It is hereby certified that all of the requirements of law have been fully complied with by the proper officers in issuing this bond and that the total amount of this bond and of the issue of which it forms a part does not exceed the debt limit prescribed by the Constitution or Statutes of the State of zrgmnma. That the Directo~ of Finance of the County of Albemarle be and he is hereby authorized to publish a notice of sale of said bonds and to prepare and dispose of the issue as a wh~le or in in- stallments, at par or more, any sale to be ratified and approved by The Board of County Supervisors. 5. That the proceeds of this entire issue of said bonds shall be used excl~sively for con- strutting a water supply system for The Crozet Sanitary District of the County of Albemarle, and the entire Proceeds of the sale of said bonds shall be placed to the credit of the Director of Finance of t~e said County of Albemarle, who shall .disburse the same upon proper warrants for the ~mrposes afore- said. 6. It is hereby determined that said $100,O00.O0.water supply bonds shall not be included in the 18% debt limitation prescribed by Section 1 of said Chapter 126, but whenever and for so long as the water supply system of said District fails to produce s~fficient revenue to pay for cost of opera- tion amd administration (including interest on the bonds issued therefor) and the cost of insurance against loss by injury to ~ersons or property, and an annual amount to be covered into a sinking fund sufficient to pay, at or before maturity, all bonds issued on account of said system, all such bonds outstanding shall be included in determining such limitation. While the said bonds or any of them shall remain outstanding or unpaid, there shall be ievied and collected from the users of water from said system a water rate sufficient to provide for the paymen' of the principal and interest as the same becomes due and payabt~; and the.net revenue derived from the operation of said water supply system shatt~be:~.~s~t~asi~to pay the interest on said bonds and to create a sinking fund to redeem principal thereof at maturity; provided, however, that any part, or all of said sinking fund, as hereafter determined by this Board, may be applied to the purchase of any of such bonds at any time, and provided f~ther that this Board shall, if necessary for the payment of the interest on su~b bonds, or to increase the sin~ing fund provided therefor, levy an annual tax upon all the property in The Crozet Sanitary District subject to local taxation to pay such interest and to make payments into said sinking fuud. 7. This resolution shall take effect immediately. 'Upon motion, the meeting adjourned. A regular meeting of the Board of County Supervisors of Albemarle County, Virginia, was held at the Office Building of said County on the 17th day of November, 1954. Present: Messrs. H. The meeting opened with the Lord's Prayer led by Mr. E. H. Bain. Minutes of the meetings of .i 'October 20, 1954 and No$ember 9, 1954, were read and approved. Mr. W. W. Shields, Resident Highway ~ngineer, presented to the Board the revised Secondary Budge~ for the year ending June 30, 1955. On motion of Mr. Bairn, seconded by Mr. Wood, the following resolution was unanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the Final Secondary Budget for the year ending June 30, 1955, as presented by Mr. W. W. Shields, Resident Engineer, be and is hereby approved in the following amounts: Ordinary Maintenance Maintenance Replacements Construction $252,765.71 35,313o00 52 .~09.00 Total $340,487.71 The matter of roads at the Joint Airport was discussed and the following resolution was re- ceived from the Joint Airport Committee: "BE IT RESOLVED by the Charlottesville-Albemarle Joint Airport Committee that the Board of County Supervisors in considering the abandonments and additions to the Secondary System of roads at the Airport, be requested to set forth in their resolution that old Route #743 from a point 1~04 miles southeast of Route #660 and continuing generally eastward for a distance of approximatb~y .56 miles to its in- tersection with old Route #606 at a point approximately .20 miles south of its in- tersection with old Route #649 be removed from the Secondary System, however, in so doing that no action be ,taken to abandon right-of-way over which this p~rtion of old Route ~Y43 traverses since it appears desirable to retain such right-of-way for access to the Airport property." Mr. Wood, the following resolution was unanimously adopted. WHEREAS, a section of road in the Secondary System located at the site of the Charlottesville-Albemarle Airport has been altered and a new road, which serves the same citizens as the old road, has been constructed~in lieu thereof and approved by the State Highway Commissioner by letter dated October 21, 1954 to the Board of County Supervisors of Albemarle County; and WHERF_~S section 33-76.12 of the Code of Virginia provides for the abandon- merit of such alteration in fha Secondary Road System, NOW~ THEREFORE, BE~ITRESOLVED by the Board of County Supervisors of Albe- marle County that said old road be and the same is hereby abandoned as follows: (1) That section of Route 606 from the northeastern end of Airport, 3.25 miles south of Route 763 to its intersection with old-Route 743~ a distance of 0.75 of a mile. / This matter was discussed with.
