1943-09-07SPECIAL1 SEPTemBER 7~ 1943 Pursuant to the following call and waiver of notice, a special meeting of the Board of County Supervisors of Albemarle County, Virginia~ was held on this day with the following members present~ Messrs. E. J. Ballard, P. H. Gentry, H. Ashby Harris~ and C. Purcell NcCue, and Dr. L. G. Roberts: CALL AND WAIVER OF NOTICE OF SPECIAL MEETING OF BOARD OF COUNTY SUPERVISORS OF AI~E~ARLE COL~TY~ We the undersigned, being all of the members of the Board of County Supervisors of Albemarle County~ do hereby call a special meeting of said Board to be held in the Board of Supervisor's Room of the County Office Building, Charlottesville, Virginia on q\~esday, September 7th~ 1943 at l0 o~clock A~M.~ for the purpose of considering an ordinance or regulation to prevent the soread of rabies in said County~ and we hereby waive any and all requirements of law pertaining to the notice of said meeting~ (Signed) J. S~ Englar, Health Officer, recommended that an Ordinance be adopted pro~ hibiting the running at lodge df dogs for a period of forty-five days to assist in the con~ trolling of rabies which existed in the County at this time. Mr~ E. V. Walker, Commonwealth's Attorney, advised the Board that it was his opinion that the Board had the right to adopt such an Ordinance. Dr. L~ G. Roberts offered the following Ordinance which was seconded by Mr. C. Purcell NcCue, and unanimously adopted. AN OP~INANCE PROHIBITING THE RUNNING OF DOGS AT LODGE WITHIN THE BOUNDARIE~ OFALBEM~RLE C~[NTY, VIRGINIA~ BE IT ORDAINED by the Board of County Supervisors of Albemarle 'County, Virginia~ as follows, to-wit: It shall be unlawful to permit the funning at large within the bounaar~s of Albemarle County, ~irginia, of any dog, and all persons owning, having control of or harboring any dog or ~ogs within the County of Albemarle, Virginia, shall be, and are hereby required to keep the same confined to their premises, so as not to come in con~ tact with any person or animal, unless said dog or dogs be in the custody of the owner or his agent and fastened to a leash. It shktl be unlawful and constitute a m~sdemeanor ~or any person to violate or permit the violation of the p~ovisions of this ordinance and every person convicted of a violation of any of the provisions of this ordinance shall be punished by a fine of not less than $10.00, nor more than $~00.00, by imprisonment in Jail for not less than one, nor more than thirty da~ or by both such fine and imprisonment. BE I~ FURTHER ORDAINED, that an emergency exists~ and this ordinance is hereby made effective immediately~ to-wit: On Septem~ her 7th~ 19~5, and shall remain in effect for a period of forty-five (45) days from said date, unless sooner repealed by the Board. The County Executive was authorized to ma~e such arrangements as possible to provide for the confiMame~ of ~ogs when necessary. Upon motion~ the meeting was adjourned~
