1948-10-20A regular meeting of the Board of County Supervisors of Albemarle County, Virginia, was held at the Office Building of said County on the 20th day of October, 1948. Present: Messrs. C. Purcell MCCue, E. J. Ballard, Henry Chiles, C. R. Dorrier, and General Peyton. Absent: W.W. Wood. Officers Present: County ExecUtive, Commonwealth's Attorney. Minutes of the meeting of September 15, 1948, were read and approved. Mrs. Minis Mahanes appeared before the Board inquiring as to the status of her rev quest to have taken into the Secondary System twomtenths of a mile of Route 610. Mrs. Mahane~ was advised that this road was viewed on August 23, 1948, and rejected because it does not serve enough people. On motion, duly made and seconded, the Final State Highway Budget for the fiscal year '48-'49 for Secondary System maintenance, maintenance replacement, and construction was approved as presented by W. W. Shields, Resident Engineer, totaling $502,144.77. This amount includes a carrymover balance from Regular State Funds of $t9,152.77 and a carry-over from Matched Federal Aid of $99,612.00. A copy of 'this Budget was filed with this Board by the Resident Engineer. The following claims against the Dog Fund were presented: a) Claim of Stephen Ludwig~ for twenty-six chickens was presented. Upon L motion, made by M~. Chiles and seconded by Mr. Dorrier, it was ordered that this claim be denied. b) Claim of N. G. Muncy for nine hens and three geese was presented. Upon motion, made by Mr. Ballard snd seconded by Nr. Dorrier, it was ordered that this claim be denied. c) Claim was presented of N. L. Via for three ewes and four lambs. Upon motion, made by Mr. Dorrier and seconded by Mr. Chiles, it was ordered that $10.00 each be paid for the ewes and the lambs of ninety pounds @ $ .22 per pound. d) Claim was presented of Odie ~. Johnson for one sheep and five lambs. Upon motion, made by Mr~ Dorrier and seconded by ~r. Chiles, it was order- ed that the assessed value of $12 be paid for the sheep and the lambs , one weighing one hundred pounds and four weighing thirty pounds @ $..22 per pound, e) Claim of Mrs. H. N. Foster was presented for eighty nine chickens and one turkey. Upon motion, made by Mr. Dorrier and seconded by Mr. Chiles, it was ordered that this claim be paid as follows: 12 chickens weighing ~ pound to one pound @ 30¢ each; 52 chickens weighing one to two po,muds @ 50¢ each; 5 chickens Weighing ~wo pounds @ 75~each; 15 chickens weighing 2~2 to 3 pounds @ 75~ each; 5 chickens weighing three and one-half pounds @ $1.00 each; I turkey a~he assessed value of 25~. Mr. B. D. Cnesshmr appeared before the Board and tendered his resignation to be effective December l, 1948. Upon motion, made by General Peyton and seconded byMr. Ballard the following resolution was unanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the resignation tendered by B. D. Chesshir as Game Warden be accepted, same to be effective October ~l, 1948, and that he deliver forthwith to the County Executive car and equipment belonging to the County heretofore used by him. Mr. L. D. Randolph and Mr. E. H. Bain appeared before the Board as representatives of the Albemarle County Planning Commission requesting the Board to appropriate funds necessa~ ry for 'the printing and ~istributing of a pamphlet on zoning in Albemarle County. They also requested funds to cover the fee of an attorney to prepare the ordinance of the Planning Commission. The report of the County ~Executive was presented, approved and ordered filed. ~r. D. A. Robinson, Director of Finance, submitted a Statement of Expenses of the Department of Finance for the month of September, 1948, one-third of which to be borne by the State. Upon motion, duly made and seconded, this Statement was examined, verified, and Sheriff's office for the month of September, 1948, two~thirds of which to be borne by the State. Upon motion, duly made and seconded, this Statement was examined, verified, and approved. Mr. D. A. Robinson, Director of Finance, submitted a Statement of Expenses of the Commonwealth's Attorney's office for the month of September, 1948, one-half of which to be borne by the State. Npon motion, duly made and seconded, this Statement was examined, verified and approved. A Statement of Expenses incurred in the maintenance of prisoners confined inthe County Jail during the month of September, 1948, was submitted. Upon motion, duly made and seconded, this Statement was examined, verified, and approved. A Summary Statement of prisoner days was submitted. Upon motion, duly made and seconded, this Statement was examined, verified, and approved. In commenting on prisoner days and the expense incurred in the maintenance of prisoners The County Execative pointed out that of a total prisoner d~ys f~er the month of