Pursuant to the following waiver, the members of the Board of County Supervisors of Albemarle County met in special session on this date with the following members present: Messrs. C. Purcell McCue, E. J. Ballard, Henry Chiles, C. R. Dorrier, P. B. Peyton, and W. W. Wood. We, the undersigned members of the Board of County ~p~rvisors of Albemarle County hereby waive notice, and special service thereof, of a meeting to be held at 2:00 P. M. on the 10th day of November, 1948, at the County Office Building, for the put. pose of considering the procedure to be followed by the County in its general reassess- ment of real property; and we do hereby consent to the transaction of any and all business and the taking of such action at said meeting upon'the matter hereinabove mentioned as may be lawful, incident and necessary thereto. Peyt~n Mr. ~cCue, Chairman, called upon Mr. Robinson, County Executive to bring the Board up to date on ~elopments which have taken place since the Board's regular meeting regarding~ the procedure being followed by the County in its general reassessment of real property. In the absence of Mr. W. O. Fife, Commonwealth's attorney, due to illness, Mr. Robinson stated that he and Mr. D. B. Marshall, Attorney of Mr. Fife's office, had had a conference with Mr. C. H. MorrisseSt, State Tax Commissioner, regarding the County's general reassessment of real property and that Mr. Morrissett had stated that in h~s opinion Section 242 of the Tax Code of Virginia makes mandatory a general reassessment of all real estate in the County of Albemarle in the year 1948, and that Mr. Marshall concurred in this opinion. Mr. Marshall pointed out that Section 242 of the Tax Code directs that such reassessment shall be mccom, i plished by a board of assessors to be appointed by the Circuit Judge of the Co~ty and he stated that Mr. Morrissett felt that it would be somewhat inconsistent to have the Board of i Equalization serving at the same time as that of a board of assessors. The members of the County's Equalization Board who were present on request in realizing the technicalities confronting the County offered their resignations. Upon motion of Mr. Henry Chiles, seconde~ by Mr. C. R. Dorrier, it was ordered that the resignation of the members of the County's Board County of Equalization be accepted and the'~J. Board of/Supervisors expressed its profound gratitude to '. ~these men~Tor the service which they have rendered to the citizens of Albemarle County in thei, outstanding work done by these men. ~.motion of Mr. Chiles,.seconded by Mr. Dorrier, and unanimously passed, the following resolution was adopted: WItEREAS, we, the members of the Board of Count~ Supervisors of Albemarle County, Virginia, have been advised that a certain Act of in the County of Albemarle in the year 1948, and, WHEREAS, the said Act directs that such reassessment shall be accomplished by a board of assessors to be appointed by the Circuit Judge of said County° NON, THEREFORE, be it unanimously resolved this 10th day of November, 1948, that a request be made and is hereby made by this Board to Judge Lemuel F. Smith to appoint, in accordance with Section 242 of the Tax Code of Virginia, and such other statutes as may be applicable, such person or persons as he shall see fit to serve as assessors for the said general reassessment, and it is further hereby resolved that a copy of this resolution be presented to Judge Smith as soon as is practicable. Upon motion of Mr. Wood, seconded by General Peyton, the following resolution was unanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County that the rate of compensation for such person or persons as may be appointed by the Circuit Judge to serve as assessors for the general reassessment of real property in Albemarle County be set at $10 per diem plus 5¢ per mile for necessary mileage.