September of 489, only'll represented county prisoners and he also stated that though the State is paying a portion of the prisoner costs on a per diem basis the cost to the County for its prisoners is at a very high per diem cost due namely to the fact that many of the jail costs the State is not participating in. Claim of Dr. Richard~TJ Ergenbright, Jail Physician, amounting to $3.75, was presented and approved for payment. Dr. S. D. Sturkie, Director of Joint Health Department recommended to the Board a revision of the budget of the Joint Health Department for the fiscal year~ ending June 30, 1949 as follows: 21-102.1 - Medical Assistance Part Time 21-109.1 - Salary Part-Time Secretary 21-405 - Equipment 21-199 - Night V. D. Clinic 21-327 - Biologicals 295.25 310.00 300.90 600.00 306.15 Upon motion, duly made and seconded, the above requested revisions were approved. Upon motion, made by General Peyton and seconded by Mro Dottier, it was ordered that the Haalth Officer of the Joint Health Department make an inspection of all tourist and trailer camps in Albemarle County to check water supply and sewage disposal. Upon motion, duly made and seconded, Et was ordered that the following. assignment of agreement be executed and spread upon the minutes of the Board: ASSIGNMENT OF AGREEmeNT FOR VALUE RECEIVED, Crozet Lumber Company, Inc., hereby trans- fers and assigns to the Crozet Sanitary District of County Albemarle, title and interest in and to that certain agreement, dated July 23, 1932, between The Chesapeake and Ohio Railway Company and Crozet Lumber Company, Inc., covering a 4" wrot iron water pipe line crossing located 1928 feet east ef ~iile Post 195, Mountain Sub-Division, Albemarle, County, 'Virginia. General Attorney Communication was received from the clerk of the City Council stating that the following committee had been appointed to work w~th a committee from the Board of County Supervisors on the matter of Lake Albemarle: Mr. S. F. Hamm, Mr. J. 2. Barr, III, Mr. Gus K. Tebell and J. E. Bowen, Jr, City Mana~._ger. Communication was received from the Virginia State Planning Board advising that the Propesty Indentification Maps for this County had been completed. It was the feeling of the Planning Board that unless some arrangement could be made to keep these maps up to date, they would be of Very littt~ Value to us. A proposed SLH Contract with the University of Virginia Hospital for the fiscal year beginning July 1, 1948, was presented providing for care of the County's indigent at a rate of $11.68o On the recommendation of the County's Hospital Committee the proposed contract was approved and ordered executed with the following clause added: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia., that the Contract with the University of Virginia Hospital this day presented to the Board be executed withtthe distinct~ understanding that the County will not be called upon to pay more than $7500.00 for the y~ar beginning July l, 1948, and ending June 30, 1949 and that the University of Virginia Hospital will not refuse to accept indigent patients after this amount has been expended. BE IT FURTHER RESOLVED that Mrs. Anne H. Loving, Superintend- ent of the Department of Public Welfare of Albemarle CoU~uty be and she is hereby designated as the representative of the County to certify indigent patients to the University Hospital for hospitalization and treatment. The District Home Report for the two months ending August 31, 1948, was presented showing a per diem cost of $1,00~inclu~ing $.10 depreciation reserve. The report was approve and the County's §hare of the cost amounting to $677.41 for the period was ordered paid. It was pointed out that the City of Nayneshoro is~making use of the District Home and that at present it has eleven inmates there. This situation has come about as a result of Waynesborc becoming a city. The County Executive stated that he had consulted with the Commonwealth's Attorney and that Mr. Haden, City of Charlottesville Board Member has consulted with the City's Attorney and the legal advisors of these two units had not been able to find anything in the Statutes permitting the City of Waynesboro,s participation in the District Home. The County Executive stated also that at the last District Home Meeting an application was received from the City of Staunton to become a participant in the District Home. These matters were referred to the County E~ec~tive, The Board's representative on the District Home Board, with the request that he work with Mr.. H. A. Haden, City of Charlottesville's representative. A claim was presented from Everett Waddey Company covering a purchase of four deedI by Mr. Chiles, this claim was approved for payment. Notice was received of the Virginia Highway Conference to be held at Virginia Military Institute, Lexington, Virginia, November ll-13, 19~8. Upon motion made by Mr. Dorrier and seconded by General Peyton, it was ordered that a contribution of $1200.O0be made to the Charlottesville and Albemarle Community Chest. A report of the Charlottesville Public Library for the mOnth of September, 1948, was presented, approved, and ordered filed. Mr. Robinson presented an estimate of $10,720.00 from John N. Ross, Contractor, for improvements to the Court House and changes at the County Shop. Mr. Robinson was instructed to secure estimates from several other contractors on this work. Requests for salaries and expenses of the Department of Finance, Sheriff's Office and Commonwealth's Attorney's Office for the calendar year 19&9 were presented and the following resolutions were unanimously adopted: BE ITRESOLVEDby the Board of County Supervisors of Albemarle County, Virginia, that the Salary and Expense Eequest Form for the calen- dar year 1949, as prepared by D. A. Robinson, Director of Finance, for the Department of Finance, be and is hereby approved. BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the Salary and Expense Request Formlfor the calen- dar year 1949, as prepared by J. Mason Smith, Sheriff, for the Sheriff's Office, be and is hereby approved. BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the Salary and Expense Request Form for the calen- dar year 19~9, as prepared by W. O. Fife, Commonwealth's Attorney, for the Office of the Commonwealth's Attorney, be an~ is hereby approved. The matter of ~Gualizing the Deputy Sheriffs' salaries was discussed. Mr. Dorrier was requested to discuss with thee Sheriff the matter of bringing the salary of Mr. T. Whitten, Deputy, up to that being paid other deputies. Communication was received from Fred C. Kimbo and was ordered filed. Mr. Robinson reported calling the Link Company on October 19th regarding the two- way radio system in county cars. They could advise that their last understanding from the Arnold Company was that the antenna was to be moved from the Monticello Hotel Do Carters ~ountain. They agreed to get in touch with the Arnold Company to see what was holding the test survey up. Mr.. Robinson also reported calling Mr. Arnold on the same day and was advised by him that test unit had been installed on truck and that he would make every effort to be here by Monday or _Tuesday of the following week. Mr. Robinson advised the Board that Mr. Bain, ~Lr. Ligon, and he had gone over the outlay of the Crozet Water System and that it would not be necessary to have Wiley and Wilso~ make a blue print of the System. Epon motion, made by Mr. Chiles and seconded by General Peyton, the chairman appointed the following Committee to make a study of the salaries beinE paid to employees: Mr. Chiles, Mr. Dorrier, and General Peyton. Upon motion, made by Mr. Dorrier and seconded by General Peyton, .the Director of Fina~nce was authorized to make temporary loans from the General Fund to the School Fund of amounts sufficient to meet the School~s requirements until the revenue from the current year ' s levy is rec~eived. Mr. Fred ~. Forberg of the State Department of Taxation appeared before the Board concerning the procedure bein~ followed by the County in it~ 7_e~r~l ~~+. ~e-~o'~ property. Mr. Forberg stated that there appeared to be two courses open to the County under which it might proceed under its general reassessment: first, the County could proceed under its E~ualization Board in which case the Equalization Board would make a complete report on all properties in the County which were equalized and issue equalization orders for same ; or mecond, proceed the ~eneral reassessment under a board of assessors appointed by the Circuit Court. After a discussion of the matter Mr. Forberg stated that it was the opinion of Mr. Morrisse~t, State Tax Commissioner that the County's procedure under the Equalization Board complie~ with the statutes regarding the general reassessment of real property in the countie~ of the Commonwealth. Upon this advice and opinian it was agreed that the County would e0nti e its general reassessment under the Equalization Board. Mr. David Ao Lyons, Delinquent Personal property tax collector, appointed by the Board appeared and expressed the feeling that since the Director of Finance had made an extensive drive for the collection of delinquent taxes after his appointment as delinquent tax collector, he felt he should~be allowed his commission on $1100. of delinquent personal property tax collections made b~etween July 1st and October 12th, the date on which he arrived to begin his work. Mr. Robinson~ concurred in this feeling and on motion of Mr. Chiles, seeonded by Mr. Dorrier, it was ordered that~r. Lyons be allowed his commission on these tax collections.
